MINUTES OF A REGULAR MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK HELD MARCH 14, 1979, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, LARCHMONT, NEW YORK. CALL TO ORDER The meeting was called to order by the Chairman at 8:35 P.M. ROLL CALL Present: Mr. G. Norman Blair, Chairman Mr. Fred L. Maggini Mrs. Mary Carlson Absent: Mr. Joseph Rigano Mr. Edward J. Cibulay Also present: Mr. Charles R. Elfreich, P .E. , Town Engineer APPROVAL OF MINUTES The minutes of the meeting of February 14, 1979 were pre- sented and on motion duly made and seconded, approved as submitted. REFERRAL FROM TOWN BOARD FOR REZONING OF BLOCK 406 PARCEL 335 The applicant, A. R. Spencer Associates , Inc. of 174 East Boston Post Road, Mamaroneck, New York, was represented by Mr. David J. Jutkowitz, an Attorney. Mr. Jutkowitz said that their reason for the petition merits considera- tion because the area that surrounds the property in ques- tion contains only two houses that comply with the R-7.5 Zone . Mr. Jutkowitz stated that his client proposes to put in three lots of approximately 7200 sq . ft. and they feel it would be an improvement to the neighborhood rather than a detriment. He further said that the addition of two more new homes would add to the tax base and would make the present houses that are non-conforming more con- forming to the proposed change in the zoning from R-7.5 to R-6. Mr. Maggini asked why they couldn' t make it a two lot subdivision and the applicant said it would not be econo- mically feasible. Mr. Blair said he disagreed with the applicants statement that if the application was approved it would not constitute spot zoning. Mrs . Catherine Ferrara of 1130 Palmer Avenue said she objected to the application and that the smaller proper- ties were there a long time ago and the purpose of the © change in zoning was to upgrade the area. Mrs . Ferrara said that by changing the zoning from R-7.5 to R-6 would be downgrading and that the two new homes would add to the traffic problem that now exists on the corner of Palmer Avenue and Weaver Street. Mrs . Chesbro of 106 Weaver Street said she does not go out of her driveway when school is getting out as the traffic is so bad on Weaver Street. Mr. Robert Thomma of 1122 Weaver Street and Mr. Alan P . Murray of 116 Carleon Avenue both expressed their objec- tion to the application . After further discussion the Board decided not to reco- mmend to the Town Board that the application for rezon- ing be granted . They gave as their reasons that it would constitute spot zoning and as Mr. Maggini said he could not see the applicant 's hardship since it does not pre- sently own the property. Mr. Blair further pointed out to the applicant that if they pursued their application it would be necessary to have an environmental impact study in compliance with SEQR.
