The meeting was rescheduled and held on February 3, 2004 in the Mamaroneck Town Center, Conference Room A,2nd Floor,740 W. Boston Post Road, Mamaroneck, New York. Approval of Minutes The minutes of November 25,2003 were approved as submitted. 2. Referrals a. Subdivision/Site Plan Approval—Varela LLC—24 Lester Place—Block 103,Lot 62 Referred by the Town of Mamaroneck Planning Board Mario Canteros, architect and Steven Gamelsky, engineer presented revised plans and submission documents for the construction of five new homes and a private road. The revised plans included more detailed information on the proposed stormwater management system, topography, and erosion and sediment control plan. The report contains the design calculations and a stormwater management system maintenance plan. CZMC finds the proposed action to be consistent with the policies set forth in the LWRP. CZMC is pleased to see the use of innovative, low impact development(LID)techniques for Page 1Qf4 %ft Printed on Recycled Paper stormwater management, such as block pavers,"bioretention swales"and"biodetention cells" on this application. However,CZMC cautions the use of these practices without appropriate deed restrictions to ensure their continued maintenance by home owners. In addition, the applicant should be required to submit a detailed maintenance plan for the stormwater detention facility and the sand filtration system and the Homeowner's Association should be required to submit copies of all inspection reports to the Town. The Stormwater Pollution Prevention Plan (SWPPP) Soil Stabilization Section(3.3.4)and associated Stormwater Management Plan (Soil Erosion & Sediment Control Plan)refer to soil stabilization best management practices(BMPs) by reference. Notwithstanding, stabilization with temporary vegetative cover via hydroseeding should be implemented in all areas as soon as possible following soil disturbance activities. b. Subdivision/Site Plan Approval—Marsella&Picciotto—1046 Palmer Avenue—Block 407, Lot 347 Referred by the Town of Mamaroneck Planning Board Frank Marsella and Virginia Picciotto,the applicants,and Benedict Salanitro,the consulting engineer, presented plans for the demolition of the existing single family house and the construction of two new houses. CZMC finds the proposed action to be consistent with the policies set forth in the LWRP. The Applicant's engineer was not able to perform the necessary percolation tests and borings for the design of the drywell system due to the frozen ground conditions at the site and instead, estimated the percolation rates and drywell locations. CZMC recommended and the applicant agreed to perform actual percolation tests and borings,when conditions permit, at the location and depth of the proposed drywells. The assumed design should then be reevaluated and modified, if necessary,at that time. . c. Forest City Daly Draft Environmental Impact Statement Referred by the Mamaroneck Town Board CZMC reviewed the Draft Environmental Impact Statement for the Forest City Daly Proposal and offered the following comments: 1. Stormwater Management a. Stormwater Quality The applicant is stating that there will be an overall improvement in the quality of the stormwater being discharged from the site (page I-9). However, there will be an 8% increase in the amount of metals present in the stormwater discharges after treatment by a sand filter. What is the potential impact of this increase in metals on the Pine Brook and Long Island Sound? What is the pollution source of the metals? Why are the estimated levels of metals so high? What can be done to mitigate this? b. Stormwater Quantity The applicant is proposing the use of a sand filter and stormwater detention structure to manage and treat stormwater. These systems are typically designed with an overflow to the stormwater sewer. In the event that the structures become clogged or fail due to a lack of maintenance,stormwater would bypass and flow directly into the stormwater sewer without detention or treatment. To prevent this scenario,the applicant should provide the Town with a detailed maintenance schedule that is enforceable by the Town. 1111 Page 2 of 4 C Appendix 5, Stormwater Management Report, Page II-2,the 1st paragraph erroneously states, "Runoff from the municipal system in Madison Avenue discharges into the Mamaronq J ,1 iver,.. ' ;This,,sjiould be corrected to read, "Runoff from the municipal system in Madison Avenue discharges into the Pine Brook..." It should be noted that the Pine Brook is subject to serious flooding downgradient of the project site in the Village of Larchmont. The applicant should evaluate the capacity of the Pine Brook to receive stormwater from the project site and propose alternatives to minimize discharges to this tributary. The present proposal contains a large amount of impervious surface. In addition, the stormwater design goals provide for detention rather than retention. In consideration of the known flooding conditions of the Pine Brook,the applicant should utilize other alternatives which could reduce the amount of stormwater discharges off-site utilizing Low Impact Development techniques, including but not limited to,the use of retention structures to store,treat, and retain water on-site,the allowance for more pervious areas and materials, and increased plantings in parking areas and rooftops to provide additional detention and/or retention. 2. Environmental Assessment Pages III.B-2 and III.B-3 state that ELM conducted additional testing of on-site soils and groundwater during September 2002. This study was not included in the Appendices and should be. In addition, The Phase II Environmental Assessment Report should be included in the Appendices. ` 3. Construction Impacts lo During construction, how does the applicant plan to pre-treat stormwater and groundwater discharges from the site to remove pollutants, sediment, etc? 3. Flint Park Request for Proposal f ;. Mayor Kenneth Bialo invited members of CZN!C, Sheldrake Environmental Center and Flint Park Conservancy to a meeting on December 15,2003 to discuss the restoration and use of the conservation area of Flint Park. The entire Flint Park Improvement Project is expected to cost between $900,000 and $1,000,000 to complete. Of this,approximately$100,000 will be used for conservation area restoration. CZMC presented a Request for Proposal for the conceptual design of this area. The Mayor,while appreciative of the effort,requested that the group visit the park and, at another meeting, provide him with our suggestions. Several of the meeting attendees visited the park in January. A letter will be written to the Mayor stating that CZMC is still interested in taking an active role in this project and to see what the next step will be. 4. Open Space Inventory A draft of the Open Space inventory was distributed to all members. Comments should be sent to Elizabeth Paul. 5. Annual Report The Annual Report was revised and distributed to all members. Comments were received from Phyllis Wittner and Bernie Kaplan. Any additional comments are to be submitted by February 10t for inclusion in the final report. 6. Old Business 410 No old business to discuss. Page 3 of 4 _ ::_>�41r Gifu 7. New Business A memo on the Historic Harbor Festival was distributed. The Village of Mamaroneck is seeking the participation of all local water groups in a water pavilion to be set up at their Historic Harbor Festival. Anyone interested in participating should contact Christie Derrico or Katherine Desmond. The meeting was adjourned at 10:00 p.m. The next scheduled CZMC meeting will be held on February 24,2004 at the Mamaroneck Town Center,740 West Boston Post Road,2°d Floor,Conference Room A.
