OF MAMARONECK HELD MARCH 12, 1980, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, LARCHMONT,
NEW YORK.
CALL TO ORDER
The meeting was called to order by the Chairman at 8:30
P.M.

APPROVAL OF MINUTES
The minutes of the meeting of February 13, 1980 were pre-
sented and on motion duly made and seconded, approved
as submitted .
PUBLIC HEARING ON SUBDIVISION OF LOT - BRUCE ROAD - BLOCK 346 PARCEL 94
PLEASE TAKE NOTICE that the Town of Mamaroneck Planning
Board pursuant to Sections 276 and 277 of the Town Law
will hold a Public Hearing on March 12, 1980 in the Coun-
cil Room of the Weaver Street Firehouse, Weaver Street
and Edgewood Avenue , Town of Mamaroneck , Larchmont, New
York at 8:30 P.M. on the application of Mr. Corey M. Allen
for the approval of the subdivision of a lot located at
the southerly end of Bruce Road and known on the Tax Assess-
ment Map of the Town of Mamaroneck as Block 346 Parcel
94.
TAKE FURTHER NOTICE that all persons present will be given
an opportunity to be heard.
Mr. Blair had received a letter from the Town Attorney
stating that in Mr. Johnston 's opinion the Planning Board
had the power to approve the application of Mr. Allen
providing that the applicant improve the street or road-
way to the property to the satisfaction of the Planning
Board.
Mr. Forbes, Mr. Allen's Attorney, stated that the Plan-
ning Board could approve the layout with conditions and
subject to the approval of a variance from the Zoning
Board of Appeals .
It was pointed out that Mr. Allen and his neighbors could
get together and have the road improved or if the Town
made the improvements the residents would be assessed
accordingly.

Mrs. Hannes of 2 Bruce Road expressed concern over the
trucks that would have to go through their section of the
road if there was any construction and did not think they
should be put in a position to maintain the road.
Mr. Kaye of 6 Bruce Road, also, expressed concern stating
that their section of the road suited them as a private
road and they did not want any additional taxes .
Mr. Elfreich said that the road at present does not meet
Town standards and that the road when improved could re-
main a private road and would not have to be dedicated
to the Town. Mr. Elfreich stated that the original deve-
loper of the property had never given up the title to the
road.
Mr. Kaye said that some of the residents had put in their
own curbing.
The Secretary had presented the Chairman with a letter
addressed to him from Mr. Allen . In his letter Mr. Allen
said he would not be able to attend the meeting and listed
the following neighbors he had spoken to about the appli-
cation:

Robert Hannes 2 Bruce Road
Shirley Lashins 5 Bruce Road
Lewis Kaye 6 Bruce Road
Nanette Selig 7 Bruce Road
Vincent Monte-Sano 8 Bruce Road
Jacques Wullschleger 10 Bruce Road
Felix Larkin 1030 Old White Plains Road
Mr. Allen, also, said in his letter that none of these
people expressed any objection to the subdivision.
After further discussion the Board decided to approve the
application subject to the improvement of the road and
to the satisfaction of Town standards .
The Board pointed out that they had determined there would
be no environmental impact and the following Resolution
was adopted:
WHEREAS, Mr. Corey M. Allen, owner of the pre-
mises located at the southerly end of Bruce Road
and known on the Tax Assessment Map of the Town
of Mamaroneck as Block 346 Parcel 94 has filed
with this Board an application for the approval
of the subdivision of this plat; and
WHEREAS, pursuant to Sections 276 and 277 of
the Town Law, a Public Hearing was held on March
12, 1980 after notice was published in the of-
ficial newspaper of the Town of Mamaroneck, the
Daily Times ; and

WHEREAS, this Board has examined the plans and
determined that the same are all satisfactory
and that the proposed subdivision will have no
significant effect upon the environment;
NOW, THEREFORE, BE IT
RESOLVED, that the application of Mr. Corey M.
Allen be approved subject to the following con-
ditions :
1 . That the applicant shall obtain
approval of construction plans from
the Town Engineer for the following
improvements:
a) installation of approxi-
mately 70 lineal feet of
15 inch diameter storm drain
pipe and headwalls under
Bruce Road in the vicinity
of the cul-de-sac.
b) installation of approxi-
mately 620 lineal feet of
stone curbing along the
edges of Bruce Road from
a point where the existing
curb terminates on both
the easterly and westerly
sides of Bruce Road extend-
ing to and including the
entire circumference of
the cul-de-sac at the southerly
end of Bruce Road.
c) installation of the
necessary amount of stone
base, asphaltic base, and
asphaltic roadway surface
materials to improve the
paved roadway in accordance
with the roadway standards
of the Town of Mamaroneck .
d) filling, grading, and
seeding of the area between
the proposed curbing and
adjacent front property
lines.
2. That the applicant obtain approval
from the Westchester County Health
Department for the septic systems .
3. That the applicant obtain the
proper variance under Chapter 89,
Article III Section 89-14 "Required
Street Frontage" from the Zoning Board
of Appeals .
4. That no building permits shall
be issued until the above items 1 ,
2 and 3 be complied with .
FURTHER RESOLVED, that upon compliance with
the above conditions, the Chairman of the Plan-
ning Board is hereby authorized to sign such
subdivision map as evidence of the approval
of same.
VILLAGE OF MAMARONECK - FAIRWAY CONDOMINIUMS
Mr. Elfreich advised the Board members that he had invited
Mr. Glass to attend the meeting. Mr. Glass had a site
plan for the development of property,owned by AJF Construc-
tion Corp. of 608 Fifth Avenue, Larchmont, in the Village
of Mamaroneck. The developer was requesting that the
proposed new road connect to Rock Ridge Road which is
in the Town. Mr. Elfreich informed the Board that Mr.
Glass would present his plan to the Town Board at their
next meeting which would be on March 19, 1980. At that
time the Town Board would probably refer the application
to the Planning Board for their recommendations .
ADJOURNMENT
There being no further business to come before this meet-
ing it was adjourned at 10:15 P.M.
