APPEALS OF THE Town of MMARONECK, HELD JULY 27,1960,
IN THE COURT ROOM OF POLICE HEADQUARTERS, TOWN OF
MAMARONECK POLICE, 11 EDGEWOOD AVENUE; LARC1 ONT.
CALL TO ORDER
The Chairman called the meeting to order at 8:00 p.m.
PRESENT: A. E. Wullschleger, Chairman
George Schuler
Laurence Sobel
Philip Corby
ABSENT; Sydney Bierman
ALSO PRESENT: Maurice Friedlander, Town Engineer
John L. Delius, Town Attorney
MINUTES
The minutes of the regular meeting of June 29, 1960
were approved as corrected. Mr. Sobel made the
correction suggesting that mention be made that
Mrs . Charles Kelley had filed her application for
a fence variance under the name of Norma C . Neason
which application was granted at the June 29th
meeting.
HEARINGS
The Chairman declared the hearing open and stated
that the first application to be acted on would
be that of the Howell Park Association and Peter
G. Moore which was adjourned from the meeting of
June 29, 1960.
Mr. Johnston and Mr. White, attorneys, appeared
and asked that the matter again be adjourned until
a full Board were present.

Whereupon, on motion by Mr. Schuler, seconded by
Mr. Wullschleger, the following resolution was unan-
imously adopted:
RESOLVED that at the request of Mr. Johnston and
IIr. White, the hearing on the application of
Howell Park Association and Peter G. Moore be
adjourned until the regular meeting of the Board
on October 26, 1960.
FURTHER RESOLVED that this decision be filed
with the Town Clerk as provided by Section 267
of the Town Law.
The secretary then presented the affidavit of the
publication of the notice of hearings as published
in the official newspaper of the Town of Mamaroneck,
The_Daily Times, July 18, 1960.
The Chairman then requested the secretary to read the
second application.
APPLICATION NO.2---ADAM SULIETZ Case # 75
Application of Adam Sumetz for permission to erect
8 lineal feet of 4' 6" in height, 8 lineal feet of
fence 5' 0" in height, and 124 lineal feet of fence
6 ' 0" in height, to be located in the rear yard
and along the southerly side yard on premises
located at 12 Normandy Road and known on the Tax
Assessment i"ap of the Town of Mamaroneck as Block
130, Parcel 1, in accordance with Article IV,
Section 421.4 of the Zoning Ordinance of the Town
of Mamaroneck.
The Chairman asked if anyone present wished to
speak either in favor of or in opposition to this
application and the following persons addressed
the Board:
For Appellant: Adam Sumetz
In Opposition: None
Mr. Sumetz submitted plans for the fence and explained
that because of the contour of the land he proposed
to erect the fence at different heights so as to make
it appear level.
Following a short discussion on motion by Mr. Corby,
seconded by :Jr. Sobel the following resolution was
unanimously adopted:

WHEREAS,�IIiZR,�AS, Adam Sumetz heretofore requested a Il
permit for the erection of 8 lineal feet of
solid fence 4' 6" in height and 8 lineal feet
of solid fence 5' 0" in height and 124 lineal
feet of solid fence 6' 0" in height to be
located in the rear yard and along the southerly
side yard of premises located at 12 Normandy
Road and known on the Tat Assessment Map of
the Town of Mamaroneck as Block 130, Parcel
1; and
WHEREAS, the Building Inspector has refused to
grant such permit on the ground that construction
or erection of such fence violated Article IV,
Section 421.4 of the Zoning Ordinance of the
Town of Lamaroneck; and
WHEREAS, Adam Sumetz has appealed to this Board
for modification of the Building Inspector's
decision pursuant to Article IV, Section 421.4
so as to allow the erection of said fence:
NOW, THEREFORE, BE IT
RESOLVED that permission is granted Adam Sumetz
to erect 8 lineal feet of solid fence 4' 6" in
height and 8 lineal feet of solid fence 5' 0"
in height and 124 lineal feet of solid fence
6 ' 0" in height to be located in the rear yard
and along the southerly side yard on premises
located at 12 Normandy Road and known on the
Tax Assessment rap of the Town of Mamaroneck
as Block 130, Parcel 1; and it is
FURTHER RESOLVED that this resolution be filed
with the Town Clerk as provided in Section 267
of the Town Law.
The Chairman then requested the secretary to read
the first application.
APPLICATION NO.1--E.J.EGAN FOR EDGAR ADSIT Case # 70
Application of Edward J. Egan, agent for Edgar
Adsit, for modification of Article IV, Section
410, Schedule of Residence District Regulations,
and Article IV, Section 400.4, Division of an
Existing Lot, so as to permit the construction
of a one family dwelling on a lot, which by
division of the existing lot into a parcel,
results in a building lot with a frontage of
25 feet on Homer Avenue, rather than the required
85 feet, on premises known as Block 121., Part of

Parcel 426 which is divided, on the ground of
practical difficulty and/or unnecessary hardship.
The Chairman inquired as to whether anyone present
wished to speak either in favor of or in opposition to
this application and the following persons addressed
the Board:
For Applicant: Edward J. Egan, Esquire
250 Park Avenue
New York, N.Y.
In Opposition: Er. Joseph Goldberg
20 Homer Ave. ,Larchmont
Mr. & Mr s . S. LI. Haviland
28 Homer Ave. , Larchmont
Mr. Egan, representing Mr. Adsit, submitted plans for
the proposed house and stated that his client had
owned this property since 1949. Mr. Adsit had purchased
the property for his own protection but was now selling
his home and the purchaser was hot interested in
keeping this property. He also pointed out that the
contiguous property had only 25 foot frontage.
Mr. Goldberg and Mr. Haviland stated that they thought
another driveway on Homer Avenue would create additional
traffic hazards and therefore they were not in favor
of the granting of this application.
The Board members then questioned Mr. Sumetz, who is to
be the builder, as to whether the house could be Set
further back and provide in that way for a turnaround
driveway. Ir. Sumetz said he would have to give the
matter further study.
Following further discussion, on motion by Er. wullschleger,
seconded by Mr. Schuler the following resolution was
adopted unanimously:
RESOLVED that the hearing on the application
of Edward J. Egan for Edgar Adsit, be and
it hereby is adjourned to a special meeting
of this Board, to be held Wednesday, August
3 , 1960, and be it
FURTHER RESOLVED that this decision be filed
with the Town Clerk as provided in Section
267 of the Town Law.
ADJOURNMENT
There being no further business to come before this
meeting it was adjourned at 9:16 p.m.
