HomeMy WebLinkAbout1926_10_05 Town Board Minutes rh -L kJ XTETING OF THE TOOT BOARD TOW OF MAMARONECK held October 5,1926 The meeting was called to order by Supervisor Burton at 10.30 P.M. PRESENT: Supervisor Burton Justices Boyd, Collins,Howell,Leeds Town Clerk Sherman Counsellor Gamble. Upon motion it was voted to dispense with the reading of minutes of meetings not yet approved. The Clerk stated that the first order of business was the consideration of applications for building permits filed with the Building Commission which applications had been denied by the said Commission as being in violation of the Zoning Ordinance and appeals having been taken from its decision to the Sown Board, notices for same having been duly advertised, after due consideration and discussion of the various applications, the following resolution was presented and upon Roll Call unanimously adopted WHMWAS the Town Board of the Town of Mamaroneck has duly advertised, pursuant to law, a Public Meeting for the purpose of cnnsidering certain applications therein stated made under the Zoning Ordinance of the Unincorporated Part of the Town of Mamaroneck, which applications are now — pending, and SAS the said Town Board having held said hearing and those parties appearing for and/or in opposition to the granting of said applications as provided in said Zoning Ordinance have been heard, and WHEREAS application No. 858 of Alden House Inc, is one of the aforesaidapplieations, and WHEREAS due consideration has been given said application, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Mamaroneck, sitting jointly as a Board of Appeals and as a Town Board, do and hereby does grant application No. 85a of Alden House Inc. to erect a six story elevator apartment on thenorth side of the Boston= Post Road and the east side of Alden Road and the south side of Copley Road in an Unclassified District and the decision of the Building Commission be and hereby is reversed, subject to and upon the following specific terms, conditions, lim1ations and safeguards, to wit: 1. That the building is a six story and basement elevator apartment with four one story stores andprivate garage connected thereto on the Boston Post Road side. 2. That the building be erected as shown by the plot plan submitted to this meeting (and marked as an Exhibit and filed ) upon Lots Nos. 78, 79980081082, 83084,85, 86987 as shown on a certain map entitled "Subdivision of Property of Harimo Corporation, Westchester County, New York",John F. Fairchild, C.E. , Mount Vernon,New York, dated April 300 1923. 3. That the building be built substantially in accordance with the Plans and Specifications by George Keister, Architect, submitted to this meeting(and marked as Exhibit and filed ), subject however to such changes, modifications and/or alterations and additions as may be required by the Building Commission so that said building may comply in all respects, with the Zoning Ordinance as to Use, Area and Height Districts C, and with the Building Ordinanceand all other Ordinances of the Town of Mamaroneck. 4. That the following minimum set back requirements are maintained: on the east 26 feet from the easterly side of LotNo. 78 and 87; onthe north 32 feet from the southerly side of Copley Road; on the west 22®6" from the easterly side of Alden Road and on the south 10 1from the northerly side of the Boston Post Road. 5. That said garage be restricted to a private garage to be used only for the tenants of the apartment house and shall not at any time now or hereafter be used as a general garage or for public use, AND BE IT FURTHER RESOLVED that the Town Board pursuant to Article 5, section 26 of the Zoning Ordinance of the Town of Mamaroneck, subject to the terms, conditions and limitations hereinabove provided and contained, consents to the granting of the aforesaid application, IT WAS FURTHER RESOLVED that the Town Clerk be and he hereby is authorized and empowered to certify a copy of these resolutions and file the same with the Building Commission., and the Building Commission is authorized and directed to issue a permit as herein- above provided. Upon motion duly seconded, it was RESOLVED that Application No. 848 of Nicolas Leone for the erection of a one family dwelling at the southwest corner of West Brookside Drive and Fernwood Road be laid over. Mr. Alexander Meffert appeared before the Board and requested that the action of the Town Board in granting permission for the erection of a garage and showroom on the south side of the Boston Post Road,Dillon Park be rescinded. Upon motion duly seconded, it was RESOLVED thatthe action of the Town Board duly adopted September 25,1926 on Appli- cation No. 856 of Alexander Meffert for l the erection of a garage and showroom on the south side of the Boston Post Road Dillon Park, provided said building is erected 10 _feet from the street line be and the same hereby is rescinded. Upon motion the meeting adjourned at 11.45 P.M. Town clerk
