Boston Post Road,Mamaroneck,New York. Approval of Minutes The minutes of October 26,2004 and November 23, 2004 were approved as submitted. C Page 1 of 4 %of Printed on Recycled Paper 2. Referrals: • a. Tree Removal/Building Permit—Roderick Williams—74 Lansdowne Drive-Block 218,Lot 658 Referred by the Town of Mamaroneck Director of Building The proposal was presented to CZMC by Roderick Williams, Richard Hein and Benedict Salanitro. Mr. Williams is seeking a building permit to substantially enlarge the existing single family home, install retaining walls and a stormwater detention system and import fill material to re-grade the property. In addition, Mr. Williams has applied for a permit to remove seven (7) additional trees from the property. Approval has already been granted for the removal of five (5) trees that were identified as hazardous by the Town of Mamaroneck Tree Preservation Commission. Several of the adjacent neighbors and their attorney were present to hear the matter and state their concerns. CZMC requests that the applicant appear at the next scheduled meeting on February 22, 2005 with the following additional information: • Peicolation test results, design details, and calculations for the proposed stone water management system. • Engineering details of the proposed retaining walls and methods of tree protection. • An estimate of the quantity of fill material being proposed. • • A detailed erosion/sediment control plan for the fill operation. CZMC also recommends that an additional drywell be added to contain stormwater runoff from the proposed gravel driveway should it ever be paved or a deed restriction placed on the property stating that the driveway will not be paved. b. Wetlands and Watercourses Permit—Marc Contracting—33 Marbourne Drive - Block 334, Lot 23 Referred by the Town of Mamaroneck Planning Board Based on CZMC's recommendations (in a letter to the Planning Board dated 10/4/04), the applicant revised the plans for the construction of a new single family home within the 100-foot wetland buffer zone. The proposal to pipe the stream was eliminated from the original proposal and the house was reduced in size and moved as close to Marbourne drive as possible without requiring a variance. Notwithstanding, CZMC finds the proposal to be significantly inconsistent with Policy 37(C) and Policy 44 item 4 of the Local Waterfront Revitalization Program which state: Policy 37 C. Standards for Buffer Areas An important component of nonpoint pollution management is the creation and protection of buffers along the watercourses of the Town and Village, which help to maintain and improve water quality by filtering stormwater CIO runoff. Because our area has been highly developed, natural buffers have Page 2 of 4 0 � © been altered in many areas. Natural buffers should be retained where they exist, and where appropriate,restored or enhanced. Policy 44 - Item 4. Where possible, 100 foot buffers, at a minimum, should be preserved around all wetlands. While the application does not propose disturbing the banks of the watercourse, its slopes are steep and areas downstream of the site are prone to flooding. Nearly the entire parcel is within the 100-foot wetland buffer zone. Development of the site would create significant adverse impacts to the wetland buffer and potentially to the wetland and watercourse. Based upon the anticipated impacts to the buffer area and the proposed project being significantly inconsistent with the LWRP, we do not support the issuance of a Wetland and Watercourses Permit for the site. c. Special Use Permit—Glen A. Hazim—630-636 Fifth Avenue - Block 132, Lot 78 Referred by the Town of Mamaroneck Planning Board Glen Hazim is seeking a Special Use Permit for the operation of an auto body repair shop in the location formally occupied by East Coast Auto Body. The applicant is proposing the following improvements to the existing auto body shop: • Installation of additional floor drains. • Installation of an oil/water separator. • Elimination of the existing waste water connection that leads to a gravel pit at the rear of the property. • Connection of all floor drains to the new oil/water separator and connection of the oil/water separator to the sanitary sewer system. • Installation of a paint spray booth. CZMC finds the proposal to be consistent with the policies in the LWRP because the applicant is proposing to utilize best management practices to improve the quality of wastewater leaving the site. However, CZMC recommends that the applicant provide additional design details for review by the Town's Engineer and Building Department that show the proposed oil/water separator, floor drain connections and the waste water connection to the sanitary sewer system. The oil/water separator should be properly operated and maintained. CZMC also advised the applicant that in addition to Town requirements, there are also County, State and Federal requirements for discharges to the sanitary sewer system, the operation of the auto body shop, and for permanent closure of the gravel pit(dry well/Class V injection well) at the rear of the property. d. Special Use Permit—Mercedes Benz/Crocco—2500 Boston Post Road - Block 503, Lot 123 Referred by the Town of Mamaroneck Planning Board Joseph Crocco and Christopher Tokarz from Mercedes Benz presented the proposal for the operation of a car dealership at the location that was formally occupied by the Saturn dealership. The applicant is proposing to update the existing overhead lights, with Page 3 of 4 • different lighting levels proposed during hours of operation and overnight security. • Decorative landscaping will be added and the parking lot will be re-striped. The used car lot located across the street will be used for car storage. No changes are proposed to that parcel at this time. The floor of the service area has an existing oil/water separator that the applicant has agreed to replace with a new unit. The applicant provided CZMC with a list of wastes typically generated by their service department that included quantities generated and a schedule for waste collection. Cars will be delivered by truck to their White Plains location and driven individually to the location at 2500 Boston Post Road. CZMC finds the proposal to be neither consistent nor inconsistent with the policies in the LWRP. However, CZMC advised the applicant that in addition to Town regulations, there may be County, State and Federal permits required for the operation of the service area. In addition, the applicant agreed to install and properly maintain a new oil/water separator to treat waste water collected from the floor drains. The applicant was advised of potential additional Federal and State regulatory requirements with respect to the proposed petroleum bulk storage at the facility. 3. Thirteenth Annual Report Copies of the Thirteenth Annual Report were distributed. Marc Godick will be presenting the report to the Town of Mamaroneck Board on February 2nd and the Larchmont Village Board on February 7th. 4. Old Business • No old business to discuss. 5. New Business Marc Godick spoke with a Town of Mamaroneck resident who may be a good candidate for CZMC. Copies of her resume will be distributed and she will be asked to attend a CZMC meeting. The meeting was adjourned at 10:20 p.m. The next scheduled CZMC meeting will be held on February 22,2004 at the Mamaroneck Town Center, 740 West Boston Post Road, 2nd Floor, Conference Room A.
