Boston Post Road, Mamaroneck, New York. Tree Removal/Building Permit—Roderick Williams—74 Lansdowne Drive- Block 218, Lot 658 Referred by the Town of Mamaroneck Town Board and the Tree Preservation Commission The applicant, Mr. Williams, presented modified site plan drawings for a proposed addition to the single-family house. The drawings include the removal of trees, placement of fill material, construction of retaining walls, locations of drywells, replacement plantings and the footprint of the proposed addition and driveway. The applicant's engineer and tree consultant addressed the questions and comments of CZMC and the neighboring residents. Several modifications to the site plans were requested in response to these comments and are listed below. CZMC reviewed the potential impacts of the proposed action on erosion and sediment control, stormwater runoff and the protection/removal of trees. CZMC recommends that the permit for the removal of trees be granted provided that the plans are determined to be sufficient by the Town's engineer and the following revisions/clarifications are made to the site plan: • The 8' and 10' dimensions indicating the distance of the proposed retaining wall from the property line were interposed and must be corrected. • A double row of silt fence and hay bales must be indicated along the rear perimeter of the property. 4113 • Addition of a note stating that all fill material will be certified as clean fill by the engineer. • Addition of notes or details demonstrating how slopes will be temporarily stabilized during fill operations and that as soon as finished grade is achieved, vegetative cover will be reestablished. • Clarification of the maximum amount of fill to be placed in the "shaded" area of the drawing. • Indicate that the retaining wall closest to tree #5 will end at the rock outcropping and will not impact the tree. • Indicate that the tree well shown for tree #70 will only be installed as necessary. 3. Old Business a. 33 Marbourne Drive The Town of Mamaroneck Planning Board requested clarification of the consistency letter sent to them by CZMC on January 27, 2005. The letter states that the proposed action would create significant adverse impacts to the wetland buffer and potentially to the wetland and watercourse. The Planning Board asked CZMC to specify what those impacts would be. A letter is being written that clarifies the impacts associated with the loss of wetlands buffers. b. Flint Park Marc Godick updated CZMC on the status of this project. Larchmont Village retained 40 the services of Eberlin&Eberlin to design the playing fields for Flint Park. IQ Page 2 of 4 Landscapes was hired as a sub-consultant for the design of the conservation area. A meeting is being held on March 23rd at 7:00 PM to review the plans. c. Leatherstocking Trail Encroachments The Town is sending letters to those residents along the Leatherstocking Trail who have encroached onto Town property. Meetings will be arranged with each property owner to discuss restoration planting. Lawn encroachments will be addressed first and structural encroachments will be addressed at a later date. 4. New Business a. Tree Law The Tree Commission is currently made up of three staff members and two resident volunteers. It is logistically difficult to schedule site visits with the two volunteer members. The Tree Commission will now include the members of the Town's tree trimming crew who are being sent to training classes. A professional arborist can be consulted as necessary. b. Waterfront Revitalization Law The Town's Waterfront Revitalization Law requires applicants to submit a Coastal Assessment Form. Elizabeth Paul,the Town's Environmental Coordinator requested that CZMC review whether this form is duplicative and unnecessary because applicants are required to prepare an Environmental Assessment Form. Councilwoman Phyllis Wittner contacted the NYS DOS and determined that the form is required for Direct Actions, defined as "An action planned and proposed for implementation by the municipality or any public or quasi-public agency. "Direct actions"include but are not limited to capital projects, procedure-making,policy-making and zoning." c. Environmental Quality Review Law Judith Gallent, the attorney for the Town of Mamaroneck Planning Board requested that CZMC review the Town's Environmental Quality Review Law (MEQR). Section 92-3 currently states: "The procedures of 6 NYCRR 617.4 shall be amended in that the last sentence of 617.4(h) shall state: "Any unlisted action located partly or wholly inside or substantially contiguous to a CEA must be treated as a Type I action by an involved agency.' This section is no longer valid because Section 617.4(h) of SEQR was eliminated when SEQR was amended in 1995. If the Town would like to require all unlisted actions in or contiguous to a CEA to be treated as a Type I action, an amendment to MEQR will be required. A letter will be written to the Town Board making the recommendation that an amendment be made. d. Forest City Daly The Town Board has accepted the Final DEIS from Forest City Daly. The number of proposed units has been reduced and the number of work force housing units has been increased from the original proposal. In order to alleviate the parking impacts in the neighborhood, a parking deck will be constructed above the lot on Myrtle Boulevard. The next step is for the applicant to apply for a zoning text amendment. Page 3 of 4 The meeting was adjourned at 9:55 p.m. • The next scheduled CZMC meeting will be held on April 26, 2004 at the Mamaroneck Town Center, 740 West Boston Post Road, 2nd Floor, Conference Room A.
