ZONING BOARD OF APPEALS OF THE TOWN OF MAMARONECK
FEBRUARY 26, 1986, IN THE COURTROOM, TOWN OFFICES,
BOSTON POST ROAD, MAMARONECK, NEW YORK
CALL TO ORDER
The meeting was called to order by the Chairman at 8:40 P.M.

APPROVAL OF THE MINUTES
Mr. Kelleher moved, Mr. Simon seconded, and the minutes of the
meeting on January 29, 1986 were unanimously approved.
SCHEDULING
The Board changed the March meeting to Thursday, March 27, 1986.
PROCEDURE
The Chairman explained to all present that each applicant would
have the option to postpone their applications until the next
meeting, as there are only three members present and therefore,
approval of any application would require a unanimous vote. All
applicants were asked individually if they wanted to proceed.

APPLICATION NO. 1 - CASE 679
The Public Stenographer recorded this case, and his report will
become a permanent part of this record.
This applicant chose to postpone until the next meeting.
APPLICATION NO. 2 - CASE 703
The Public Stenographer recorded this case, and his report will
become a permanent part of this record.
Mr. Kelleher moved that this petition be accepted on the basis of
economic hardship and practical difficulty, with the requirement
that the easement must be filed with the Building Department of
the Town of Mamaroneck. Mr. Simon seconded this motion and the
Board approved the application unanimously.
APPLICATION NO. 3 - CASE 708
This case was postponed until next month.
APPLICATION NO. 4 - CASE 720
The applicant requested postponement until next month via a
letter submitted to the Board on February 25th.
APPLICATION NO. 5 - CASE 722
This application was read by the Chairman as follows:
Application of Mr. Steven P. Rosen for modification of Article VI
Section 89-30, Sub-Section B(2) "Construction Requirements for
R-30 One Family Residence District" which requires a minimum side
yard of 20 ft, to allow the construction of a 1 story addition at
the southeast corner of dwelling for an enclosed porch having a
minimum side yard setback of 19.04 ft. on the premises located at
2 Boulder Brae Lane and known on the Tax Assessment Map of the
Town of Mamaroneck as Block 313 Parcel 261 on the grounds of
practical difficulty and/or unnecessary hardship.
Judith Cohen, Mr. Rosen's wife, explained that the application
was for a variance to put up a screened-in porch on an existing
structure. The side yard will be 1/2 foot less than the required
side yard.
J. Cohen had submitted to the Board a petition in which each
neighbor states that they have no problem with the addition.

Mr. Pia, a neighbor who is abutting the side yard in question,
wrote a letter stating that he is in support of the addition, and
did appear at the hearing to confirm that.
The Chairman read a letter written by Mr. Pia, of 3 Boulder Brae
Lane, which was also signed by Mr. Edward Polak, 1 Boulder Brae
Lane, and Mr. Daniel W. Greenbaum of 4 Boulder Brae Lane. The
letter was in clear support of the addition.
There were no objections from anyone in the audience.
The Chairman moved that this is a Type II action which has no
adverse environmental impact. Mr. Kelleher seconded this motion,
and the Board accepted this unanimously.
Mr. Simon moved that this application be approved on the grounds
of practical difficulty and hardship, as it is only a minor
variance and there are no objections. Mr. Kelleher seconded this
motion and the application was approved unanimously by the Board.
APPLICATION NO. 6 - CASE 723
The Public Stenographer recorded this case, and his report will
become a permanent part of this record.
The Chairman read the application as follows:
Application of Mr. Frank Calogero for modification of Article V
Section 89-28-A "Permitted Uses in "B" Business District which
does not permit Building Contractor's Establishments in "B"
Business District; Article X Section 89-56-A "Non-Conforming Use
of Buildings" which does not permit enlargement of non-conforming
buildings; Article VII Section 89-41 Sub-Section A-3 which
restricts a maximum building coverage to 25% to allow the
construction of a 2 Story Addition to be used as a Contractor's
Establishment which will create a maximum building coverage of
39.34%, existing building coverage is 29%, on the premises
located at 8 Valley Place and known on the Tax Assessment Map of
the Town of Mamaroneck as Block 131 Parcel 11 on the grounds of
practical difficulty and/or unnecessary hardship.
Following the presentation of the case by the applicant, and
questions from the Board, there were no comments, for or against,
from the audience.
The Chairman moved that this be considered a Type II action,
having no adverse environmental impact. Mr. Kelleher seconded
this motion, and the Board accepted it unanimously.
Mr. Simon moved that the application be accepted on the grounds
of practical difficulty and hardship, as the area where the
variance will be granted will not be adversely effected. Mr.
Kelleher seconded this motion, and the Board accepted it
unanimously.

ADJOURNMENT
There being no further business to come before the Board, the
Chairman moved to adjourn, Mr. Kelleher seconded this motion, and
the meeting was unanimously adjourned at 9:15 P.M.
