1. Approval of Minutes
The minutes of July 22, 2003 were approved as amended.
2. Referrals
a. Site Plan Approval for the Construction of a Bank& Drug Store—Melron
Amusement Corp.—1265 Boston Post Road,Block 412,Lot 449
Referred by the Town of Mamaroneck Planning Board
The applicant, Ron Getland of Melron Amusement Corp., presented the proposal for the
demolition of the existing building and construction of bank and drug store. CZMC

found the proposed action to be consistent with the policies set forth in the LWRP.
However, CZMC objected to the use of a drywell overflow that would be directly
connected to the storm sewer system. Drywells require maintenance and eventually •
become clogged with sediment over time. Eventually,the performance of the drywells
would diminish and stormwater would be directed to the storm sewer system and could
continue to be discharged to the storm sewer system indefinitely. The overflow would
not be needed if the stormwater drainage and drywell system were adequately designed,
maintained, and replaced, as warranted.
In addition, the applicant indicated that the project would be exempt from requiring
coverage under the New York State Phase II stormwater general permit for construction
activities greater than 1 acre. The applicant expressed that the disturbed area as part of
construction would be less than one acre, and as a result, the New York State
Department of Conservation(NYSDEC) indicated that the project would be exempt
from the Phase II stormwater requirements. CZMC may disagree on this matter as all or
nearly all of the site would be disturbed in some fashion included areas subject to
excavation, stockpiling, landscaping, removal of pavement, and all other areas where the
surface is disturbed or sediment is deposited. The Phase II stormwater requirements
would include filing a Notice of Intent(NOI) under the general permit and preparation of
a Stormwater Pollution Prevention Plan(SWPPP). The incremental costs for
implementing the Phase II stormwater requirements would not be significant relative to
the total costs for the project. While the measures implemented would be comparable to
those required under the Town's erosion and sediment control ordinance, the self-
monitoring and reporting requirements are far more stringent. Filing of an NOI and •
developing an SWPPP forces developers and contractors to take the erosion and
sediment control requirements far more seriously. Consequently, CZMC recommended
that the Town consult both with the Town's Engineer and/or NYSDEC, as appropriate,
to determine whether the Phase II stormwater requirements should be implemented for
this project.
b. Site Plan Approval for Subdivision of Lot& Construction of Single Family Home—
48 Monroe Avenue—Block 705,Lot 294

The applicant, John& Reneta Donaghy, has applied for site plan approval for
subdivision of the lot& construction of a single family home. CZMC finds the proposal
to be consisting with the policies set forth in the LWRP provided that the applicant
installs and maintains appropriate erosion and sediment control devices throughout
construction, and stormwater management systems, as necessary, to ensure a no net
increase in post-construction runoff from the project site.
3. Old Business
a. Flint Park Update
It was noted that the erosion and sediment controls at the SSO project site were no longer
in place and sediment is now entering the creek. The construction manager/contractor •

and the Westchester County Department of Environment Facilities and Department of
Public Works would be asked to correct this. CZMC forwarded a letter to the Village
documenting the issues associated with the project site.
Revised plans for modifications to the park have been submitted to the Village. Marc
Godick was given an opportunity to review the revised plan with Mayor Ken Bialo. The
revised plan appeared to addresses many of the concerns raised in a letter forwarded to
the Village in February 2003. A copy of the plan will be obtained for the next CZMC
meetings to solicit comments from all of the members of the commission.
b. Open Space Inventory
Kate Dehais forwarded the updated inventory to Marc Godick. An executive summary
and filling minor data gaps need to be completed prior to forwarding to the final versions
to the Town and Village. This work should be completed in September or October 2003.
5. New Business
There was a discussion regarding holding meetings in the Village. It was agreed that the
location of future CZMC meetings would alternate between the Village and the Town.
The next meeting in September 2003 would be held in the Village.
The meeting was adjourned at 9:30 p.m.
The next scheduled CZMC meeting will be held on September 23, 2003 at the Larchmont
Village Hall Conference Room—2"tl Floor. Anyone unable to attend this meeting should
