HomeMy WebLinkAbout1980_12_10 Planning Board Minutes MINUTES OF A REGULAR MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK HELD DECEMBER 10, 1980, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, LARCHMONT, NEW YORK. CALL TO ORDER The meeting was called to order by the Chairman at 8:30 P.M. ROLL CALL Present: Mr. G. Norman Blair, Chairman Mrs. Mary Carlson Mr. Warner Pyne, Jr. Mr. Anton Schram Mr. Paul Kalos APPROVAL OF MINUTES The minutes of the meeting of November 12, 1980 were pre- sented and on motion duly made and seconded, approved as submitted. APPLICATION FOR SPECIAL PERMIT - RESTAURANT AND BAR - VILLAGE SQUARE SHOPPING CENTER Mr. Bernard Rosenshein, the developer of the Village Square Shopping Center appeared before the Board with Mr. J. DeFonce, the owner of the proposed restaurant and his Architect, Mr. Lawrence Goodman. Mr. Rosenshein said that the restaurant would be a "white tablecloth" type and specialize in steaks and seafood. Mr. Rosenshein said that aesthetically the restaurant would be a "plus" to the shopping center. He further said that a restaurant of this caliber will blend into the "clock tower" and the entrance to the restaurant will be through the clock tower. Mr. Elfreich, the Town Engineer, who was not able to attend the meeting had sent a memo to the Board members in which he informed the Board that the developer had obtained a variance from the Zoning Board for parking only 142 cars instead of the required 172. Mr. Elfreich said in his memo that the parking lot had been constructed with 161 spaces due to an encroachment on school owned property for which Mr. Rosenshein to date had not received proper authorization for the use of the property. Mr. Rosenshein said that an agreement had been worked out with the Board of Edt.cation. He said that the Board of Education had given them an easement to run the electric lines underground and when his men did the blacktopping they did the school property as well . Mr. Rosenshein said that according to the agreement they are presently leasing the property but in June they will purchase the land. The Board questioned as to whether there would be enter- tainment and Mr. Rosenshein said that it would primarily be a restaurant with no entertainment. A question was also asked about the hours of operation and Mr. DeFonce said he would probably open about 11 :00 A.M. to get ready for lunch and they would remain open till about midnight seven days a week. The Board asked Mr. Rosenshein how many stores he antici- pated would be in the shopping center when it was completed and the number of employees. Mr. Rosenshein said there would be no more than ten stores and each one would pro- bably have on the average of two employees each. Mrs . Carlson asked about the number of seats for diners and it was pointed out that there was 90 seats for dining plus 23 stools at the bar. Mr. Blair said that the restaurant would not create any additional problems as far as traffic is concerned and there would be no additional environmental impact then when the shopping center was initially approved. Mr. Elfreich, also, mentioned in his memo that the plan did not show any location for a wash down pad that the Westchester County Health Department requires for storing garbage and rubbish containers for restaurant use and he did not see any place where it could be conveniently lo- cated to be readily accessible for removal operations. After further discussion the Board decided to recommend that the Town Board approve the application subject to the following conditions: 1 . The applicant obtain a variance for the parking as required for a restaurant. 2. The approval of the Westchester County Health Depart- ment for the location of the storage pad. The Board also decided that the environmental impact would not be changed from what had been determined when the shop- ping center was originally approved.
