HomeMy WebLinkAbout1959_08_26 Zoning Board of Appeals Minutes r MINUTES OF A REGULAR MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD AUGUST 26, 1959, IN THE COURT ROOM OF POLICE HEAD- QUARTERS, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK° CALL TO ORDER In the absence of the Chairman, Mr. Wullschleger, the meeting was called to order at 8:00 p. m. by Mr. Schuler, Acting Chairman. PRESENT: Mr. George Schuler, Acting Chairman Mr. Sydney Bierman Mr. Laurence Sobel Mr. Phil Corby ALSO PRESENT: Maurice Friedlander, Town Engineer & Building Inspector ABSENT: Chairman Wullschleger APPROVAL OF MINUTES The minutes of the meeting held June 24, 1959, were approved as presented. HEARINGS The secretary presented the affidavit of publication of notice of the hearing as published in the official newspaper of the Town of Mamaroneck, The Daily Times, on August 19, 1959. The Chairman declared the hearing open and requested the secretary to read the first application. 57 APPLICATION NO. 1---GLORIA LEVINE Case # 43 Application of Gloria Levine for modification of Article IV, Section 410 (formerly Article III, Section 9) of the Zoning Ordinance of the Town of Mamaroneck, so as to permit the addition of a bedroom and bath and the extension of the living room on a residence located at 584 Weaver St. and known on the Tax Assessment Map of the Town of Mamaroneck as Block 225, Parcel 228, having a rear yard of 18 feet and a side yard of 8 feet, on the grounds of practical difficulty and unnecessary hardship. This appeal is taken under Article V, Section 550. 2 of the Zoning Ordinance of the Town of Mamaroneck adopted June 29, 19 59. At this time Mr. Corby stated for the record that he had an interest in the Bonnie Briar Holding Corp. the property of which adjoins that referred to in this application. Mr. Brill, attorney for Mrs. Levine, stated there was no challenge as far as he was concerned as he felt certain Mr. Corby held no bias. Following Mr. Corby's statement and Mr. Brill's reply, the chairman inquired as to whether any other interested person had any objection to Mr. Corby serving in this matter. There was none. The Chairman then asked if anyone present wished to speak either in favor of or in opposition to this application and the following persons were heard: For Applicant: William Brill, Esquire 175 Boston Post Rd. Larchmont In Opposition: Mr. Daniel Mahony 580 Weaver St, , Larchmont Mrs. Daniel Mahone 580 Weaver St. , Larchmont Mr. Brill, representing Mrs. Levine, appeared and submitted the plans for the addition to the house. Mr. & Mrs. Mahony, 580 Weaver Street, addressed the Board 58 stating that they were the owners of the property adjacent to the applicant's and had not received any notice of this hearing in the mail. They further stated that they had no knowledge of the hearing until to day and therefore no opportunity to view the plans for the addition nor were they able to secure the services of a lawyer. Mr. Sobel pointed out that very rarely did any person other than the applicant secure the services of an attorney. Following further discussion, upon motion by Mr. Schuler, seconded by Mr. Bierman, the following resolution was unanimously adopted: RESOLVED that the hearing on the application of Gloria Levine be adjourned until the meeting of the Board of Appeals on September 23, 1959, and: . FURTHER RESOLVED that the notice of hearing be readvertised, at no cost to the applicant, and the usual notice be mailed to all interested parties, OLD BUSINESS APPLICATION OF JOSEPH & CATHERINE GIACOMO Case # 33 For the purpose of clearing the record,the chairman requested the Board to act on the above application, continued at the meeting of March 25, 1959. Whereupon on motion by Mr. Bierman, seconded by Mr. Corby, it was unanimously: RESOLVED that the application of Joseph and Catherine Giacomo for modification of Article III, Section 14 of the Town of Mamaroneck Zoning Ordinance, as amended, so as to permit the erection of a two family dwelling u on Lester Place on premises known as Block 132, Parcel 125 on the Tax Assessment Map of the Town of Mamaroneck, be considered abandoned and therefore discontinued. FURTHER RESOLVED that this decision be filed with the Town Clerk as provided by Section 267 of the Town Law. 59 ADJOURNMENT There being no further business to come before this meeting it was adjourned at 8:30 p. m.
