BOARD OF AIFEALS UNDER THE ZONING ORDINANCE-TOWN OF MAMARONECK, N . v .
STATED MEETING
Thursday evening September 25, 1930.
RESENT: -Chairman Rossbottom, Messrs ; C . C. Worth, 0. A. Raynor,
C. W. Cross and F. G. Smith.
The minutes of the stated meeting held on Thursday evening
August 28, 1930 were approved and orde*ed placed on file as Number
10 of Volume Number one .
The clerk was instructed to inquire of the Building
Commission whether or not that commission has enforced the Zoning
Ordinance in regard to the application of James J. McCann to
maintain as erected , an apen terrace to residence on the south- side
of Hillside Road in the unincorporated Section of the Town of
r..amaroneek as this application was denied by this Board at a
stated meeting held on Thursday evening June 26, 1930.
In re-application of Mrs . Bernetta Bowman to erect a one-
family dwelling on the southwest corner of Forest and Murray Avenues
in the unincorporated Section of the Town of Mamaroneck.
ir. F. D. Tansey who appeared at a heaaing held before this
Board on Thursday evening August 28, 1930 also appeared at this
meeting stating that there was a petition in circulation to re-
quest the Town Board to purchase this property in question and that
this petition would be in r diness for presentation before this
Board within a few days . Mr. Tansey represented those in opposition
to the proposed application, of :'rs . Bernetta Bowman.
Upon motion of ,Ir. Raynor and seconded by Mr. Smith and
unanimously carried, the following resolution was adopted:
Whereas , Caraine Tortorella through his representative
has filed on the date of July 31, 1930 an application
or request for a re-hearing on an application to erect
a gasoline filling station on the south side of Myrtle
Boulevard in the Town of _Iamaroneck (unincorporated
Section) and,
Whereas, said original application was denied at a meeting
of this Board held on Thursday evening :;.arch 13, 1930 and
Whereas, this Board deems that it has no authority on
adjudicated cases to grant a re-hearing after same has
once been determined, be it therefor
RESOLVED: that the applioatioh of Or. A. S. Derby as
council for applicant Mr. Carmine Tortorella for a re-
hearing be and hereby is denied.

THE
RESOLUTION-
'.Vhereas, Jr. Karl F. Fiebig filed on September 11 ,1930 an
application under the Zoning Ordinance to permit the erection
of a two-car garage on premises known as number 6 Dean rlace
in the sown of ;,iamarore ck (unincorporated 'vection) within
75 feet of the east side of Dean Place and
Whereas, a Public hearing was held on this application by
the Board of Appeals at its stated meeting held on Thursday
evening September 25, 1330, after due notice by -publication
in the public press and
Whereas , the plot-plan did show that owing to the shallow
depth of this propertr in question it was and/or is imposs-
ible to set this proposed garage at the set-back as required
in Article 3 Section 11 of the Zoning Ordinance and
Whereas, this garage if erected would and/or will in no war
interfere with the rights or property privilages of ad-
jacent propertrowners it was therefor
RESOLVED-that the Board of Appeals does hereby make and grant a
variation from Article 3 Section 11 of the Zoning Ordinance
allowing the erection of a two-car garage for private use
on the east side of Dean place providing that same is
constructed in accordance with the pilot-plan as filed and
also in aclordances with the requirements of the Building
Commis7ion
