MAMARONECK HELD MAY 14, 1980, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE , LARCHMONT,
NEW YORK.
CALL TO ORDER
The meeting was called to order by the Chairman at 8:30
P.M.

Also present: Mr. Charles R. Elfreich, P .E. , Town Engineer
APPROVAL OF MINUTES
The minutes of the meeting of April 9, 1980 were presented
and on motion duly made and seconded, approved as submitted.
APPLICATION OF MR. PAUL CHARLAP - 215 HOMMOCKS ROAD
The Town Board had referred the application of Mr. Charlap
for an amendment to the Zoning Ordinance and a Special
Permit to the Planning Board for its recommendations .
Attached to the application was an Environmental Assess-
ment Form for its review by the Planning Board in accord-
ance with SEQR.
Mr. Charlap was represented by Mr. Daniel Natchez of
555 Alda Road, Mamaroneck and Mr. Hunter Meighan of
100 Mamaroneck Avenue, Mamaroneck .
Mr. Blair explained that the Planning Board could take
no action but could only recommend to the Town Board
whether or not there should be a revision to the Zoning
Ordinance permitting helicopter landings under a Special
Permit.
In the application Mr. Charlap states that he is the
Chairman of the Board of the Savin Corporation and the
use of the helicopter will save from a half to two hours
each time he has to fly to and from the different Savin
plants . The applicant said that the helicopters had
been landing and taking off from Mr. Charlap's back yard
for over six years until November 1978 when an objection
was raised by a family living across the channel . When
Mr. Charlap was served with a violation notice he dis-
continued the landings and take-offs of his helicopter
from his backyard even though he has FAA approval .
A representative of the Town Volunteer Ambulance Corp
and the Village of Mamaroneck Rescue Squad spoke in
favor of the application and in Mr. Charlap 's petition
there were letters from neighbors as well as signatures
of the members of the Hommocks Property Association ap-
proving the application .
Mr. James Savage of Larchmont, who does not live in the
vicinity of the proposed helicopter landing but is a
"sailor" objected to the noise of the helicopters .
A letter had been sent to the members of the Town Council
and the Planning Board from Dr. Benford of 45 Hommocks
Road objecting to the application .
Mrs . Carlson said she had a received a letter which she
did not bring with her from Mrs . Fredston of 3 Cedar Island,
Larchmont, also, objecting to the application.
Mrs . Carlson stated that she would like to have more in-
formation on the application.
Record was made of a memorandum from the Building Inspec-
tor to the Supervisor and members of the Town Board in
which Mr. Paonessa calls attention to the fact that after he
conferred with the Town Attorney they came to the con-
clusion that the application would have to have an Environ-
mental Impact Statement so as to conform with the Town's
Environmental Quality Review Law passed in 1977. Mr.
Paonessa in his memo, also, called attention to the fact
that in addition to requiring a Special Permit since Mr.
Charlap 's home is located in an R-30 Residential District
it would be necessary to obtain a Use Variance so that
he could put this highly residential area to a business
use.

It was pointed/that there would be not more than two land-
ings and two take-offs on any day between the hours of
7:30 A.M. and 7:30 P .M. except for public service purposes
or emergencies .
After further discussion a motion was made that the Board
in compliance with Chapter 23 Environmental Quality Review
Section 6 to post a Notice of the proposed action (Zoning
Ordinance Amendment) on the signboard of the Town Hall
and publish the notice in the Daily Times of the proposed
action . Mrs . Carlson voted against the application with
Mr. Schramm disqualifying himself from voting on this sec-
tion of the application.
The Board, also, decided to recommend that the Town Board
approve the applicant's request for a zoning amendment per-
*(see note) fitting helicopter landings in residential areas with Mrs .
Carlson voting against the request.
In response to the applicant's request for a Special Permit
the Board decided to reserve decision until the amendment
to the Zoning Ordinance is in effect. Mrs . Carlson voted
against.
ENVIRONMENTAL IMPACT STUDY - APPLICATION OF TOWN RECREATION COMMISSION
The Town Recreation Commission is applying for a Federal
grant to be used for improvements at the Hommocks Park
Ice Rink/Tennis Courts facility and as part of the appli-
cation a declaration of negative or positive impact is
required under SEQR.
After discussirg the application the Board decided that
the notice of the application should be sent to all the
proper agencies .
ENVIRONMENTAL IMPACT STUDY - APPLICATION FOR SHELDRAKE RIVER STREAM
IMPROVEMENTS
The project in question is for a modest flood control pro-
gram to alleviate flooding along the Sheldrake River.
After the Board discussed the application it was decided
that notices should be sent to all the proper agencies .
ADJOURNMENT
There being no further business to come before this Board
it was adjourned at 10:45 P .M.
* NOTE As Secretary to the Planning Board and at the request of
the Chairman, Mr. Blair, the recommendations on the Charlap
application were withdrawn pending further study and con-
sultation with the Town Attorney.
