HomeMy WebLinkAbout1982_05_26 Planning Board Minutes MINUTES OF A REGULAR MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK HELD MAY 26, 1982, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE , WEAVER STREET AND EDGEWOOD AVENUE , LARCHMONT, NEW YORK. CALL TO ORDER The meeting was called to order by the Chairman at 8:25 P.M. ROLL CALL Present: Mr. Paul Kalos, Chairman Mrs. Mary Carlson Mr. Warner Pyne , Jr. Mr. Anton Schramm Mr. Emil Nicolaysen Also present: Mr. Charles R. Elfreich , P.E. , Town Engineer APPROVAL OF MINUTES The minutes of the meeting of December 9, 1981 and Jan- uary 13, 1982 were presented and on motion duly made and seconded, approved as submitted. PUBLIC HEARING - DRAFT ENVIRONMENTAL IMPACT STUDY - GOTHAM CONSTRUCTION COMPANY Mr. Kalos referred to the Public Notice which is as fol - lows: NOTICE IS HEREBY GIVEN that the Town of Mamaroneck Plan- ning Board, in its capacity as the Lead Agency under the Environmental Quality Review Local Law - No. 1 - 1977, will hold a Public Hearing on May 12, 1982 at 8:15 P.M. , in the Weaver Street Firehouse, corner of Weaver Street and Edgewood Avenue, Town of Mamaroneck, New York, for the purpose of receiving a Draft Environmental Impact Study from Gotham Construction Company to pass on its suffiency before referring the matter to the Town Board for hearing. Mr. Kalos explained to those present that the Planning Board was meeting as the Lead Agency to determine whether they would accept the Draft Environmental Impact State- ment and to set the date for the hearing to be held before the Town Board. Mr. Sachs said that the Environmental Impact Study had been filed with the Secretary on or about April 16th and additional copies had been made available to the Attor- ney, Mr. Barrett, Mr. Neale and Dr. Wilson. Mr. Sachs said he would get some extra copies to the Secretary for the residents who want to examine it and would, also, deliver copies to the Mamaroneck and Larchmont Libraries. Mr. Sachs, also, said he would send the notices to the parties to be notified and give the Secretary an affidavit 11Cfi that they had been sent. On motion made and seconded with Mr. Nicolaysen abstain- ing as a new member and Mrs. Carlson abstaining because she objected to the words "contents and adequacy" in the Resolution and with three votes in favor the Board decided to accept the Draft Environmental Impact Statement and the following Resolution was adopted: RESOLVED, that the Town of Mamaroneck Planning Board, in its capacity as lead agency under the provisions of Local Law No. 1/1977 herewith cer- tifies that the Draft Environmental Impact State- ment, prepared for Garfield Housing Corp. , is sufficient as to scope, contents and adequacy. The Planning Board directs that a Notice of Com- pletion of the Draft Environmental Impact State- ment be published and posted as provided by law. Mr. Sachs, the Attorney for the applicants requested that the Planning Board hold the Preliminary Hearing on the sub- division so that the Public Hearing could be held at the joint meeting of the Town Board and Planning Board on June 23rd. The Board then decided to reconvene as the Planning Board to act on the Preliminary Hearing of the subdivision. Mr. Sachs read a draft of a letter in which he said that the Planning Board had held a Public Hearing on September 16th for the amalgamation of the two parcels into one and for the discontinuance of three Town streets and the crea- tion of one new Town street. Mr. Sachs further said that the application was adjourned to October 14th and the Plan- ning Board at that time approved the application which the applicants feel is in full force and effect since it had never been challenged or set aside by ary Court. Mr. Sachs , also, said that as a result of the December meeting of the Planning Board in which the Board decided to reverse its earlier position and require the applicant to prepare a Draft Environmental Impact Statement a question has been raised as to the legality of the October 14th determination. Mr. Sachs said that they were now requesting that a Public Hearing be held at the same time the hearing is held on the Draft Environmental Impact Statement. Finally Mr. Sachs said that he was reiterating the applicants position of the October 14th approval but in a spirit of cooperation with the Planning Board are making the request. Mr. Pyne said he felt they should grant the developers re- quest so as not to delay the application procedure and Mr. Schramm said he was in favor. Mrs. Carlson said she feels the Board should not hear the subdivision application until they receive the final Environmental Statement. On a vote of 3 to 1 the Board agreed that they would hold the Public Hearing on the amalgamation of the two parcels into one and the extinguishment of three Town streets with q' ciG the creation of one new Town street simultaneously with the Town Board hearing on June 23, 1982.
