CALL TO ORDER The meeting was called to order by the Chairman at 8:25 P. M. ROLL CALL Present: Mr. Paul Kalos , Chairman Mrs. Mary Carlson Mr. Warner Pyne, Jr. Absent: Mr. Anton Schramm Mr. Emil Nicolaysen Also present: Mr. Charles R. Elfreich , P .E . , Town Engineer APPROVAL OF MINUTES The minutes of the meeting of January 12, 1983 were pre- sented and on motion duly made and seconded, approved as submitted. PUBLIC HEARING - SUBDIVISION OF LOT ON OLD WHITE PLAINS ROAD - TISHMAN BLOCK 315 PARCEL 235 PUBLIC NOTICE PLEASE TAKE NOTICE that the Town of Mamaroneck Planning Board pursuant to Section 276 and 277 of the Town Law will hold a Public Hearing on February 9, 1983 in the Auditorium of the Weaver Street Firehouse, Weaver Street and Edgewood Avenue , Town of Mamaroneck, Larchmont, New York at 8:15 P.M. on the application of Mrs . Norman Tish- man for the approval of the subdivision of a lot located at 1000 Old White Plains Road and known on the Tax Assess- ment Map of the Town of Mamaroneck as Block 315 Parcel 235 and shown on a Survey done by Mr. Gabriel E. Senor, P.E . , L.S. , dated October 13, 1982. TAKE FURTHER NOTICE that all persons present will be given an opportunity to be heard. BY ORDER OF THE TOWN OF MAMARONECK PLANNING BOARD PAUL KALOS, CHAIRMAN Mr. Senor, who represented the applicant, Mrs. Tishman, had submitted a revised plan showing the entrance to the vacant lot. The Board had decided at the previous meeting that the application was a Type 2 which does not require an Environmental Impact Statement. After further discussion a motion was made and seconded and on a vote of 3 to 0 the application was approved. The fol- lowing Resolution was adopted: WHEREAS, Mrs. Norman Tishman , owner of the pre- mises located at 1000 Old White Plains Road and known on the Tax Assessment Map of the Town of Mamaroneck as Block 315 Parcel 235 has filed an application with this Board for the approval of a subdivision plat; and WHEREAS, pursuant to Sections 276 and 277 of the Town Law, a Public Hearing was held on Feb- ruary 9, 1983 after a notice was published in the official newspaper of the Town of Mamaro- neck , the Daily Times; and WHEREAS, this Board has examined the plans and determined that the same are all satisfactory; and WHEREAS, this Board has determined that the application will not cause problems to water supply, sewerage disposal , drainage , fire pro- tection or noise and therefore will not have any significant affect upon the environment; NOW, THEREFORE, BE IT RESOLVED, that the application of Mrs. Norman Tishman be approved subject to the approval of the Westchester County Health Department. The Chairman of the Planning Board is hereby authorized to sign such subdivision map as evi- dence of the approval of same. OLD BUSINESS - GARFIELD HOUSING Mr. Kalos said he had received a letter from Mr. Forbes which he was going to read. Mr. Kaplan said he did not think it appropriate for Mr. Kalos to read the letter because of a law suit that was involved with the appli- cation. Mr. Forbes then read the letter in which he said that on November 10, 1982 the Planninn Board had granted a preliminary subdivision approval to his client, Garfield Housing Corporation. Mr. Forbes further said in his letter that in the approval were a number of require- ments that his client is in the process of complying with. Additionally Mr. Forbes said in his letter that the major requirement relates to the approval of the Westchester County Board of Health and that as soon as that approval is received they would inform the Planning Board so that the final hearing can be held pursuant to the subdivision requirements of the Town of Mamaroneck. PRELIMINARY HEARING ON SUBDIVISION OF LOT - 31 SETON ROAD - BLOCK 116 PARCEL 428 Mr. and Mrs. Hafetz, the applicants , appeared before the Board. Mr. Kalos read the requirements for the deter- urination as to whether it would require an Environmental Impact Statement. The Board decided that it was a Type 2 action and would not require an Environmental Impact Statement. The Secretary was requested to publish the notice for the Public Hearing to be held at the next meeting. OFFICE BUILDING - FENIMORE ROAD - VILLAGE OF MAMARONECK The Chairman asked the Secretary to note that his letter addressed to the Chairman of the Village of Mamaroneck Zoning Board be made part of the record. In the letter Mr. Kalos expressed his hope that the Village would care- fully consider the impact of the proposed office build- ing on Town residents and other nearby residential areas . OFFICE BUILDING - 2155 PALMER AVENUE Mr. Kalos explained that the Planning Board at this time was meeting as the Lead Agency for a Final Environmental Impact Statement. The Town Council had held a Public Hearing at which time they had determined that the pro- posed project may have a significant impact and the Final Environmental Impact Statement was required. The Chair- man said that the applicant had submitted documents which were distributed to the appropriate authorities and in addition they had submitted the credentials of the experts who had made the study. Since the Final Environmental Impact Statement made refer- ence to a traffic study to be made by Westchester County Mr. Kalos asked whether the traffic study was the same one that had been sent to the Village of Larchmont Office. Mr. Clifford and Mr. Purvis who represented the appli- cant said they did not know of any other. The Board discussed the application and Mr. Engel , Coun- cil to, Mr. Troy, President of the Pine Brook District Property Owner' s Association Inc. were both present and commented. In view of the fact that the traffic study from Westches- ter County was not available to the Planning Board until the meeting, the Board decided to adjourn the hearing until its next meeting. Mr. Purvis said that the appli- cant was pressed for time and would like to appear before the Zoning Board at its March meeting. The Board members present agreed to hold their next meeting on Tuesday night, March 8th instead of Wednesday, March 9th to ac- commodate the applicants. Mrs. Carlson said that the Board should have technical assistance with respect to the SEQR process . The Board adjourned the application to the next meeting to be held on March 8, 1983. A Court Reporter was present and his transcript will Ict be the record of the hearing.
