CALL TO ORDER The meeting was called to order by the Chairman at 8:15 P .M. ROLL CALL Present: Mr. G. Norman Blair, Chairman Mr. Warner Pyne, Jr. Mr. Anton Schramm Mr. Paul Kalos Absent: Mrs . Mary Carlson Also present: Mr. Charles R. Elfreich, P .E. , Town Engineer APPROVAL OF MINUTES The minutes of the meeting of May 9, 1979 were presented and on motion duly made and seconded, approved as corrected. PUBLIC HEARING - APPLICATION OF MR. AND MRS. R. ESPOSITO - 112 HARMON DRIVE - BLOCK 215 PARCEL 30 The Board discussed the application of Mr. and Mrs. Esposito for the subdivisiorof the lot on Harmon Drive which had previously been heard at the April llth meeting and decided they could see no reason why it could not be granted. The Board pointed out that there had been a determination that there would be no environmental impact and the fol- lowing Resolution was adopted: WHEREAS, Mr. and Mrs. R. Esposito, owner of the premises located at 112 Harmon Drive and known on the Tax Assessment Map of the Town of Mamaroneck as Block 215 Parcel 30 shown on a map entitled "Resubdivision of lots 6 thru 10 and Portion of lots 1 thru 5 as shown on "Plan of lot called Larchmont Gardens" , in the Town of Mamaroneck, Westchester County, N.Y. and filed in the Co. Clerk's Office on March 14, 1912 as Map No. 1967" made by Richard A. Spinelli , N .Y.S. Lic. Land Surveyor No. 49240 dated May 22, 1979, has filed with this Board an application for the approval of the subdivision of this plat; and WHEREAS, pursuant to Section 276 and 277 of the Town Law, a Public Hearing was held on June 13, 1979 after notice was published in the official newspaper of the Town of Mamaro- neck , the Daily Times ; and WHEREAS, this Board has examined the plans and determined that the same are all satisfac- tory; NOW, THEREFORE, BE IT RESOLVED, that the Board has determined that the proposed subdivision will have no Environ- mental Impact; and FURTHER RESOLVED, that the application of Mr. and Mrs. R. Esposito be approved and the Chair- man of the Planning Board is hereby authorized to sign such subdivision map as evidence of the approval of same. PUBLIC HEARING - SUBDIVISION OF LOT - 108-112 LAUREL AVENUE - BLOCK 12 4 PARCEL 215 The Board discussed the application of Mrs. Rose Polera for the subdivision of a lot into three lots . This ap- plication had been discussed at the meeting of May 9, 1979. The Board decided to approve the application and stated that there had been a determination that there would be no environmental impact and the following Reso- lution was adopted: WHEREAS, Mrs. Rose Polera, owner of the premises located at 108-112 Laurel Avenue and known on the Tax Assessment Map of the Town of Mamaro- neck as Block 1'24 Parcel 215 and shown on a map entitled "Subdivision Map of Property belong- ing to Rose Polera, Town of Mamaroneck, West- chester County, New York made by Richard A. Spinelli , N.Y.S. Lic. , Land Surveyor No. 49240 dated May 23, 1979, has filed with this Board an application for the approval of the subdivi- sion of this plat; and WHEREAS, pursuant to Section 276 and 277 of the Town Law, a Public Hearing was held on June 13, 1979 after notice was published in the offi- cial newspaper of the Town of Mamaroneck, the Daily Times ; and WHEREAS, this Board has examined the plans and determined that the same are all satisfactory; NOW, THEREFORE BE IT RESOLVED, that the Board has determined that the proposed subdivision will have no Environ- mental Impact; and FURTHER RESOLVED, that the application of Mrs . Rose Polera be approved and the Chairman of the Planning Board is hereby authorized to sign such subdivision map as evidence of the approval *Ci v j of same. APPLICATION OF A. R. SPENCER ASSOCIATES - REQUEST TO TOWN BOARD FOR AMENDMENT TO ZONING ORDINANCE - BLOCK 403 PARCELS 99, 102, 105 AND 108 Mr. Frederick Wiedle, who is a Planning Consultant, rep- resented the applicants and presented the Board with a sketch of how the property was to be developed. Mr. Blair questioned as to the front setback as shown on the sketch and what was listed in Mr. Forbes petition for Section 3. Mr. Blair said that Mrs . Carlson who was not able to attend the meeting had asked him to say that she was not in favor of a "Spot Zoning Situation" . Mr. Blair said that he did not feel that Mr. Spencer had any hardship as to the use of the property as he has a legitimate use at present. It was, also, pointed out that a Doctor is permitted to have a Professional Office in his residence providing that he complies with the Zoning Requirements . Mr. Pyne questioned as to whether Mr. Spencer had prospective customers and it was pointed out that the building was not only for medical purposes but also for professional offices. Mr. Joseph Catera of 1081 Palmer Avenue said he objected and that he did not think a residential district should be involved with commercial use. Mr. Catera pointed out that there were several schools on Palmer Avenue and he had trouble getting in and out of his driveway now. Mr. Catera further said that the proposed profes- sional building would increase automobiles in a residen- tial district and they would like to preserve the character of Palmer Avenue as residential . After further discussion all the Board members agreed that they would recommend that the Town Board not approve Mr. Spencer' s application for an amendment to the Zoning Ordinance to permit medical and/or professional office buildings in a two family residential district. The members all felt that the character of the neighborhood should be preserved as residential and Mr. Blair pointed out that if the Town decided to approve the application they would require an Environmental Impact Study and a hearing should be held. The Secretary was asked to advise the Town Board of their decision. REPORT FROM FREDERICK P. CLARK ASSOCIATES The Board briefly discussed a report they had received before the meeting from Mr. Portman of Frederick P . Clark Associates regarding Town owned property between North Chatsworth Avenue and Madison Avenue. The members decided they would discuss the report more in detail at a later meeting.
