HomeMy WebLinkAbout1950_08_23 Zoning Board of Appeals Minutes II MINUTES OF A REGULAR MEETING OF THE BOARD OF APPEALS OF THE TOWN OF MAMARONECK, HELD ON AUGUST 23rd, 1950, IN THE BOARD ROOM AT 11 EDGE- WOOD AVENUE, LARCHMONT, N. Y. Mr. Quinn called the meeting to order at 8: 15 P . M. PRESENT: Mr. Quinn, Chairman Mr. Butterfield Mr. Wullschleger Mr. Mink ABSENT: Mr. Burke Presence was also noted of Mr. Delius, Town Attorney, and Mr. Foote, Town Engineer. The application before the Board was that of Wilma Harris for per- mission to use property on the south side of Washington Street, 150 feet westerly from North Chatsworth Avenue, known on the Tax Assessment Map of the Town of Mamaroneck as Block 133, Parcel 707, as a parking space for automobiles owned by tenants of the Oak Haven Apartment which adjoins the premises. J This application was before the Board at its previous meeting, and was denied. At the present hearing, Mrs. Harris was represented by Mr. Samuel J . Kalmanson, an attorney of New Rochelle, who stated that he had new facts to present to the Board. He said he had discussed this matter with others who felt that a parking space was needed in this area as the Police and Fire Departments have a problem, because of the parking in the street. In fact, he said, he would consider amending the application to request the Board to grant permission for public parking on the lot. Mr. Kalmanson said he had discussed the matter with the Fire Chief who would be on hand to state his views to the Board this evening. The Chairman asked if there was any opposition to this application and Mr. Anthony Carpino, representing Michael and Angelo Carpino, presented a letter from *fir, Michael Carpino. He then went on to say that there is ample off street parking space in that area, and his family objects to the present application because the noise, especially at night, and fumes would be a nuisance as the con- templated parking space is within 10 feet of their home. Mr. Tony Mirandi, representing his Mother, said that he and his mother object to this application. He said also, that if this application is granted the parking space will be only about 6 feet away from a shingle house in which his uncle lives. Mr. Quinn read the letter from Mr. Carpino and it was ordered received and filed. -111- Mr. Kalmanson was granted time to attempt to contact the Fire Chief at his homw, but was unsuccessful . The Chairman then asked Mr. Kalmanson if he wished to take an ad- journment to enable him to produce any other or further evidence he might have, or additional testimony. Mr. Kalmanson did not wish to do this. *********ram*****xx** The Board then went into executive session and discussed this application. Upon motion duly made and seconded, it was RESOLVED that the application of Wilma Harris for permis- sion to use property known as Block 133, Parcel 707, on the Tax Assessment Map, as a parking space for automobiles owned by tenants of the Oak Haven Apartment which adjoins the premises, be and the same hereby is denied upon the ground that the applicant has failed to show unnecessary hardship or practical difficulty in abiding by the pro- visions of the Ordinance. A vote taken on this resulted as follows: AYES: Mr. Quinn Mr. Mink Mr. Butterfield Mr. Wulischleger NOES: None There being no further business the meeting adjourned at 9: 15 P. M. Secretary -112-
