OF MAMARONECK HELD SEPTEMBER 8, 1976 , IN THE COUNCIL ROOM OF THE
WEAVER STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, LARCH-
MONT, NEW YORK.
CALL TO ORDER
The meeting was called to order by the Chairman at 8:20
P.M.

Present: Mr. Fred L. Maggini , Chairman
Mr. Joseph Rigano
Mr. G. Norman Blair
Mrs. Mary Carlson
Absent: Mr. Edward J. Cibulay
Also present: Mr. Charles R. Elfreich, P.E. , Town Engineer
APPROVAL OF MINUTES
The minutes of the meeting of July 14, 1976, were presented
and on motion duly made and seconded, approved as submitted.
APPLICATION FOR SPECIAL PERMIT - COOK'S RESTAURANT- BLOCK 412 PARCEL 449
Mr. Maggini explained to those present that Mr. Cook was
applying for a Special Permit to install a refrigerator
building on his property at 1265 Boston Post Road.
Mr. Donald S. Mazin, an Attorney, of 1415 Boston Post
Road represented Mr. Cook and said that the proposed build-
ing was 8' x 18' and 9' high. He stated that the front
setback was 58 ft. and 34 ft. from the rear and one park-
ing space would be eliminated. Mr. Mazin further stated
that the applicant intended to provide screening and that
the unit was factory assembled, therefore, requiring no
construction. He, also, said that no lighting was required
and it would create very little noise.
Mr. Rigano asked what the unit would set on and the answer
was a concrete pad. Mr. Maggini questioned as to whether
the cooling unit was sealed and the reply was yes.
The Chairman asked if there was anyone in opposition.
Mr. Otto Scheuble of 3 Rock Ridge Road, Larchmont, said
he thought no further building should be allowed until
Mr. Cook brought the present building into conformity.
Mr. Maggini advised Mr. Scheuble to present his letters
and objections to the Town Board at the Public Hearing.
Mr. Kirchoff of 25 Rock Ridge Road inquired as to why
the applicant had to apply for a Special Permit and he
was told that in 1976 the Town Board had approved a change
in the Zoning Regulations which placed restaurants as
a Special Use instead of a Permitted Use. It is now nec-
essary if any extension or addition to such use or any
enlargement or extension of any building or structure
be subject to the requirements for Special Permits.
After further discussion the Board decided they would
make their recommendation to the Town Board approving
the application with the provision that the applicant
provided adeauate screening.
ADJOURNMENT
There being no further business to come before this meet-
ing it was adjourned at 8:45 P.M.
