Giancola Consulting Engineer, 7 Deerfield Lane 1. Approval of Minutes The minutes for March 26, 2002 and April 23,2002 were approved as submitted. It was noted that there was some confusion as to whether one of the proposed docks at the Larchmont Yacht Club was on the north or east side of the existing dock. Freshwater Wetlands and Watercourses Permit for the Construction of a Driveway and Garage at 7 Deerfield Lane-Block 325,Lot 92 Referred by the Town of Mamaroneck Planning Board John Giancola,the consulting engineer for Mr. Yasgur presented the proposal to install a 243' long gravel and macadam driveway leading to a detached three-car garage. The driveway will run along the side of the manmade pond. The stormwater detention system has been sized to detain runoff from the entire driveway and the garage roof. Michael Finkbiender,the applicant's forester,presented plans to remove several trees that are located within the path of the proposed driveway and the garage. The plans presented indicated tree protection measures. The grove of trees next to the pond will be preserved. The pond is a man-made structure with retaining walls and a concrete bottom. It is maintained by filling it with pumped groundwater. The pond would go dry if water was not pumped into it. The applicant selected a route for the driveway that would impact the fewest trees. Mr. Finkbiender described the trees selected for removal and the measures for protecting the remaining trees. The applicant stated that he is very concerned about the protection of his trees. CZMC suggested methods for protecting the tree root system from compaction and damage during construction by using wood chips,plywood sheets and lighter weight equipment. This matter was referred to CZMC due to the proximity of the proposed project to a man-made pond that was built many years ago on the Applicant's property and an adjacent lot. At our meeting,the Applicant represented to CZMC that the pond was constructed of and lined with concrete, had no natural feeder, and was filled by means of water artificially introduced into the pond by the Applicant. Further, the Applicant and his consultant confirmed that the pond was not surrounded by hydric soils or hydrophytic vegetation. Accordingly, CZMC questions whether this pond should be identified as a watercourse on the Town wetlands map. (For your information,the draft revision to the Town wetlands law,which CZMC has submitted to the Supervisor, suggests that"Structures" such as the pond be specifically excluded from the definition of"Watercourse." We believe that this revision merely clarifies existing law.) Under the circumstances, CZMC believes that the requirement for the Applicant to obtain a Freshwater Wetlands and Watercourse Permit is unnecessary. Alternatively, in the event that the Planning Board believes that the pond should continue to be considered as a watercourse, CZMC has determined that the construction of the garage and driveway is, in fact, inconsistent with Policy 44 of the LWRP, which discourages disturbances in areas within 100 feet of wetlands and watercourses. CZMC notes, however,that Applicant has attempted to minimize the CZMC-4/23/02,Page 2 of 3 Revised 8/6/2002 disruption by providing a drainage plan that will result in no net increase in run-off from the site, and has sited the driveway so as to minimize the need for the removal of trees. 3. Old Business The revised Wetlands and Watercourses Law has been submitted to the Town Board for their review and comment. A new map needs to be created to accompany the revised law. Steve Coleman had already created a map. This should be located. The revised law should be sent to Mayor Ken Bialo. Packages have still not been received for the open space inventory. Madelaine Berg and Phyllis Wittner reminded everyone to please work on these and return them to Elizabeth Paul. Marlene Kolbert requested a copy of the open space list for the Village of Larchmont. The Village of Larchmont requested that we not contact the individual property owners. Once all the parcels have been visited, a smaller list of parcels will be selected for inclusion in the list. Our recommendations should be made to the Town Board. 4. New Business There will be a special meeting on Monday, June 3, 2002 to review the SEQR process. A public scoping session for the Forest City Daly Draft EIS will follow this. We are still trying to schedule a meeting with the NYS DOS and the Mamaroneck Village CZMC. The meeting was adjourned at 9:00 p.m. The next scheduled CZMC meeting will be held on June 25, 2002.
