In the absence of the Supervisor, the meeting was called to order by Justice Boyd at 9 P.M. PRESENT: Justices Boyd,Colllns ,Howell, Leeds Town Clerk S: he-rman Counsellor Gamble Upon motion duly seconded it was voted to dispense with the reading of the minutes of meetings not yet approved. The Clerk stated that the meeting was called pursuant to notice duly advertised to consider applications for building permits which had been denied by the Building Commission as being in violation of the Zoning Ordinance . After considering and discussing in full the various applications and plans for building permits , before the Board and at which time fair. A. H. Stevens , representing the Chats- worth dissociation and MT. H. M. Williams appeared inogiaosition to the granting of the application No. 872 of Luigi G. Leone for the erection of a business dwelling on the Crest side of Murray Avenue it was upon motion duly seconded. unanimously RESOLVED, whereas the Town. Board of the Town of "Mamaroneck as duly advertised pursuant to law a Public Meeting for the purpose of considering certain appli- cations therein stated made under the Zoning Ordinance of the unincorporated _part of the Town of Tb amaro.nack, which applications are now pending, and vl emu; S the said Town Board having held said Hearing and those parties appearing for and in opposition to the granting of said applications as provided under said Zoning Ordinance and after due considera- tion, therefore be it RESOLVED that the Torun Board of the Torun of Mamaroneck sitting jointly as a Board Of Appeals and as a Town Board do and hereby does grant the followinE applications from the decision of the Building Commiss- ion, which decision is herein reversed and does hereby consent to the granting of the following respective applications subject in each respective case t.o the specific conditions and safe guards therein stated, to wit : L.�' JL 1. Application #874 of Tiichael Doherty for the erection of a 9 car private garage on the south side of the Boston Post Road corner of Dillon Road within an unclassified district. 2. Application -;'T892 of James P. Fennelly for the erection of a service station on the south side of the Boston Post Road between near_ Place and Dillon Road wit in an unclassified district, provided said service station is erected not less than 10 feet from the front lot line. 3. kpplication ;`877 of Barbara B. S"chrasaei: for the erection of 'a one family d-welling and. garage on the south- •crest corner of Fernwood Road and Clover Street, provided that the said building is erected w ithin 20 feet of Clover Street, And be it further RESOZ , that the following applications be denied, to wit: L2111ic tion ,-' 872 of Luigi Leone for the erection of a one story business dwelling on the crest side of Tviurray Avenue within a residential district, and be it further RESOLU ', that the following applications be and the same hereby are laid over for further consideration, to wit : Ap_alica.tion X848 of Nicholas L. Leone for the erection of a one family dwelling on the southwest corner of West Brookside Drive and Fernwood Road within 30 feet of � Fernv7cod Road, and be it further R :SOLT]:D, that the Town C 1 erk be and he hereby is authorized and directed to certify the action of this Tovan Board to the Building Commission. The EIlerk also presented the application of John C. Broomell to erect a one family dvaelling on the north- east corner of 'dgewater Place and Dillon Road within 30 feet of both street lines. The application was referred to the Building Co;=ission. The Corraittee on F ire matters reported that they dad gone into full detail on the question of the condition -- of the apparatus floor and submitted various letters and tests of certain engineers and after a full discussion of the entire matter the Committee recommended that the Toan Board appoint a competent engineer for the purpose of deciding the course to be taken in the altering of the apparatus floor. Upon the recommendation of the Co=ittee it Was informally agreed that the Committee be authorized and empowered to secure a competent engineer or Board of engineers for the purpose of ascertaining the true condition of the apparatus floor. Counsel discussed with the B card the request of the Board of Sewer Commissioners of Sewer District No . 1 of the Town of Mamaroneck to issue and offer for sale 0150,000 principal amount of Sewer Bonds for the con- struction of Contract No. 11 and additions to the enlargement of the Sewage Disposal Plant. Counsel stated that under the provisions of Chapter 470 of the Laws of 1926, i. e. General District Law, an Act in relation to the creation, financing and actiVitieac of certain public districts, it was now necessary for the Town Board to give notice of the filing of the petition of the Board of Sewer Commissioners, the request for the issuance of bonds and to hold a Public Hearing thereon prior to taking action on the petition, which notice must contain a description of the district. He further stated that the law provided for the posting and publishing of said notice in specific manner and recommended that a date be fixed for said Public Hearing and he be authorized to draft the necessary notice in accordance with the law, I Upon motion duly seconded, it was RESOLVED, that the Town Board hold a Public Hearing on December 15, 1926 at 8.30 F.11- -- at the office of the Town Clerk, 8 Elm Street, Mamaroneck, New York to We action upon the petition of the Board of Sewer Commissioners of Sewer District No. 1 requesting the Town Board to issue and sell j502000 principal amount of Sewer Bonds for the construction of Gontxact l;o. 11 and for additions to enlargement of the Sewage Disposal Plant within said Sewer District at which Hearing full opportunity to be heard shall be granted to all interested persons, and it was FURTHER RES0171y that Counsel be and he hereby is authorized and directed to prepare the proper notice of said Hearing, and it was FURTHER RESOLVE that the Toxin Clerk be and he hereby is authorized to post and publish said notice in accordance with the law as he may be advised by Counsel , and it was FURTHSR RESOL VED that said notice be published in The Daily Times which is hereby designated the official newspaper of said Town for the purpose of such publication.
