July 25, 2006
A regular meeting of the Coastal Zone Management Commission(CZMC) was held on July 25,
2006 in the Mamaroneck Town Center, Conference Room A 2nd Floor, 740 W. Boston Post
Road, Mamaroneck,New York. The meeting was called to order at 8:00 p.m.

1. Approval of Minutes—June 27,2006
The minutes were approved as submitted for June 27, 2006.
2. Referrals:

Referred by the Town of Mamaroneck Planning Board
The applicant presented plans to open an Italian style take-out restaurant in the space
formally occupied by a Chinese take-out restaurant. CZMC found the proposal to be
neither consistent nor inconsistent with the policies in the LWRP.

Referred by the Town of Mamaroneck Planning Board
On May 23'd, CZMC requested additional information on whether the proposed .
driveway retaining wall would impede the flow of the Sheldrake River during a
storm. As originally proposed, the wall would have been located within the flood
zone and within the stream channel. To remedy this situation, CZMC suggested that
the applicant consider reducing the width of the proposed driveway in order to move
the retaining wall outside of the flood plain and away from the river bank and/or seek
a variance to move the driveway closer to the property line. The applicant's engineer
met with Town staff to review the flood maps and returned to CZMC on July 25th
with an alternate design that utilizes a cantilever retaining wall.
CZMC found that even with the modified retaining wall design, the proposed action
conflicts with Policy 44 of the LWRP because the construction of the proposed
retaining wall and driveway would disturb soils and vegetation within the 100-foot
buffer and possibly along the bank of the river itself. Policy 44 is to "Preserve and
protect tidal and freshwater wetlands and preserve the benefits derived from these
areas." The explanation of the policy and the guidance for determining consistency
with this policy specifically states:
"Where possible, 100 foot buffers, at a minimum, should be preserved
around all wetlands."
Despite the applicant's effort to mitigate the affect of the driveway on the buffer,the 111
proposed action remains and is inconsistent with the LWRP. •
c. Special Permit—Forest City Mixed Use Development—Madison Avenue—Block
132, Lots 410,463,469,504, 511,512
Referred by the Town of Mamaroneck Planning Board
Forest City requested a modification of their special use permit that would allow the
construction of one additional floor on the previously approved apartment building.
In addition,Forest City would construct a parking deck over the existing Town
parking lot on Myrtle Blvd. CZMC found the proposed action to be neither
consistent nor inconsistent with the policies set forth in the LWRP.
3, Old Business:
a. Gap Analysis—Town of Mamaroneck Surface Water,Erosion & Sediment
Control Law
Madelaine Berg, Elizabeth Cooney and Lisa Hochman agreed to conduct the review
of the erosion control law for compliance with the Phase II Stormwater Regulations.
Elizabeth Paul will provide each of them with the necessary materials.

4. New Business:
a. Blood Brothers Project in Mamaroneck Village
CZMC discussed the proposed redevelopment of the Blood Brothers site in
Mamaroneck Village. This site was the former location of an auto wrecking company
and is located on the bank of the Sheldrake River. CZMC would like an opportunity
to review the DEIS.
The next scheduled CZMC meeting will be held on September 26, 2006 at the Mamaroneck
Town Center, 740 W. Boston Post Road,2"d Floor Conference Room A. Anyone unable to
