February 26,2002
A regular meeting of the Coastal Zone Management Commission(CZMC) was held on February
26, 2002 in Conference Room A, Town Center, 740 West Boston Post Road, Mamaroneck,New
York. The meeting was called to order at 8:10 p.m.

1. Approval of Minutes
The minutes for January 22, 2002 were reviewed and accepted as corrected.
2. Referrals
a. Special Use Permit—Auto Detailing and Accessories at
626 Fifth Avenue—Block 132, Lot 61
Referred by the Town of Mamaroneck Planning Board
The applicant, Anthony Sgarlata presented his proposal to open an auto detailing and
accessory business. He explained that the proposed business would be limited to the
detailing of cars. He will not be washing any cars on the premises. In addition, there
will be no repair work, bodywork or painting of cars. The services he is proposing

would include window-tinting,pin striping, cleaning of car interiors and the sale of
car accessories.
All work will be performed inside the garage. No work will be performed in the
parking area outdoors. A floor drain in the floor of the garage is believed by the
Applicant to be connected to the sanitary sewer systems A catch basin located on
Fifth Avenue feeds into the storm drain system. The cleansers the Applicant is
proposing to use are similar in nature to dishwashing soap or laundry detergent. The
material safety data sheets were provided for the solvents and thinners he is
proposing to use. The solvent is water and alcohol based. He will not be using any
degreasers and will not be cleaning engines. A self-contained machine will be used
to shampoo car interiors. He will not be using any sprays—the window tinting is
done using a self-adhesive film that is applied.
CZMC finds that the proposed action is not inconsistent with the policies set forth in
the LWRP. It is suggested that the applicant hire a licensed plumber to confirm that
the garage floor drain is properly connected to the sanitary sewer system. In addition,
this drain should be routinely maintained and kept free of silt, grit and any oils that
may accumulate. CZMC recommends and the applicant agreed that the Special Use
Permit should prohibit engine cleaning and bulk storage of hazardous substances as a
condition of the permit.
b. Freshwater Wetlands and Watercourses Permit for the Construction of a
Retaining Wall,Re-grading and Construction of a Deck at
87 Rockland Avenue -Block 210, Lot 328
Referred by the Town of Mamaroneck Planning Board
Benedict Salanitro,the Applicant's Civil Engineer,presented the proposed project.
The project involves the re-grading of the rear yard, the relocation of the river wall
and the construction of an addition to the existing deck. Photographs were used to
describe the existing conditions at the site.
The proposed retaining wall will be constructed by hand, inland of the current
retaining wall, and will be made of stone. A vinyl fence will be erected on top of the
new wall once it is completed. The old wall will be removed and any stone that
remains underwater will be left in place. Soil located between the two walls will be
removed and used to re-grade the yard, along with clean fill. Approximately 275 to
300 cubic yards of fill will be required to re-grade the yard. The sections of the
original wall on the property that are not involved with the re-grading will be
repaired.
The existing slate patio will be removed(decreasing the amount of impervious
surface). As a result of the re-grading and change in location of the retaining wall,
the width of the Sheldrake River will be increased, adding to the capacity of the river.

No trees will be removed to complete the work. A cheek wall may be used to protect
one tree located in the rear yard.
The environmental assessment form that was submitted indicated that the proposed
project was contiguous to a state or national historic place. Mr. Salanitro explained
that he had thought that the Leatherstocking Trail conservation area was a historical
site and was not correct. In addition, he had thought that the Sheldrake River was
considered a critical environmental area and it is not.
In order to mitigate any potential impacts on the Sheldrake River, the applicant is
proposing to leave the existing wall intact until the new wall is constructed, establish
the new grade in the yard and then remove the old wall by hand. Materials will be
moved using wheelbarrows, a bobcat or small buggies. The river bottom will be
allowed to naturally reestablish itself with time. The applicant has agreed to the use
of sod instead of hydro-seeding to more quickly reestablish vegetation and to
stabilize the soil after the grading work is completed. This is also preferable due to
the potential water restrictions resulting from the current drought.
The proposed addition to the deck will be approximately 40 square feet. The deck
will be pervious to runoff and gravel will be placed beneath the deck where grass
will not grow. A lattice enclosure will be used to match the existing deck enclosure.
CZMC finds that the proposed action is consistent with the policies set forth in the
LWRP. It is recommended that appropriate erosion and sediment controls be utilized
throughout the construction phase of the project to minimize erosion. CZMC
suggests that the amount of the completion bond be sufficient to guarantee that the
construction debris in the Sheldrake River related to the new retaining wall is
removed by the applicant.
3. Revised Wetlands and Watercourses Protection Law
The latest revision of the Wetlands and Watercourses Protection Law was distributed to
CZMC. This version includes comments from a joint work session of the Town of
Mamaroneck and the Village of Larchmont. Because the Village has been working on
revising their zoning law it has not focused attention on the Wetlands Law and has advised
CZMC that it does not intend to amend its law at this time. CZMC will, however provide its
suggested revision to the Town for adoption. Judy Gallent has already reviewed the revised
law. Once the newly appointed members of CZMC have had an opportunity to review and
comment on the draft, it will be given to Supervisor O'Keeffe and the Town Board.
Depending on the nature of the comments received, CZMC may invite Stephan Coleman, its
wetlands consultant who drafted the law, to the next CZMC meeting.

4. Point Road Access to Long Island Sound
Dixon Brown presented the history of this property dispute to continue a discussion begun at
a previous meeting. The parcel belongs to the Village of Larchmont. It is located near the
end of Pryer Lane and can be accessed through a driveway about half way down Pryer Lane.
The parcel appears to allow public access to Premium Mill Pond and Long Island Sound.
However, although the Village owns the property,which contains a right of way known as
Point Road there is a negative easement on the property which grants the adjacent landowners
access to Point Road but forbids the Village from granting access to others. The Village at
one time applied to the court for permission to make Point Road a public road, but its
application was denied and the decision was never appealed. The time allowed for an appeal
of the decision has since expired. One way for the Village to open the parcel to the public
would be to condemn the easement and pay the adjacent property owners for the taking.
5. Old Business
Copies of the Village of Larchmont 2020 Master Plan were distributed to CZMC. This
document has been received by the Village Trustees but has not been adopted or accepted.
Access to Long Island Sound is one of the issues addressed in the report. Also included are
the restoration of wetlands and the need to create additional playing fields in the community.
Lindlesy Place, located behind Flint Park is mentioned as a potential point of access for the
public to Long Island Sound.
Phyllis Wittner called the NYS Department of State to ask a representative to give a
presentation at a joint meeting of the Town of Mamaroneck/Village of Larchmont CZMC and
the Village of Mamaroneck CZMC. Lee York, of the Department of State contacted
Madelaine Berg to say that DOS would be happy to meet with the groups. Madelaine will
contact the Chair of the Village of Mamaroneck CZMC to set up a mutually convenient date
in the next few months.
It was noted that a retaining wall at the intersection of Boston Post Road and Purchase Street
in Rye was constructed of the pressed concrete method of construction that was proposed for
the hip wall at One Cedar Island. It looks very good and it is difficult to tell that it is not
really stone. It was suggested that CZMC members should drive by and look at it since this
type of wall may come before the commission again.
6. New Business
A preliminary site inspection will be held at 1 Bay Avenue between 8:30 and 8:45 on Friday,
March 1st. Dan Natchez will be at the site to explain the proposal for the installation of a
floating dock,the construction of a gazebo and the construction of an addition to the house.
The application will be on next month's agenda.
Bill Urmay contacted Howard McMichael this week with concerns about a neighbor's
proposal to install a ramp and boat dock at 11 Bishop Place. The New York State
Department of Environmental Conservation is currently reviewing this application. Elizabeth

Paul was asked to make sure that the Department of State was aware of the application and to
request that it be referred to CZMC.
The meeting was adjourned at 9:40 p.m.
