NEW YORK.
CALL TO ORDER
The meeting was called to order by the Chairman at 8:30
P.M.

APPROVAL OF MINUTES
The minutes of the meeting of April 13, 1977 were presented
and on motion duly made and seconded, approved as submitted.
PUBLIC HEARING - SUBDIVISION OF LOT - DURHAM AND FENIMORE ROADS -
BLOCK 203 PARCEL 32
The Chairman asked the Secretary to read the Public Notice.
PLEASE TAKE NOTICE that the Town of Mamaroneck
Planning Board pursuant to Sections 276 and 277
of the Town Law will hold a Public Hearing on
May 11 , 1977 in the Council Room of the Weaver
Street Firehouse, Weaver Street and Edgewood
Avenue, Town of Mamaroneck, Larchmont, New York
at 8: 15 P.M. on the application of Mr. and Mrs.
Donald Miller for the approval of a subdivision
of a lot located on the southwest corner of
Durham and Fenimore Road and known on the Tax
Assessment Map of the Town of Mamaroneck as
Block 203 Parcel 32 and shown on a map prepared
by Mr. Sal Spinelli dated May 2, 1977.
TAKE FURTHER NOTICE that all persons present
will be given an opportunity to be heard.
Mr. Richard Spinelli , who is also a Surveyor, represented
his father, Mr. Sal Spinelli and spoke for the applicants,
Dr. and Mrs. Donald Miller. Mr. Spinelli said the appli-
cants propose to split the property into three lots, with
two lots fronting on Durham Road and the other on Feni-
more Road. He further stated that the two lots which
will front on Durham Road have an existing sewer.
It was pointed out that the Millers had informally sub-
mitted another proposal for the subdivision of the lot
but it was not feasible as the cost for the improvements
were far more expensive than the amount they would have
received from selling the lots plus the fact that some
of the lots were not conforming to the zoning. The pre-
sent plan conforms to the zoning.
After discussion, the Board decided to approve the appli-
cation and the following Resolution was adopted:
WHEREAS, Dr. and Mrs. Donald Miller, owners of
the premises located at 1 Durham Road and known
on the Tax Assessment Map of the Town of Mama-
roneck as Block 203 Parcel 32 and shown on a
map prepared by Mr. Sal Spinelli dated May 2,
1977, has filed with this Board an application
for the approval of the subdivision of this plat;
and
WHEREAS, pursuant to Sections 276 and 277 of
the Town Law, a Public Hearing was held on May
11 , 1977 after notice was published in the of-
ficial newspaper of the Town of Mamaroneck, the
Daily Times ; and
WHEREAS, this Board has examined the plans and
determined that the same are all satisfactory;
NOW, THEREFORE, BE IT
RESOLVED, that the application of Dr. and Mrs.
Donald Miller be approved subject to the appro-
val of the Westchester County Health Department
and the Chairman of the Planning Board is hereby
authorized to sign such subdivision map as evi-
dence of the approval of same.
APPLICATION FOR DEVELOPMENT OF PROPERTY IN THE VILLAGE OF MAMARONECK
The Chairman advised those present that he had received
a copy of a plan from the Village of Mamaroneck showing
the proposed development of property off of Fenimore
Road. The plan is for 24 condominium apartments
and adjoins property in the Town of Mamaroneck on
Country Road and Country Lane.
Dr. William Nelson, 1 Country Lane; Dr. Lawrence Greenhill ,
9 Country Lane; Mr. Gary Hirschberg, 3 Country Lane;
Dr. and Mrs. Henry Makover, 3 Country Road; Mr. Paul
Jenisch, 2 Country Road and Mr. Richard J. Gramaglia,
5 Country Road, all spoke in opposition to the applica-
ation and asked the Town to voice their objection to
the application at the Village meeting to be held Thurs-
day, May 12, 1977. Their main objections were traffic,
drainage problems and blasting. Dr. Makover said that
no matter what the Village decides to allow on the pro-
perty in question it will directly effect the residents
of that section.
Mr. Maggini advised those present that he would attend
the Village meeting on the following night and convey
their message to the Village Board.
ADJOURNMENT
There being no further business to come before this meet-
ing it was adjourned at 10:00 P.M.
