Present: Supervisor Burton Justices Boyd, Collins, Howell and Leeds Town Clerk Sherman Counsellor Gamble Upon motion, it was voted to dispense with the reading of the minutes of meetings not yet approved. The Clerk stated that pursuant to notice duly advertised the Board should now consider the various applications and plans for building permits which had been denied as being in violation of the Zoning Ordinance , At this time the following applications were withdrawn: ', 1. Application of Harimo Corporation for the erection of a one car garage on the west side of Alden Road, about 150 feet south of Kenmare Road, within 75 feet of the front lot line 2. Application of Harimo Corporation for the erection of a one car garage on the west side of Alden Road, about 150 feet south of Kenmare Road, within 75 feet of the front lot line. ' 3. Application of Merard Holding Company, Inc . , for the -- erection of a one family dwelling and garage on the east side of Cherry Street, approximately 150 feet from Stonyside Drive, with-', in 6 feet of the side lot line. - After reading of the notice as advertised:, and after discussing and considering the various applications and plans for building permits before the Board, it was upon motion, duly seconded, unanimously , RESOLVED, Whereas, the Town Board of the Town of Mamaroneck has duly advertised pursuant to law, a public meeting for the purpose of considering certain applications therein stated, made under the Zoning Ordin® anoe of the unincorporated part of the Town of Mamaroneck, which applications are now pending, and WHEREAS, the said Town Bard having held said hearing and both parties having been garnated the privilege of appearing for or in opposition to the granting of certain -- applications as provided under the said Zoning Ordinance and after due consider ation, therefore, be it RESOLVED, THAT the Town Board of the Town of Mamaroneck, sitting jointly as a Bard of Appeals and as a Town Board does hereby grant the following applications from the decision of the Building Commission, which decision is hereby reversed and does hereby consent to the granting of the following applications subject in each case to the specific conditions and safeguards therein stated: 3 1. Application of Merard Holding Company, Inc, for the erection of a one family dwelling on the northeast corner of Stonyside Drive & Greystone Road, provided the building is erected not less than 24 feet from the front lot line on Stony- side Drive. 2. Application of Karl Feidig for the erection of a one family dwelling and garage on the west side of Dean Place, provided that the building is erected not less than 20 feet from the front lot line. 3. Application of R. E. Cullen for the erection of a one family dwelling and garage on the southeast corner of Rockland Avenue and Stonyside Drive, provided that the building is erected not less than 24 feet from the front lot line on Stonyside Drive and further provided that the level of the cellar floor and garage floor will be regulated to meet with the requirements of the Building Commission. Mr. Marcus, representing Spanish Gardens, appeared before the Board and asked consent to erect signs in the Town of Mamaroneck directing people to the Spanish Gardens Develop- ment . After discussion, Mr. Marcus withdrew his application. A delegation of Taxi Drivers in the Town of Mama- roneck appeared before the Board in regard to the present sit- uation at the New Haven station and asked the Town Board to take some action, if possible, to obtain a location for them for a taxi stand and asked that they be licensed to drive within the Town of Mamaroneck. Upon motion, duly seconded, the entire matter was referred to the Board of Police Commissioners to look into the situation and report back to the Board with their recommendations . Justice Leeds, on behalf of the Committee on Police, reported that the Committee had investigated the matter of the installation of cells in said Police Headquarters and had a plan and specifications prepared and had gotten an informal bid thereon, and recommended that the Town Board immediately obtain bids for this work. Upon motion, duly seconded, it was RESOLVED, that Counsel be and he hereby is authorized and empowered to immediately prepare a notice to bidders for the receipt of bids by the Town Board of necessary cells for the police headquarters in accordance with the plan and specifications prepared by said Committee, together with any other necessary documents in connection therewith. Further RESOLVED, that the Committee on Police be and it heaeby is authorized and empowered to fix the date of the receipt of bids and arrange for the proper advertising therefor. Mr. Farrell appeared before the Board in connection with the proposed plan for severing Dillon Park pursuant to the action taken by the Board at its last meeting. Mr. Sherman, on behalf of the Committee heretofore appointed to look into, report and recommend a plan for the sewage system in Sewer District No . 2, and the contiguous territory thereto, which Committee consisted of Justice Leeds, Clerk Sherman and Mr. Robert Stevens, Chairman of the Board of Sewer Commissioners, Sewer District No. 1 presented a written report of the Committee, including two reports by Mr. A. C. Foote, C. E., which report recommended that the district now included in Sewer District No. B, be,_,annexedi. to and mdde' a"-part of Sewer District No. 1, together with the territory between the present northerly boundary line of Sewer District No . 2, and the southerly line of Sewer District No . 1, directly =fir north thereof, and that property in the Town of Mamaroneck be- tween the present southerly boundary line of Seger District No . 2, and Long Idland Sound, to®wit: the development known as Preyer manor. Mr. Sherman reported on behalf of the Committee that in their opinion the cat of the sewer system would be consider- ably less to the residents of this section, both from enlarge- ment of the territory and by consolidations with Sewer District No . 1. Mr. Farrell discussed the matter with the Bcd. After discussion, upon motion, duly seconded, it was RESOLVED, that counsel be and he hereby is authorized and directed to prepare a new petition to include the district as outlined it the report of the Committee and annex the same to Sewer District No. 1. Further RESOLVED, that the ?Committee proceed to have the necessary maps of the new proposed extension immediately made so that said petition may be prepared. Further RESOLVED, that counsel submit the petition upon the completion thereof to Mr. Farrell, so that signatures there- on could be obtained. Further RESOLVED, that counsel take such other steps as might be necessary in connection v<ith the annexing of the proposed extensions of said territory to Sewer District No . 1 and the rescinding of action heretofore taken in connection with the establishment of Sewer District Nog 2. Counsel advised the Board that Sewer Commissioners of Sewer District No . 1 of the Town of Mamaroneck had obtained bids in connection with the construction of Contract No . 14 and requested the Town Bard to authorize the issuance and sale from time to time of Certificates of Indebtedness; in the sum of $175,000, which the Sewer Commissioners had advised would be the approximate cost of the construction of said contract, as prepared, in accordance with the law. After discussion, upon motion, duly seconded, it was RESOLVED, WHEREAS, the Board of Sewer Commissioners have estimated and reported to this Board the estimated cost of construction of Contract No . 14, determined as required by law; and WHEREAS, pursuant to law the Town Bwd shall cause Certificates of Indebtedness to be issued, the same to be a Town charge, the proceeds of#hich Certificates shall be applied in payment of the cost of construction of said part or portion of such Sewer Dttrict as is so requested by said Sewer Commissioners; . Therefore, be it RESOLVED, that the Supervisor be and he hereby is authorized and empowered in accordance with the law, to borrow upon the faith and credit of the Town of Mamaroneck the sum of not to exceed $175,000, and to issue a temporary Certificate or Certificates of Indebted- ness in amount of not to exceed A $175,000, which shall bear interest at a rate of not to exceed six per cent per annum; payable at such time or times as the Supervisor may fis, not, exceeding, however, eighteen months from the date hereof, and to sell or dispose of said Certificate or Certificates of Indebtedness for not less than the par value thereof; and further RESOLVED, that said Certificate or Certificates of Indebtedness shall be in substantially the following form: UNITED STATES OF AMERICA STATE OF NEW YORK COUNTY OF WESTCHEESTER TOWN OF MAMARONECK Certificate of Indebtedness Issued Pursuant to Section 237 of the Town Law of the State of New York, for Sewer District No= 1 of the Town of Mamaroneck, No. Amt. The Town of Mamaroneck in the County of Westchester, a Municipal Corporation of the State of New York, hereby acknowledges it is indebted and for value received promises to pay to the sum of lawful money of the United States of America, with interest thereon at the rate of per cent per annum'j on or before at This Certificate of Indebtedness is one of an issue of $1755,000, issued pursuant to the provisions of the Town Law constituting Chapter 62 of the Consolidated Laws of the State of New York, and a resolution of the Town Board of the Town of Mamaroneck duly adopted August 55th, 1927- It is hereby certified and recited that all conditions, ', acts and things required by the constitution and statutes of the State of New York to exist, to have happened, and to be performed', precedent to and in the issuance of this Certificate of Ind"ebted® ', ness exist, have happened and have been performed, and that the issue of Certificates of indebtedness, of which this is one, to- gether with all other indebtedness, of said Town of Mamaroneck is within their debt and other limits prescribed by the constitution', and laws of said State. IN WITNESS WHEREOF, the Town of Mamaroneck, through its Town Board, has caused this Certificate of Indebtedness to be signed by its Supervisor and the corporate seal of said Town to be hereunto affixed and attested by its Town Clerk, and this Certificate of Indebtedness to be dated the day of - 1927- — ATTEST: Supervisor Town Clerk Further 4e REWSOLVE1°, that the Town of Mamaroneck hereby covenants to pay the principal and interest of said certificates or certificate of Indebtedness in the amount hereinabove provided as the same shall be- come due, by levying assessments on property of Seder District No. 1, of the Town of Mamaroneck at such time or times and in such amounts as may be necessary thereof. The Town of Mamaroneck further COVENANTS that in case of a default in carrying out the foregoing covenant, the said Town will raise by taxing all taxable property in said Town of Mamaroneck from time to time the sum or sums sufficient to pay the principal and interest of said certificate or certificates of indebtedness as the same shall become due .
