The meeting was called to order at 8:10 p.m. MEMBERS PRESENT: William Bailey Bernard Kaplan Madelaine Berg, Chairperson C. Alan Mason Elizabeth Cooney Howard McMichael Marc Godick REGRETS: Lili Andrews Eileen Weingarten OTHERS PRESENT: George Latimer Chair, Westchester County Board of Legislators Phyllis Wittner Town Board, Town of Mamaroneck 1. Introduction Elizabeth Cooney, representing the Town of Mamaroneck, was introduced to CZMC as a newly appointed member. 2. Approval of Minutes The minutes of the February 2, 2000 meeting and the February 29, 2000 meeting were read and approved as changed. 3. David's Island Request For Proposals George Latimer advised CZMC that the County will shortly be releasing a Request for Proposals for a consultant to review possible uses for David's Island should the County JPrinted on Recycled Paper ® acquire the island from New Rochelle for use as a park or other purpose. Rep. Latimer said that the County would provide CZMC and other interested bodies with draft copies of the RFP so they may comment on its contents before it is finalized. 4. Consistency Referral 11 Briar Close Referred by the Town of Mamaroneck zoning Board of Appeals James Fleming, architect, and Veronique Parke,homeowner,presented the description of a proposed rear extension to the Parke home. The extension will lie within 11 feet of the boundary of the Leatherstocking Trail, a Critical Environmental Area. The existing house is approximately 22 feet from the boundary. Color photos of the site, taken in winter, show that because of the elevation of the site above the actual trail portion of the Town property, the addition would be only minimally visible from the trail. Mr. Fleming contended that the request met the standards for a zoning variance. The CZMC concluded that the requested variance was not consistent with the LWRP because of its proximity to the adjoining Critical Environmental Area. However, CZMC acknowledged that this particular site presented unusual conditions. Specifically,the elevation of the site reduced the visual impact of the addition, and other alternative proposals, which would be further from the Leatherstocking Trail,would, actually be more visible from the Trail. This referral sparked discussion among the members regarding the problem of certain other landowners who are actually encroaching on the Leatherstocking Trail by extending their lawns over the boundaries of the Critical Environmental Area and into the Town's property. Howard McMichael suggested that the resolution of this problem might be to place monuments, either in the form of stone markers, walls or shrubbery, along the boarders of the trail. 5. Wetlands Law Copies of the proposed draft versions of the Town of Mamaroneck and Village of Larchmont Wetlands and Watercourses Protection Laws were distributed to the members, along with the memos to the Town and Village boards which will accompany the laws. The draft laws will be forwarded to the Town and Village boards,with an offer to participate in a joint work session with both municipalities, in an effort to expedite and streamline the review process for the laws. Madelaine Berg thanked Phyllis Wittner for her assistance with the Village version of the law. The meeting was adjourned at 9:42 p.m. © The next scheduled CZMC meeting will be held on April 25,2000. 2
