MAMARONECK HELD NOVEMBER 12, 1980, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, LARCHMONT, NEW
YORK.
CALL TO ORDER
The meeting was called to order by the Chairman at 8:45
P.M.

APPROVAL OF MINUTES
The minutes of the meeting of October 8, 1980 were presented
and on motion duly made and seconded, approved as submitted.
PUBLIC HEARING - APPLICATION FOR SUBDIVISION OF LOT ON COOPER LANE -
BLOCK 217 PARCEL 455
Mr. Hunter Meighan, represented the applicant, Mrs. Muriel
C. Ross . The Board discussed the application and determined
that there would be no adverse environmental impact.
After further discussion the Board decided to approve the
application and the following Resolution was adopted:
WHEREAS, Mrs . Muriel C. Ross, owner of the pre-
mises located on Cooper Lane and known on the
Tax Assessment Map of the Town of Mamaroneck
as Block 217 Parcel 455 and shown on a Survey
and Map dated September 23, 1980, has filed
an application with this Board for the appro-
val of the subdivision of this plot; and
WHEREAS, pursuant to Section 276 and 277 of
the Town Law, a Public Hearing was held on Novem-
ber 12, 1980 after notice was published in the
official newspaper of the Town of Mamaroneck,
the Daily Times; and
WHEREAS, this Board has examined the plans and
determined that the same are all satisfactory;
NOW, THEREFORE, BE IT
RESOLVED, that the Board has determined that
the proposed subdivision will have no signifi-
cant adverse effect upon the environment; and
FURTHER RESOLVED, that the application of Mrs.
Muriel C. Ross be approved subject to the ap-
proval of the Westchester County Health Depart-
ment and the Chairman of the Planning Board
is hereby authorized to sign such subdivision
map as evidence of approval of same.
PUBLIC HEARING - APPLICATION FOR SUBDIVISION OF LOT ON OLD WHITE
PLAINS ROAD - BLOCK 304 PARCEL 204
Mr. Eugene Magnetti , who is the contact vendee for the sub-
division of the property owned by Mr. Morton A. Karmel ,
appeared before the Board. Mr. Magnetti 's Survey, Mr. Richard
Spinelli had prepared the construction drawings and also
a plan showing the location of the proposed homes on the
lots .
The Board discussed the application and it was pointed out
that one utility pole would have to be moved and they deter-
mined that there would be no adverse environmental impact.
The application was approved and the following Resolution
adopted:
WHEREAS, Magnetti Enterprises, Inc. , contract
vendee for the property on Old White Plains
Road and known on the Tax Assessment Map of
the Town of Mamaroneck as Block 340 Parcel 204
and shown on a "Subdivision Map of the former
Stopford Property - Town of Mamaroneck, West-
chester County, New York" dated September 23,
1980, has filed an application with this Board
for the approval of the subdivision of this
plot; and
WHEREAS, pursuant to Section 276 and 277 of
the Town Law, a Public Hearing was held on Novem-
ber 12, 1980 after notice was published in the
official newspaper of the Town of Mamaroneck,
the Daily Times; and
WHEREAS, this Board has examined the plans and
determined that the same are all satisfactory;
NOW, THEREFORE, BE IT
RESOLVED, that this Board has determined that
the proposed subidivision will have no signifi-
cant adverse effect upon the environment; and
FURTHER RESOLVED, that the application of Mag-
netti Enterprises, Inc. , contract vendee be
approved subject to the approval of the West-
chester County Health Department and the Chair-
man of the Planning Board is hereby authorized
to sign such subdivision map as evidence of
approval of same.
APPLICATION FOR SPECIAL PERMIT - RESTAURANT AND CATERING BUSINESS
USE - DANDRY PROPERTY - 2155 PALMER AVENUE - BLOCK 501 PARCEL 1
Mr. George P. Forbes, Jr. an Attorney of 7 Woodland Ave-
nue, Larchmont, represented the applicants , Mr. and Mrs.
Cunningham, who operate a restaurant and catering business
in Pelham at present. Mr. Forbes had presented the Board
with a memorandum which they had received previous to
the meeting.
The Board questioned as to whether there would be enter-
tainment, a bar and the operating hours. Mrs. Cunningham
said that most of their business would be preparing for
parties held in private homes which is picked up for deli-
very but that they would also have rooms to provide pri-
vacy for small parties beside their regular diners.
Mr. Cunningham said that there would be no bar or cock-
tail lounge and there would be only a service bar. The
applicants, also, pointed out that there would no enter-
tainment provided except when there would a private party
in which case the individuals would provide their own
entertainment with probably one or more musicians. The
applicants further said that the normal closing hours
for the restaurant would be 10 P.M. but when there are
private parties it might be later. It was pointed out
that the Cunninghams cater to a conservative clientele.
A question was raised regarding outdoor dining and it
was determined that if the applicants wanted to provide
outdoor dining it would require another Special Permit.
The Cunninghams further said that they were leasing the
property with an option to buy.
After further discussion the Chairman asked the Secretary
to report their comments to the Board.
ADJOURNMENT
There being no further business to come before this meet-
ing it was adjourned at 9:30 P.M.
