OF MAMARONECK HELD MARCH 10, 1976, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, LARCHMONT,
NEW YORK.
CALL TO ORDER
The meeting was called to order by the Chairman at 8:25
P.M.

APPROVAL OF MINUTES
The minutes of the meeting of February 11 , 1976 were pre-
sented and on motion duly made and seconded, approved
as submitted.
PUBLIC HEARING - SUBDIVISION OF LOT ON SOUTH RIDGE ROAD - BLOCK 206
PARCEL 531
Mr. and Mrs. Frederick Landmann, the owners of the property
in question were represented by Mr. George P. Forbes, Jr.
an Attorney, of 7 Woodland Avenue, Larchmont, New York.
The Board members had inspected the site and commented
that they would like to stipulate that the front of any
proposed house shall not be set behind a line drawn from
the right rear corner of #7 and the middle break of #15
as indicated on a sketch prepared by the Town Engineer.
The Board pointed out that it would be to the Landmann' s
advantage particularly when they wanted to sell their
home.
After further discussion the Board decided they would
approve the application but would ask the Town Attorney
if the Board had the right to stipulate in the Resolution
the location of the proposed house on the lot. The Board
advised Mr. Forbes to have Mr. Spinelli , the Surveyor,
submit the final map showing the actual square footage
of both the lots and plot the location of a proposed house.
The following Resolution was duly adopted:
WHEREAS, Mr. and Mrs. Frederick E. Landmann,
owners of the premises located on South Ridge
Road and known on the Tax Assessment Map of
the Town of Mamaroneck as Block 206 Parcel
531 and shown on a Survey done by Mr. Sal Spinelli ,
New York State Land Surveyor (License No. 23043)
and dated January 25, 1976, have filed with
this Board an application for the approval of
the subdivision of this plat; and
WHEREAS, pursuant to Section 276 and 277 of
the Town Law, a Public Hearing was held on March
10, 1976 after notice was published in the of-
ficial newspaper of the Town of Mamaroneck,
the Daily Times ; and
WHEREAS , this Board has examined the plans and
determined that the same are all satisfactory,
NOW, THEREFORE, BE IT
RESOLVED, that the application of Mr. and Mrs.
Frederick E. Landmann be approved and the Chair-
man of the Planning Board is hereby authorized
to sign such subdivision map as evidence of
the approval of same.
PRELIMINARY HEARING - APPLICATION FOR SUBDIVISION OF LOT ON LARCH
LANE - BLOCK 203 PARCELS 213 and 260
Mr. Thomas J. McEvoy, the Surveyor and Mr. Robert M.
Riley, the applicant, appeared before the Board. The
Board made the same statement as in the previous appli-
cation regarding whether they had the right to stipulate
the location of a future house. It was pointed out again
that it would be to Mr. Riley' s advantage and the only
problem was that in order to comply with the Zoning Regu-
lations there would be restrictions as to the size and
type of house that could be built. Mr. Riley decided
he would discuss the problem with Mr. McEvoy and the
Chairman would advise the Secretary to arrange for the
Public Hearing to be held at the next meeting on April
14, 1976.
APPLICATION FOR REZONING OF DANDRY PROPERTY - BLOCK 501 PARCEL 1
Members of the Board had read the report from Miss Susan
Gallion of the Westchester County Department of Planning
and Mr. Maggini had prepared a letter with the recommen-
dations from the Planning Board to the Town Board. (copy
attached) .
The Board discussed the recommendations and agreed with
most of the suggestions made by the Westchester County
Department of Planning. The Planning Board members decided
that they felt the applicant should amend his application
to read from OB-1 to Business instead of L.I. After
further discussion the Secretary ,as instructed to write
the letter to the Town Board before the Public Hearing
f to be held on March 17, 1976.

There being no further business to come before this meet-
ing it was adjourned at 9:30 P.M. J

Subject: Application for Rezoning of Dandry Property from 0B-1 to L. I. - Block 501
Parcel 1
In reference to the above-mentioned application, the Planning Board disapproves of the
change of zoning from 08-1 to L. I. because in the event that the proposed "Nursery Use"
should terminate at anytime in the future, the land could then be used for light industry
which may or may not be compatible to the existing neighborhood land use.
The Planning Board recommends the following:
1. That the applicant be asked to amend his rezoning request to read from OB-1 to Busi-
ness and that the Town Board favorably consider such rezoning.
C2. That subparagraph (7) be added to our zoning regulations "Permitted Use" column
to read as follows :
Nursery Use: for the sale of plants , trees , shrubbery, nursery stock, seeds ,
nursery supplies , fertilizers , soil conditioners, garden hand
tools and accessories ; gardener's masonry and incidental sup-
plies. (fruits, vegetables and food not permitted)
The land area to be 60,000 sq. ft. or more if used for Nursery
business purposes.
3. That the proposed nursery at the above location be permitted a Zoning Variance to
permit the outdoor storage of plants, trees, shrubbery, flowers and gardener's build-
ing supplies that are incidental to the Nursery Business only.
4. That the Nursery business not be permitted the storage or sale of chemicals , mater-
ials, supplies or equipment that would create unpleasant odors, create dust, make un-
pleasant noises or be stored or located as to be unattractive to the residents in the
neighborhood.
5. That the suggestion made by the Westchester County Planning Department that the
parking spaces on the Palmer Avenue entrance be modified or relocated so as to make
the inlet flow of trafficiii0e smoothly. (If the first four parking space users were
maneuvering in or out they would hold up the Palmer Avenue entrance traffic and cause
a traffic holdup similar to that experienced at the Daitch Shopwell Shopping Center. )
6. That the owner be asked to observe the traffic flow through the nursery and that
necessary changes in the parking or traffic flow be made so as to reduce or eliminate
traffic restrictions or traffic hazards on Palmer Avenue that may be caused by the Nur-
sery Business.

7. Since the residents of Harrison Drive expressed apprehension concerning "commercial
traffic" on Harrison Drive if the nursery business is allowed and if it is decided such
a condition will exist the Town police should consider posting Harrison Drive as
"Commercial Traffic not Permitted". The Planning Board is of the opinion that because of
the hills, turns and narrowness of the road commercial traffic will not be a problem.
