CZMC Minutes
February 22, 2005
A regular meeting of the Coastal Zone Management Commission(CZMC)was held on February
22, 2005 in the Mamaroneck Town Center, Conference Room A, 2nd Floor, 740 W. Boston Post
Road, Mamaroneck, New York. The meeting was called to order at 8:00 p.m.

1. Approval of Minutes
Since a quorum was not present, approval of the minutes for January 25, 2005 were tabled
until the next meeting.
2. Referrals:
a. Tree Removal/Building Permit—Roderick Williams—74 Lansdowne Drive- Block
218, Lot 658
Referred by the Town of Mamaroneck Town Board and the Director of Building
The applicant, Mr. Williams did not submit revised plans in time for the meeting. A
discussion of this application has been adjourned until next month.
3. Old Business
a. Wetlands and Watercourses Permit—Marc Contracting—33 Marbourne Drive—
Block 334, Lot 23
The Town of Mamaroneck Planning Board requested clarification of the consistency
letter sent to them by CZMC on January 27, 2005. The letter states that the proposed
action would create significant adverse impacts to the wetland buffer and potentially to
the wetland and watercourse. The Planning Board asked CZMC to specify what those
impacts would be. A letter will be written to them addressing the impacts associated with
the loss of wetlands buffers.

4. New Business •
CZMC discussed the Town's Tree Permit review process,the Waterfront Revitalization Law
and the Environmental Quality Review Law. This discussion will be continued at the next
meeting when more members are present.
a. Tree Permit Review
Applications for the removal of non-hazardous trees will be referred to CZMC for review
because this activity is considered an unlisted action under the Town's Environmental
Quality Review Act. It was noted that if the application for 74 Landsdowne Drive did not
involve the removal of trees, the proposal would not have required CZMC review.
Applications for projects that involve the importation of a significant amount of fill
should be reviewed by CZMC.
b. Waterfront Revitalization Law
The Town's Waterfront Revitalization Law requires applicants to submit a Coastal
Assessment Form. Elizabeth Paul,the Town's Environmental Coordinator is requesting
that CZMC review whether this form is duplicative and unnecessary because applicants
are required to prepare an Environmental Assessment Form.
c. Environmental Quality Review Law
Judith Gallent, the attorney for the Town of Mamaroneck Planning Board requested that
CZMC review the Town's Environmental Quality Review Law(MEQR). Section 92-3
currently states:
"The procedures of 6 NYCRR 617.4 shall be amended in that the last sentence of
617.4(h) shall state: "Any unlisted action located partly or wholly inside or
substantially contiguous to a CEA must be treated as a Type I action by an
involved agency.'
This section is no longer valid because Section 617.4(h) of SEQR was eliminated when
SEQR was amended in 1995. If the Town-:.could like to require aii unlisted act uns in or
contiguous to a CEA to be treated as a Type I action, an amendment to MEQR will be
required.
The meeting was adjourned at 8:45 p.m.
The next scheduled CZMC meeting will be held on March 22, 2004 at the Mamaroneck
Town Center, 740 West Boston Post Road,2"d Floor, Conference Room A. Anyone unable
