CALL TO ORDER The Chairman called the meeting to order at 8:00 p.m. PRESENT: Mr. A. E. Wullschleger, Chairman Mr. Sydney Bierman Mr. Robert L. Parsons ABSENT: Mr. Laurence J. Sobel Mr. George Schuler ALSO PRESENT: Mr. McEvoy, Assessor Mr. Friedlander, Town Engineer APPROVAL OF MINUTES On motion of Chairman Wullschleger, seconded by Mr. Parsons, . the minutes of the meeting of March 27, 1957, were approved as presented. APPLICATION #1 - Anna Silver At the request of the Chairman, the Secretary presented the affidavit of publication of the notice of hearing as published in the official newspaper of the Town of 4 Mamaroneck, The Daily Times, on April 17, 1957, and read the first application as follows: Application of Anna Silver for modification of Article III, Section 9 of the Zoning Ordinance, as amended, so as to permit the erection of a 4 foot extension to the existing attached garage, on premises known 139 V Y • • . . as Block 211, Parcel 1 on the Tax Assessment Map of the Town of Mamaroneck, having a set back from Stoneyside Drive of 22 feet rather than the required 30 foot set back, on the ground that there is prac- tical difficulty and unnecessary hardship in con- forming with the provisions of the Zoning Ordinance regarding set backs because this is a cofner lot. The following persons were heard: For Appellant: Mr. Edmund Dawson 21 North Chatsworth Avenue, Larchmont, representative for Mrs. Anna Silver. • In opposition: None Mr. Dawson, appeared for Mrs.Anna .Silver. He explained in detail that the reason for Mrs. Silver's request for the variance was that the present garage is inadequate• for the • modern type of passenger automobile. Thereupon, after the Chairman had ascertained that no other person wished to speak either for or against this application; ' on motion, by Chairman Wullschleger, seconded by Mr. Parsons, the following resolution was unanimously adopted. WHEREAS, Anna Silver,has filed an appeal from a de- cision of the Building Inspector of the Town of Mamaroneck refusing a permit for an structural addition on property located on the northerly side of Ellsworth Road, and easterly side of Stoneyside Drive, and*known on the Tax Assessment Map of the Town of Mamaroneck as Block 211, Parcel• 1; and WHEREAS, Anna Silver requests that because the present structure is inadequate for modern type passenger automobiles, this Board grant a variance and over-rule the decision of the Building Inspector; and WHEREAS, this Board has viewed the property and has examined the plans and other matters submitted by the applicant, and has heard all persons appearing 4 for or against the appeal; NOW, THEREFORE, BE IT RESOLVED that the appeal of Anna Silver,from the decision of the Building Inspector refusing the issuance of a permit for a structural addition to the 140 present building, located on the northerly side of Ellsworth Road and easterly side of Stoneyside Drive, and known on the Tax Assessment Map of the Town of Mamaroneck as Block 211, Parcel 1, having a set back from Stoneyside Drive of 22 feet rather than the required 30 foot set back, be granted pursuant to Article III, Section 9 of the Zoning Ordinance of the Town of Mamaroneck, which requires that no part of any building shall be built within 30 feet of any street line, except that on corner lots such buildings may be set back a less distance from the side street, with the approval of the Board of Appeals. Further RESOLVED that this decision be filed with the Town Clerk as provided by Section 267 of the Tuwn Lay.
