Boston Post Road, Mamaroneck,New York. Brookside Drive Frank Buddingh,Neighbor Nina Arron,Neighbor 1. Approval of Minutes—November 28, 2006 The minutes were accepted as submitted for November 28, 2006. 2. Referrals: a. Wetlands and Watercourses Permit—Billie Cohen,LTD- 12 Wildwood Circle- Block 507, Lot 66 Referred by the Town of Mamaroneck Planning Board The applicant requested that discussion of this matter be adjourned until further notice. Special Use Permit—David Dunn,Diamond Glass—636 Fifth Avenue—Block 132,Lot 78 Referred by the Town of Mamaroneck Planning Board David Dunn presented the proposal to open an auto glass repair shop. The location was formerly an auto body shop. CZMC found the proposed action to be neither consistent nor inconsistent with the policies set forth in the LWRP. c. Wetlands and Watercourses Permit—John & Marguerite Lee—160 W. Brookside Drive—Block 430, Lot 206 Referred by the Town of Mamaroneck Planning Board Sue Ellen Commender, the landscape designer for the Lees,presented the proposal for the removal of invasive vegetation from the property. The proposal includes the removal of all invasive ground cover and vines from the property and the planting of native shrubs. No specific planting plan has been provided to CZMC because the applicant is proposing to clear the existing vegetation and, once removed, determine the location and quantities of replacements. In addition to the application for a wetlands permit, the applicant has applied to the Town's Tree Preservation Commission for a permit to remove 47 trees from the property. According to the landscape designer, the applicant plans to apply to the Building Department for permits needed for the demolition of the existing house,the construction of a new house and the replacement of the bridge over the Sheldrake River. According to Elizabeth Paul,who serves as a member of the Town's Tree Preservation Commission, upon initial review, it was determined that the 47 trees the applicant is proposing to remove are not all hazardous as the permit application suggests. Many of the trees are Norway Maples, known to be invasive, but which appear to be in good health. Other trees included in the application are located in an area to be disturbed by proposed construction, however, since plans have not yet been received by the tree commission for any proposed work, these trees cannot be approved for removal. CZMC finds that insufficient information is available to make a determination of consistency without detailed erosion control plans and a detailed planting plan. In addition, CZMC requests that the matter be adjourned until the applicant can present completed plans for all of the proposed site work so that CZMC can adequately assess the cumulative impacts of the project on the wetland buffer zone. It is possible that the new construction could require a wetlands permit if drainage systems and trenching are required within the buffer zone. The existing vegetation, although invasive, could be beneficial as an erosion control measure to prevent sediment disturbed during construction from reaching the Sheldrake River. CZMC suggested that the applicant proceed with necessary property maintenance as permitted by the Town Wetlands and Watercourses Law. This is interpreted by CZMC to include the removal of dead or diseased vegetation and the pruning and cutting of invasive plants Page 2 of 3 and vines in order to get a better understanding of the underlying conditions without the removal of the plants themselves. Since Town Code does not require site plan review for the construction of single- family homes (unless they are part of a staged development), CZMC also recommends that the site plan code be reviewed by the Planning Board and Town Board to consider an amendment that requires site plan review for"Tear Downs." 3. Old Business: a. Gap Analysis—Town of Mamaroneck Surface Water, Erosion & Sediment Control Law The Gap Analysis has been completed for the Erosion and Sediment Control Law and needs to be entered on the DEC forms in the Analysis workbook. 4. New Business: a. Flint Park Turf Field Update Anne McAndrews presented preliminary plans for the new artificial turf field proposed for Flint Park. The field, paid for using Legacy Grant funds, will be located in the area of the park occupied by the existing picnic area and tennis courts behind the Veteran's Hall and will require the use of some Town-owned land. Some tree removals will be required and the feral cat houses would need to be removed or relocated. The field as proposed will be fenced in to protect the field when not in use and no lighting will be permitted. © A letter will be sent to Larchmont Village Board with the following comments: • Local consistency review will be required for the project because of the designation of the site as a Critical Environmental Area. • Alternate, and if possible shared sites for the leaf-composting area should be considered by both the Town and the Village. Would it be possible to relocate the leaf area to the newly expanded parking area in front of the Veteran's hall? The leaf area closer to the shore could then be incorporated into the conservation area. • CZMC requests that the environmental area improvements proceed in a timely manner and not be delayed by the design and construction of this new field. • Fencing in the new field will prevent public access to pre-existing open space when league play is not scheduled and should be eliminated. • CZMC would like to review the information surrounding the benefits of the use of artificial turf as opposed to real turf. The next scheduled CZMC meeting will be held on February 27, 2007 at the Mamaroneck Town Center, 740 W. Boston Post Road, 2" Floor Conference Room A.
