Thank you to Dr. C. Alan Mason for Serving on CZMC Dr. C. Alan Mason resigned from CZMC. A letter will be sent to him thanking him for his many years of service with the commission. Subdivision/Site Plan Approval—Mark Mustacato/RMG Design—Subdivision of Lot and Construction of a Single-Family House—2040 Palmer Avenue—Block 601, Lot 137 Referred by the Larchmont Village Planning Commission Mark Mustacato presented revised plans for the subdivision of the property and the construction of a single-family house. This project had come before CZMC last year and the plans for the proposed house have been completely revised. CZMC found the proposal to be neither consistent nor inconsistent with the policies set forth in the LWRP. It was noted that the test pits that were dug for the design of the drywell were done to a depth of two feet and did not simulate the depth of the proposed drywell. CZMC recommends that the Village of Larchmont Engineering and Building Departments revise their criteria for the design and siting of drywells to require test pits dug to the depth of the proposed drywell. This would more accurately determine the depth to bedrock and give more precise percolation rates for use in the design. In addition, CZMC recommends that appropriate measures be used for sediment and erosion control during construction. b. Freshwater Wetlands and Watercourses Permit—Hampshire Country Club/Tony Campanella— 1025 Cove Road—Block 414, Lot 20 Referred by the Town of Mamaroneck Planning Board Benedict Salanitro and Tony Campanella presented plans for a stormwater detention system for the golf cart path. The cart path had been constructed within several feet of a wetland area without a wetlands permit. The proposed stormwater detention system uses a series of 18 infiltrator units, connected by an underground drain. CZMC finds the golf-cart path and stormwater detention system to be inconsistent with the policies in the LWRP. Because the Hampshire Country Club failed to obtain the necessary permits and go through the proper review process, the golf-cart path as it exists is not the optimum design. Considering that the entire property is classified as a Critical Environmental Area(CEA)and the project's proximity to the wetlands, CZMC would have likely recommended that the path be constructed of gravel rather than asphalt. It is our opinion that a pervious surface is more preferable to an engineered solution as the efficiency of dry wells can deteriorate over time. Notwithstanding, in lieu of removing the path that was installed, the stormwater detention system proposed by the Applicant appears to be sufficient to minimize the effect of runoff from the project. During our meeting,the Applicant was receptive to planting native wetland species along the bank of the wetlands as a mitigative measure to minimize future erosion. The Town's Conservation Department can provide the Applicant reference material and assist in the selection of appropriate plantings. CZMC also recommends that future paths within the Hampshire Country Club be constructed of gravel or another pervious surface, if possible. All future work on the golf CZMC-40/22102,Page 2 of 4 Revised 12/12/2002 0 course should also be reviewed by the Town's Building Department to determine which permits, if any, are required. c. Freshwater Wetlands and Watercourses Permit—Winged Foot Golf Club—Dredging of Irrigation Pond—851 Fenimore Road - Block 347,Lot 1 Referred by the Town of Mamaroneck Planning Board Winged Foot Golf Club is proposing to dredge the upper irrigation pond to create additional water storage capacity. Aqua Dredge, a dredging company,has proposed to dredge the pond,pipe the sediment into a holding area and pipe the water back to the pond. Once completed,the sediment will be covered with topsoil and seeded. Approximately 10,000 cubic yards of sediment will be removed from the pond. The applicant has contacted NYS DEC and has determined that they are not required to obtain a permit from the State. The applicant has also tested the sediment at the request of the Planning Board and found no pesticides, or other contaminants in the sediment. Some sulfur was detected. CZMC finds the proposed dredging of the irrigation pond to be neither consistent nor inconsistent with the policies set forth in the LWRP. CZMC recommends that appropriate sediment and erosion control measures be used throughout the duration of the project, until vegetation is reestablished. d. Subdivision—William J. Morley/Jim Fleming—34 Beach Avenue- Block 720,Lot 162 Referred by the Larchmont Village Planning Commission At one time, there were two houses located on the property—a main house and a carriage house. The main house was destroyed many years ago. The owner lives in the carriage house and is not permitted to build a second house, because two houses are not permitted on one lot. The owner wishes to subdivide the property at this time but has no plans yet to build a home on the vacant parcel. CZMC finds the subdivision of the property to be neither consistent nor inconsistent with the policies set forth in the LWRP. CZMC requests that the current owner refrain from cutting the trees on the vacant parcel until plans to build the house are approved. At the time a new house is built, it is recommended that appropriate sediment and erosion control measures are used and care is taken to protect the trees on the property. e. Special Use Permit—Trikaya Partners,LLC—Yoga Studio—2444 Boston Post Road - Block 503,Lot 137 Referred by the Town of Mamaroneck Planning Board The applicant is proposing to create a Yoga Studio and have classes in a commercial building. There are no exterior modifications proposed to the structure. CZMC finds the proposal to be neither consistent nor inconsistent with the policies set forth in the LWRP. f. Site Plan Amendment/Freshwater Wetlands and Watercourses Permit—Winged Foot Golf Club—Creation of Tee Area—851 Fenimore Road - Block 347, Lot 1 Referred by the Town of Mamaroneck Planning Board CZMC—10/2202,Page 3 of 4 Revised 12/12/2002 0 The Coastal Zone Management Commission(CZMC) adjourned the above referenced matter at its regularly scheduled meeting on October 22, 2002 at the applicant's request. CZMC requests an opportunity to review the proposal at its next regularly scheduled meeting on November 26,2002. 4. Old Business a. Open Space Inventory Kate Dehais gave a status report of the Open Space inventory. The remainder of the non- inventoried parcels will be redistributed to members that are interested in visiting them. The next step will be to create a plan to visit the larger parcels. Once that is completed, recommendations will be made to the Town and Village Boards. Phyllis Wittner requested a list of the larger parcels. A response to our letter regarding the parcel on Griffen Drive (adjacent to Flint Park) was received from Larchmont Village's ad-hoc committee on open space. In the letter,they agreed to look into the acquisition of the property and will make their recommendations to the Village Board. CZMC discussed Flint Park and the need for additional playing fields and the future of Tony's Nurseries. 5. New Business a. Environmental Committee The Larchmont Village Board approved the creation of an Environmental Committee. CZMC would like to support the committee and have a liaison attend the meetings. b. David's Island The City of Rye turned down a resolution supporting the County acquisition of David's Island. CZMC should write a letter to the Village of Larchmont and the Town of Mamaroneck asking them to pass a resolution supporting the County acquisition. The meeting was adjourned at 10:05 p.m. The next scheduled CZMC meeting will be held on November 26, 2002.
