HomeMy WebLinkAbout1926_05_08 Town Board Minutes (2) 3 MEETING OF THE TOWY BOARD TOWN OF u'IAMARONE IK held May 8, 1925. The sheeting was celled to order by Supervisor Burton at 10.30 A .M. PRESENT: Supervisor Burton Justices Boyd, Collins,Howell & Leeds Town ClerR Sherman. Upon motion it was voted to dispense with the reading of minutes of meetings not yet approved. Mr. H.J.Brewer on behalf of the Westchester County Park Commission presented for filing portions of the Pelham-Portche^ater Parkway within the Town of Mamaroneck as shown on their sheets Nos.3 and 9. The reap was ordered received and placed on file. The Board then took up for consideration the request of the Westchester County Parr. Commission heretofore made for A change of zoning of certain properties within -!he lines of takings for the3?elhara®3'ortchester Parkway as shown on their map sheets Nos. 3 and 9. After due consideration and disdussion, the following resolution was presented and unanimously adopted WHEREAS, at its meeting held on December 9 _ 1925, this Board adopted a resolution amending "a`he zoning ordinance of the unincorporated part I of the Town of Mamaroneck,Westchester County, - - New York-"An ordinance adopted by the Town Board of this Town of Manaroneck,N.Y. at its meeting held on June 21,1922 by virtue of the power~ vested in said Town Board under the provisions of Chapter 322 of the Laws of 1922 to establish building lines on any property fronting or adjoining any public streets and requiring all buildings hereafter erected to be within such lines; to regulate and restrict the location of trades and industries and the location of buildings dedigned for special uses; to regulate and limit the height and bulk of buildings hereafter erected; to regulate and determine the area of yards: courts and other open space=s, surrounding buildings and to establish the boundaries of districts for the said purposes ; and to provide penalties for the violation of its provisions together with the zoning map whi the aforesaid resolution of Dece$nber 9, 1925 be and the same hereby is rescinded and the portions of the Town of Mamaroneck therein described which were transferred to and re- classified as"C" Residential Districts in the aforesaid resolution be and the same hereby are returned to thee' former Classi- fication either as "A" Residential Districts or "B" Residential Distracts; and it is farther RESOLVED, that Subdisivion "B" of said Paragraph 2 be and the serge hereby is 'rescinded to the extent that the portions of the Town of Mamaroneck described therein only which are within the area of the takings of the Westchester County Par? Commission for its proposed parkway in the Town of Mamaroneck, be and the same hereby is rescinded and such portions thereof within the tatting heretofore re-Classified as "C" Business Districts be and the same hereby are returned to either " Ass Residential Districts Or 1"B" Residential Districts; but that portion of '... the Town of NAmaroneck described in said resolution not within the taking of the Westchester County Para: Commission is in no way affected or rescinded; and it is further RESOLVED, that except to the extent herein specified the aforesaid resolution of December 9,1925, be and the same hereby is and shall remain in f=all force and effect. The Supervisor recommended that he be authorized and empowered to employ some party to examine the books of - the Receiver of Taxes and compile a list of all unpaid taxes as shown on said books of the Receiver of Taxes from the year 1375 to date. Upon motion duly seconded, it was RESOLVED, that the Supervisor be and he hereby L is authorized and empowered to employ some Party to examine the books of the Receiver of Taxes and compile a list of all unpaid taxes from the year 1875 to dates upon the terms and at a compensation at hid discretion. The Clerk brought to the attention of the Board the matter of the publication of the list of Audited Torn Accounts for theyear 1925. Upon motion duly seconded, it was RESOLVED, that the matter of the publication of the list of Audited Town Accounts for the year referred tans w to the 1925 be and the sa:Ge hereby is Supervisor with power to act therein in accordance with law. mr, Brewer representing the Building Commission appeared before the Board and requested on behalf of said Board instructions as to whether Counsel should take an appeal from the Order granted by Mr.dustice Young directing the B*aiding Commission of the Town of Mamaroneck to issue a permit to the Mahlstedt®Steen Corporation for the erection of an apartment house on the northwest corner of Chatsworth and Myrtle Avenues , which order was issued in connection with the mandamus action heretofore brought by said Cor­ poration. The Board dibussed the matter in detail, and in connection therewith Messrs. Perrin and Harrisson of the zoning board -of appeals appeared before the Board and spoke in favor of an appeal being taken from said order; and Messrs. Birch, Stevens, Gagliardi and Badolato appeared before the Board and spoke in opposition to said appeal being token, Upon motion duly seconded, it was REVIVED, that when this Board adjourn, it adjourn to meet on Hay 10, 19260 at 3 P.M. at which time the Natter of taking an appeal would be taken via and disposed of.
