HomeMy WebLinkAbout1975_12_10 Planning Board Minutes MINUTES OF A REGULAR MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK HELD DECEMBER 10, 1975, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, LARCHMONT, NEW YORK. CALL TO ORDER The meeting was called to order by the Chairman at 8:15 P.M. ROLL CALL Present: Mr. Fred L. Maggini , Chairman Mr. Joseph Rigano Mr. G. Norman Blair Absent: Mr. Edward J. Cibulay Mrs. Mary Carlson APPROVAL OF MINUTES The minutes of an Informal Meeting held on August 13, 1975, a Special Meeting held on August 18, 1975 and a Regular Meeting held on November 12, 1975 were presented and on motion duly made and seconded, approved as submitted. PUBLIC HEARING - APPLICATION FOR REDUCTION OF BOND - "THE FAIRWAYS" The Board discussed the application of Mr. Pollack for reduction of the bond and decided they would not approve the application at this time. Several of the Board mem- bers present had gone out and looked at the road and felt they could not approve the work that had been done. The Chairman suggested that the application be held over for the next regular meeting on January 14, 1976. OLD BUSINESS - OTTO SCHEUBLE The Chairman said that he had contacted the Village of Larchmont and Village of Mamaroneck to find out if they had any rules restricting operating hours for business establishments. Mr. Maggini reported that in the Vill- age of Larchmont rules regulating operating hours are specified in the General Village Ordinance and in the Village of Mamaroneck they have no provision but are pre- sently working on an amendment to the General Village Ordinance to provide for the restriction of operating hours. The Pla ming Board, therefore, recommends that the Town Board investigate the possibility of establish- ing an amendment to the General Town Ordinance similar to the one that is now in existence in the Village of Larchmont. Mr. Scheuble' s suggestion in his letter of April 7, 1965 that high exhaust chimneys be erected for ventilation for establishments such as Cook's and Dunkin Donuts, in the opinion of the Board members present is impractical and there is no proof that such a structure would solve i ;" the problem. Mr. Scheuble, also, questioned the 5 ft. buffer zone which the Town Board had approved in 1955 but which was omitted from the new Zoning Ordinance adopted in 1959. Mr. Maggini said that since Rock Ridge Road is 100 ft. within a com- mercial zone it would not be practical to close off a 5 ft. buffer strip on Rock Ridge Road and that was the reason it was omitted from the new Zoning Ordinance. The Chairman further said that if Mr. Scheuble felt the Zoning Ordinance had been violated it should be discussed with the Town Board.
