CALL TO ORDER The meeting was called to order by the Chairman at 8:20 P.M. ROLL CALL Present: Mr. Fred L. Maggini , Chairman Mr. Joseph Rigano Mr. G. Norman Blair Mrs. Mary Carlson Absent: Mr. Edward J. Cibulay Also present: Mr. Charles R. Elfreich, P.E. , Town Engineer APPROVAL OF MINUTES The minutes of the meeting of January 11 , 1978 were pre- sented and on motion duly made and seconded, approved as submitted. PUBLIC HEARING - SUBDIVISION OF LOT ON COLONIAL AVENUE - BLOCK 120 PARCEL 287 Application of Mr. and Mrs. Thomas J. Salb for the appro- val of the subdivision of a lot located on Colonial Ave- nue and known on the Tax Assessment Map of the Town of Mamaroneck as Block 120 Parcel 287 and shown on a revised subdivision Map of "A Portion of Second Amended Subdivi- sion Map of Maple Hill showing changes in lots thru 30 incl . in the Town of Mamaroneck, Westchester County, N.Y. " dated January 19, 1978. Mr. Hunter Meighan , an Attorney, of 100 Mamaroneck Ave- nue, Mamaroneck, New York, represented the owners of the lot and said the Salbs had a purchaser for the lot. The Board questioned as to whether the storm drains were ade- quate for another house. Mr. Elfreich said there would be a certain amount of increased runoff and it was pointed out that the sewer and all other necessary utilities are existing. After further discussion the Board decided to approve the application and the following Resolution was adopted: WHEREAS, Mr. and Mrs. Thomas J . Salb, owners of the premises located on Colonial Avenue and known on the Tax Assessment Map of the Town of Mamaro- neck as Block 120 Parcel 287 and shown on a sub- division map dated January 19, 1978, has filed with this Board an application for the approval of the subdivision of this plat; and llHEREAS, pursuant to Sections 276 and 277 of the • Town Law, a Public Hearing was held on February 8, 1978 after notice was published in the offi- cial newspaper of the Town of Mamaroneck, the Daily Times; and WHEREAS, this Board has examined the plans and determined that the same are all satisfactory; NOW, THEREFORE, BE IT RESOLVED, that the application of Mr. and Mrs. Thomas J. Salb be approved subject to the ap- proval of the Westchester County Health Depart- ment and the Chairman of the Planning Board is hereby authorized to sign such subdivision map as evidence of the approval of same. PUBLIC HEARING - BLOSSOM GROVE SUBDIVISION - BLOCK 403 PARCEL 99 Application of Spencer Construction Corporation for the approval of the subdivision of a lot located at the end of Blossom Terrace between Palmer Avenue and the railroad known on the Tax Assessment Map of the Town of Mamaroneck as Block 403 Parcel 99 and shown on two subdivision maps known as "Subdivision - Map of Spencer Property - Sec- tion "A" and "Subdivision Map of Spencer Property - Sec- tion "B" both dated January 9, 1978. Mr. David Jutkowitz, Mr. Spencer's Attorney and Mr. Jeff Gordon, a partner in the Spencer Corporation presented the application. Mr. John Ibelli and Mr. Angelo Rigano represented the Palmer Avenue Civic Association. The Board discussed whether or not the bus shelter would have to be moved. Mr. Maggini said the Board was not in favor of having cars back out onto Palmer Avenue. Mr. Elfreich said he had contacted the Westchester County Traffic Department and he thought possibly they might have a regulation that a turn around be made in each driveway. Mr. Ibelli asked that the developer when he builds the homes try to make provision for two cars. After further discussion and review of the final plan the Board decided to approve the application subject to the following conditions; therefore, the following Resolution was adopted: WHEREAS, Spencer Construction Corporation, owner of the premises located at the end of Blossom Terrace and known on the Tax Assessment Map of the Town of Mamaroneck as Block 403 Parcel 99 has filed with this Board an application for the approval of the subdivision of this plat; and WHEREAS, pursuant to Section 276 and 277 of the Town Law, a Public Hearing was held on Feb- ruary 8, 1978, after notice was published in the official newspaper of the Town of Mamaro- neck, the Daily Times ; and WHEREAS, this Board has examined the plans and determined that the same are satisfactory; NOW, THEREFORE, BE IT RESOLVED, that the application of Spencer Con- struction Corporation be approved subject to the following conditions: 1 . The applicant shall install all street improvements in accordance with the standard and procedure ac- ceptable to the appropriate Town Depart- ments. 2. No building permits shall be issued until the applicant either furnishes a performance bond or posts a cash deposit in an amount specified by the Town Engineer for the completion of such improvements. 3. Formal offers or deeds of cession to the public of all streets, high- ways , easements or public places in- dicated on the plans filed with the Planning Board shall be in form sat- isfactory to the Town Attorney. Until such streets are formally accepted by the Town Board, delivery of such offers or deeds shall not constitute an acceptance by the Town of a dedi- cation of any such street, highway, easement or public places ; nor waive the payment of necessary title charges and recording fees, but such accep- tance effective only upon the adop- tion of a Resolution by the Town Board. 4. The applicant obtain approval from the Westchester County Health Department for all public water sup- ply facilities and public sanitary sewers to serve all structures intended for human occupancy constructed in said subdivision. 5. The applicant furnish construc- tion drawings to be approved by the Town Engineer. 6. Construction equipment for road- way improvements (clearing, grading, excavating, sewer, storm drains , water main, curbs, subbase and base material ) shall not have access by way of the existing roadway (Blossom Terrace) . Such equipment shall have access only through the lots on Palmer Avenue. This must be indicated on the construc- tion drawings and no building permit shall be issued for any said lot until all the above improvements are com- pleted to the satisfaction of the Town Engineer. 7. Setback requirements for lots 9 and 10 shall be considered rear 25 ft. setbacks so that the proposed homes will not be too close to the existing homes on Palmer Avenue. 8. The developer must plan for proper use of driveway turn-arounds so as to facilitate forward egress on to Palmer Avenue (County road) in accord- ance with County regulations. 9. The application is approved sub- ject to the legal requirement that a title company, doing business in the State of New York, will insure that the easement area depicted on the survey may be used for the pur- poses to which the developer proposes to use it. FURTHER RESOLVED, upon compliance of the all of the above conditions , the Chairman of the Planning Board is hereby authorized to sign such subdivision map as evidence of approval of same.
