MAMARONECK HELD AUGUST 15, 1984, IN THE AUDITORIUM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, LARCHMONT, NEW
YORK.
CALL TO ORDER
The meeting was called to order by the Chairman at 8:25
P.M.

REFERRAL FROM TOWN BOARD FOR RECOMMENDATIONS FOR APPLICATION FOR
SPECIAL PERMIT - POWER TEST GASOLINE STATION - 2385 BOSTON POST
ROAD - BLOCK 505 PARCEL 415
Mr. John McDermott represented the applicants and said
that they were proposing to extend out in the front about
2 ft. in order to put in a mini mart and self-service gas
station. A question was raised as to the hours of opera-
tion and the applicant said that in their other stations
they are usually open from 7 A.M. to 11 P.M. but that would
be up to the dealer.
Mr. McDermott said their reasons for expansion were to
have the self-service station, attract new dealers and
be of public service for the late shoppers. The applicant
said they would probably sell milk, bread, cigarettes,etc.
A question was raised as to whether they planned to sell
beer. Mr. Nicolaysen pointed out that there is a super-
market in the vicinity which is opened at night. Mr. McDer-
mott said that this type of operation has been very suc-
cessful in Connecticut and Massachusetts and Mr. Nicolay-
sen said they are very common in the South and West but
expressed "hang-out".p concern about it becoming a g A ques-

APPLICATION FOR PRELIMINARY HEARING - SUBDIVISION OF JOSEPH T. MALONEY
(BERRINGER PROPERTY) - FENIMORE ROAD - BLOCK 302 PARCEL 1 - BLOCK
304 - PARCELS 1 and 58 - BLOCK 312 PARCELS 45 and 130
Mr. Albert F. Campbell, an Attorney of 271 North Avenue,
New Rochelle represented the applicant who said the appli-
cants have 32 lots and they all contain more than 30,000
sq. ft. and no zoning variances will be required.
Mr. Kalos said that under SEQR the Planning Board is charged
with making the initial determination as to the type of
action and based on that determination whether to proceed
or whether a full Environmental Impact Statement will be
required.
About fifty Murdock Woods residents appeared who were con-
cerned about the possibility of the road beitg opened and
a connection made between Murdock Woods and the proposed
development.
Mr. David Pravda of 22 Salem Drive expressed his concern
and said it would have a detrimental impact as the police
have attributed the fact the the area was relatively "bur-
glary free" due to its limited access.
Mr. George Forbes represented Mr. and Mrs. Ziplow who live
at the end of the cul-de-sac and claimed they would be
affected if the road went through. It was pointed out
by the developer that he has no interest in opening the
road and would prefer to have the road closed.
Mr. Campbell pointed out that the developer would only
take out the trees that are necessary and the houses will
probably sell b r a minimum of $600,000.
The Board decided they could not make any determination
at this time and would like some additional information
as to the location of the wetlands and the steep slopes
on the property.
Dr. Schloss of 31 Kolbert Drive said he was concerned since
when they have heavy rains now the whole street is flooded.
Mr. Richard Scheuer of 845 Fenimore Road urged the Board
to consider whether an EIS is required.
Mr. Morganroth who prepared the Environmental Assessment
Form said that the drainage they proposed on the develop-
ment will retain the water and there will be no increase
in the drainage.
After further discussion the Board on motion made and seconded
passed the following Resolution:
RESOLVED, that notices be sent to all the proper
authorities designating the Planning Board to
act as Lead Agency for SEQRA and gives notice
that a determination of the type of action would
be considered at the September Meeting.
Mr. Elfreich pointed out to the Board that requests for
subdivision approval requires two accesses and cul-de-sacs
cannot be over 400 ft. but there is a section in the sub-
division rules that gives the Planning Board the right
to waive this rule.
The determination of the type of action on this applica-
tion was deferred to the September meeting. The Attorney
for the applicant specifically consented to this procedure
on the record.
After discussion the Board held open to the September Meet-
ing Preliminary hearing on this application. The Attorney
for the applicant specifically consented to this procedure
on the record.
APPROVAL OF MINUTES
The minutes of the meeting of July 13, 1984 were presented
and on motion duly made and seconded approved as submitted.
ADJOURNMENT
There being no further business to come before this meet-
ing it was adjourned at 10:15 P.M.
