''lhereas , Carmine and Louise Tortorella filed July 18,
1930 an application with the Town Board of the Town of fam,.rore ck,
requesting rezoning of property known as 175 _•iyrtle Boulevard in
the Town of 7amaroneck (unincorporated section) from a Class "C"
Business District to a Class "D" Commercial DtAtrict , and
'Thereas , a public hearing was held on said petition
br the Board of Appeals after due notice having been given by
publication in the public press, at a meeting of said Board held on
Thursday Fvenang January 26, 1933, and
Vhereas , ;ounsel for the petitioners stated that his
clients were asking for this rezoning in order to enable them to
construct and maintain a gasoline filling station on the before
mentioned premises , and

'Vhereas , owing to the fact that an application has
previously been made for a use of this nature , and
"Jhereas, at that time many property o'^finers within this
area appeared in opiosition to this apilication and said ap lication
«ras summarily denied, and
;ihereas, petitioner failed to show actual cause of undue
hardship by being denied this ap 1ication, and
'9hereas, the Board deems the rights and interests of
these property owners must be upheld.
EESOiVED, that the Board of Apieals hereby petitions
the Town Board of the Town of _.`amaroneck to dem- the application
of the petitioners hereinbefor mentioned.
