HomeMy WebLinkAbout1975_07_09 Planning Board Minutes MINUTES OF A REGULAR MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK HELD JULY 9, 1975, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, TOWN OF MAMA- RONECK, LARCHMONT, NEW YORK. CALL TO ORDER The meeting was called to order by the Chairman at 8:20 P.M. ROLL CALL Present: Mr. Fred L. Maggini , Chairman Mr. Joseph Rigano Mr. G. Norman Blair Mrs. Mary Carlson Absent: Mr. Edward J. Cibulay Also present: Mr. Charles R. Elfreich, P.E. , Town Engineer Miss Susan Gallion, Westchester County Planning Department APPROVAL OF MINUTES The minutes of the meeting of June 11 , 1975 were presented and on motion duly made and seconded, approved as submitted. PUBLIC HEARING - SUBDIVISION - BLOCK 305 PARCEL 872 Application of Mr. Stanley Rubin for the approval of a subdivision of a lot on Griffen Avenue and Murdock Road and known on the Tax Assessment Map of the Town of Mama- roneck as Block 305 Parcel 872 and shown on a map entitled "Subdivision Map of the Stanley Rubin Property in the Town of Mamaroneck, Westchester County, N.Y. " dated May 28, 1975. Mr. Stanley Rubin presented his application to the Board and the Chairman said he thought the application had been discussed thoroughly at the preliminary hearing. The Board decided they had no objection to the subdivision and the following Resolution was duly adopted: WHEREAS, Mr. Stanley Rubin, owner of the pre- mises located at 119 Griffen Avenue and known on the Tax Assessment Map of the Town of Mama- roneck as Block 305 Parcel 872 and shown on a map entitled "Subdivision Map of the Stanley Rubin Property in the Town of Mamaroneck, West- chester County, N.Y. " dated May 28, 1975 has filed with this Board an application for the approval of the subdivision of this plat; and WHEREAS, pursuant to Section 276 and 277 of the Town Law, a Public Hearing was held on July 9, 1975 after notice was published in the offi- cial newspaper of the Town of Mamaroneck, the v Daily Times ; and WHEREAS, this Board has examined the plans and determined that the same are all satisfactory; NOW, THEREFORE, BE IT RESOLVED, that the application of Mr. Stanley Rubin be approved and the Chairman of the Plan- ning Board is hereby authorized to sign such subdivision map as evidence of the approval of same. PUBLIC HEARING - SUBDIVISION - BLOCK 102 PARCEL 118 Application of Mr. Joseph G. Ward for the approval of the subdivision of a lot located on Weaver Street and known on the Tax Assessment Map of the Town of Mamaroneck as Block 102 Parcel 118 and shown on a survey entitled "Survey of a Portion of Lot 1 as shown on Map of Lakewood in the Town of Mamaroneck, Westchester County, N.Y. " dated April 22, 1975. Mr. Mosher represented Mr. Ward and presented his appli- cation to the Board. Mr. Mosher stated that the lot in question had been subdivided prior to the 1959 Zoning and at that time it was in conformance with the previous zoning. Mrs. Carlson said she had been in contact with Mr. Lou Thompson from the State Department of Community Affairs who had advised her that because of the allega- tion by Mrs. Ward that her signature was a forgery it was a tricky matter to be before the Planning Board. Mrs. Ward said she had retained an Attorney but he was unable to be at the meeting because of prior committments. Mrs. Ward showed the Board a copy of a letter her Attor- ney had sent to Mr. Johnston, the Town Attorney and a copy of the letter her Attorney had sent to Mr. Ward, the applicant. The Board decided they could not make any decision on the application until they conferred further with Mr. Johnston. NEW BUSINESS Mr. George Basile of 294 Weaver Street came before the Board with a sketch of a subdivision of a lot. Mr. Basile asked the Board for an opinion before he filed an appli- cation. When Mr. Basile purchased the lots in 1952 they were buildable lots but according to the present zoning which is R-10 for the property in question the lot on which Mr. Basile wants to build does not conform and it would not be possible to build a house to comply with the present zoning regulations. The Board decided they could not approve such a subdivision as there would be too many variances involved. Mr. Corey Allen of 11 Bruce Road appeared before the Board and said he had lived at his present address for 12 years and had tried to form an Association with the other home owners on Bruce Road to see what could be done about the road. Mr. Allen said that there was only one resident on the road who was not in agreement with the idea of turning Bruce Road, which is now a private street, over to the Town. Mr. Allen, also, mentioned the possibility of putting in sewers and it was pointed that if this was done it would be an extension of the present sewer dis- trict. After further discussion the Board advised Mr. Allen to write a letter to the Town Board. ADJOURNMENT There being no further business to come before this meet- ing it was adjourned at 9:45 P.M. 61.
