HomeMy WebLinkAbout1926_08_10 Town Board Minutes Y^9 SPECIAL MEETING OF THE TOWN BOARD TOWN OF MAMARONECK, held August 10, 1926. The meeting was called to order by Supervisor Burton at 8.30 P.M, PRESENT: Supervisor Burton Juatices Collins, Leeds,Howell Town Clerk Sherman Counsellor Gamble. The Supervisor stated that this meeting had been called in accordance with a resolution of the Town Board duly adopted at a meeting held on August 4, 1926. The Clerk read the notice of the Hearing and stated that the same had been duly published in the issue of the Larchmont Times on August 5th, 1926, and in the issue of the Daily Times of August 5th, 7th. and 9th 1926, and presented affidavits of publication thereof. Upon motion duly seconded, it was RESOLVED, that the call and notice of the meeting and the report of the Clerk that the same had been duly published be and the same hereby are in all respects approved and it was further RESOLVED, that the affidavits of the publi- eation of the aforesaid notice be filed. The Supervisor stated that in accordance with the Notice, the meeting had been duly called in accordance with the Law and particularly pursuant to the provisions of Section 26 of the Transportation Corporations Law ofthe State of New York to consider the application of the County Transportation Company, Inc. for consent to operate buses within the Town of Mamaroneck as set forth in the notice and he stated that the Town Board would now hear all persons interested in the said application with respect thereto. The Supervisor stated that the Board would first hear any persons interested in opposition to the granting of the franchise, if any were present. Mr. Seholle, Trustee of the Village of Mamaroneck, was present and advised the Board that he, representing the Village of Mamaroneck, had had several conferences with the representative of the ThirdAvenue Railroad who are now seeking a franchise or franchises in this locality through their purchase of assets at Receiver' s sale of the Westchester Street Railroad Company bht that as said Company was not yet in a position to make a formal proposition, he asked the Town Board to cooperate with the Village of Mamaroneck in so far as deferring action on the consent to the application of the County Transportation Company, Inc. for a period of two weeks, in order to give the Third Avenue Railroad officials an opportunity to present an application to the Town Board with a comprehensive plan and proposition. Mr. Davidson, Counsel of the Third Avenue Railroad then addressed the Board and stated on behalf of said Railroad that it was studying the present transit problem as it affected the interests of the Town of Mamaroneck and requested an adjournment so that his Company might have an opportunity to be heard. The following gentlemen addressed the Board in opposition to the granting of the consent at this time; Mr. William E.Lyon,dr. , of Mamaroneck, Mr. Stephen T.Stilwell, Mamaroneck Chamber of Commerce. There being no further persons present who desired to address the Board in opposition to the application, the Supervisor called upon anyone present who desired to speak in favor of the granting of said application. Mr. Buell, Counsel for the County Transportation Company, Ine. then addressed the Board and requested that favorable action be taken upon the application and that the same be granted. The Supervisor stated that the Town Board at all times had desired to cooperate with the Village of Mamaroneck and the surrounding municipalities and had always sought t}3e cooperation of said municipalities and wished only to work out a plan which was comprehensive and for the best interests of all in the community so that they might all have the benefit of the best transportation facilities availalie. He asked Mr. Davidson if his Company would be able to present its proposition within two weeks. Mr.Davidson advised that he believed it would. After discussion it was upon motion duly seconded, RESOLVED, that this Public Hearing to consider the application of the County Transportation Company, Inc, for consent to operate buses within the Town of Mamaroneck be and the same hereby is adjourned to August 24th, 1926, at the same hour and place; and it was further RESOLVED, that the Clerk give notice of said adjourned date by notice in such form as may be prepared by Counsel and to be published in the Daily Times of August 16th and 23rd, 1926, Upon motion, the meeting adjourned at 11.00 P.M. n Town Clerk.
