MAMARONECK HELD NOVEMBER 8, 1978, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, LARCHMONT,
NEW YORK.
CALL TO ORDER
The meeting was called to order by the Chairman at 8:25
P.M.

APPROVAL OF MINUTES
The minutes of the meeting of October 11 , 1978 were pre-
sented and on motion duly made and seconded, approved as
submitted.
PRELIMINARY HEARING - SUBDIVISION OF DOHERTY PROPERTY - BLOCK 504
PARCEL 252 AND PART OF PARCEL 231
The Board discussed the application of Mrs. Doherty, who
was represented by Mr. Dennis Dillingham, for the subdivi-
sion of the lot into two parcels. A question was raised
as to the status of the road and the location of the utili-
ties and services.
After further discussion the Board advised the applicant
to check further to see if they could find out who owns
the road, and Mr. Elfreich said he would check the Town
records to see if he could find any information.
PUBLIC HEARING - MARBOURNE MEADOWS
The Chairman asked the Secretary to read the Public Notice.
PLEASE TAKE NOTICE that the Town of Mamaroneck Planning
Board pursuant to Sections 276 and 277 of the Town Law
will hold a Public Hearing on November 8, 1978 in the Coun-
cil Room of the Weaver Street Firehouse, Weaver Street
and Edgewood Avenue, Town of Mamaroneck, Larchmont, New
York at 8: 15 P.M. on the application of Marbourne Meadows
Associates for the subdivision of land formerly owned by
Idella Marx and known on the Tax Assessment Map of the
Town of Mamaroneck as Block 333 Parcel 66. The proposed
subdivisions are depicted on maps prepared by Arthur J.
Van Suentendael III , dated 10/27/78.
Mr. Blair explained to those present that the plans were
basically the same and there were no changes but were more
detailed. The Chairman pointed out that some of the street
grades are right up to the limit.
Mr. Elfreich had written a memo to the Board in which he
recommended that the Board approve the subdivision subject
to the final approval of those departments having respon-
sibility.
Mr. Roger Sirlin, an Attorney, of 211 Mamaroneck Avenue,
said he was representing the residents of Fairway Drive,
who are objecting to the road running immediately behind
their homes. Mr. Sirlin said there was a disagreement
between Mr. Anderson, the Architect, engaged by the resi-
dents of Fairway Drive and Mr. Van Suentendael , the Archi-
tect, for the developer, as to the location of the road.
Mr. Sirlin said that there is also litigation concerning
adverse possession to property for roadway rights by Dr.
and Mrs. Drachman and Mr. and Mrs. Morton Green.
Mr. Mantell , who represented the developers, said that
with respect to the litigation on behalf of the Drachmans
and Greens he did not feel they had a case and urged the
Board to approve the subdivision as submitted. Mr. Mantell
said that in regard to the Rothmans who have an injunction
against the developers to stop them from removing shrubs
which the Rothmans had planted, they have had many discus-
sions and are close to an agreement.
Mr. Barry Mendelson, of 14 Fairway Drive, who is object-
ing to the road behind his home urged the Board to recon-
sider. He pointed out that the developer has not cooperated
with their requests to relocate the proposed road to the
rear of their properties. He stated that the Planning
Board has an obligation to protect the rights of all resi-
dents of the Town and he suggested that the Board should
force the developer to put in shrubs or a fence to protect
their privacy if the proposed plans were approved by the
Board. The Board pointed out that they do not have authority
to force residential developers to provide screening but
they could request it.
After further discussion the Board decided they would con-
sult the Town Attorney before they make their decision.
OLD BUSINESS - THE FAIRWAYS AT PRINCE WILLOW
Mr. Elfreich had written to the Planning Board stating
that the developer had completed the replacement and re-
pairs to the curbing and patched the asphalt road surface
as directed. Mr. Elfreich said he and Mr. Aitchison, the
Superintendent of Highways, were recommending that the
streets be accepted by the Town Board. After a brief dis-
cussion the Board decided to recommend that the Town Board
accept the streets as requested by the developer.
ADJOURNMENT
There being no further business to come before this meet-
ing it was adjourned at 9:45 P.M.
