CONVENE REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Price at 7:00 p.m., at
which time a motion duly made and seconded, the meeting was unanimously declared adjourned
into an Executive Session in Conference Room A to discuss certiorari and personnel. The Board
then at 7:30 p.m. recessed into a Work Session to discuss the Memorial Park.
RECONVENE REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Price at 8:25 p.m.
CALL TO ATTENTION
Supervisor Price pointed out to those assembled the locations of exits as required by law for public
gatherings.
PUBLIC HEARING - Amendment to Local Law No. 7-1994
Moratorium on Placement of Cellular Telephone Antennas
Supervisor Price explained that the purpose of this law was to extend the moratorium on cellular
antenna installation, which was originally for 90 days. She said that the Town had retained the
services of Cleary Consultants, who were environmental consultants and that they conducted the
study of the Town's land use regulations with respect to placement of cellular telephone antennas
with the Town. She said that as a result of the study Cleary Consulting had advised us that they will
recommend certain amendments to the Zoning ordinance and because Town regulations State
statutes require procedures as to referrals of proposed zoning amendments, it has become
necessary to extend the of time for the moratorium to ensure the Town's compliance with State and
local Environmental Quality Review Laws.
The Supervisor requested anyone in favor of the law to now come forward. There being no one, she
asked if anyone wanted to speak in opposition.

on the Proposed Extension of its Cellular Moratorium

Good evening. My name is David L. Snyder, and I am a
partner in the White Plains law offices of Snyder & Snyder. I am
appearing this evening on behalf of NYNEX Mobile Communications
Company ( "NYNEX") .
As the record in this matter amply demonstrates, NYNEX
and its approximately 85, 000 customers in Westchester County are
vitally concerned by the actions this Board is contemplating
tonight . As NYNEX has repeatedly demonstrated in its testimony
before this Board and other Town agencies, there exists a serious
gap in cellular coverage within the Town of Mamaroneck. This gap
poses an immediate risk to all persons (including public and
private agencies) that rely on cellular service to report fires,
automobile accidents or other incidents that directly threaten
public health, safety and welfare.
This risk is not speculative or otherwise overstated.
Indeed, I would respectfully remind the Board of the August 17,
1994 letter from the United States Coast Guard which we previously
placed in the record. The Coast Guard letter indicates that due to
its proximity to Long Island Sound, seamless cellular service in
Mamaroneck is vital to the federal effort to provide emergency
service and assistance to persons on the nation' s coastal

waterways .

The development of a cell site in the Town of Mamaroneck
thus continues to be a high priority for NYNEX. And I must. stress
that this priority is imposed on NYNEX as a matter of law. NYNEX
is obligated both under its license from the Federal Communications
Commission, and as a public utility of the State of New York, to
remedy any gap in service which impedes its ability to render safe,
effective and seamless coverage within its franchise area.
Accordingly, NYNEX is deeply troubled by and opposes, the Board' s
stated intention to extend the cellular moratorium for an
additional ninety (90) days .
We believe our opposition is justified, since NYNEX has
been given no idea of the steps the Board has taken thus far, to
address the issues which prompted the moratorium originally.
Indeed, while NYNEX was assured that it would be permitted to share
its cellular expertise as the Town considered its options, the Town
has made no effort to include NYNEX in the regulatory process .
The exclusion of NYNEX from the regulatory process seems
particularly unfair, since NYNEX has elected to work with the Town
in resolving its citizen' s concerns, rather than immediately
instituting litigation, as for example, was done by another utility
in response to the Tarrytown Cellular Moratorium.
As you may know, the Tarrytown Cellular Moratorium, which
was in purpose and effect identical to the moratorium we are
considering this evening, was twice overturned by the Courts . In
the Tarrytown cases -- copies of which I will gladly provide -- the
Courts found that cellular facilities posed no risk to public
health. The Courts further determined that since a federal agency
had considered the health impacts of these facilities, any
inconsistent action by a local agency was pre-empted.
The Tarrytown decisions are particularly relevant, since
the Tarrytown moratorium, like the moratorium being consider
tonight, stated that it was initiated in response to a "perception"

of risk. I note that in the Tarrytown case the Court found that :
"The Village cannot, by law override a federal mandate by the
enactment of a moratorium based solely on a perception of risk. "
While NYNEX might be willing to accommodate a brief
extension of the Mamaroneck Moratorium, it cannot do so without
knowing where this matter stands, what has been done, what remains
to be done, and when it will have an opportunity to participate in
the regulatory process . In any event,. however, while NYNEX has
acted with great restraint thus far, it cannot accept an extension
of the Moratorium for an additional ninety (90) days . There is
simply too much at stake .
I appreciate your consideration, and remain hopeful that
we can initiate a dialogue this evening that advances the interests
of all parties, by identifying a definitive course of action that
will move this process expeditiously to a conclusion.

The Supervisor commented that the appeal which Mr. Snyder was referring to that had occurred in
Tarrytown differed significantly from this matter.
Ernie Odierna said that speaking on his own behalf as a resident, the world is becoming dependent
more and more on cellular communication and for the Town to study this and spend a great deal of
money on studies seems ludicrous.
Supervisor Price pointed out to him that other than Mr. Snyder, no one had objected or spoken out
against this moratorium, and as a result of the moratorium, we engaged a study that has gathered
research regarding concern about the public perception that had been voiced at our meetings.
Mr. Batruss, Bruce Road - invited the Board to take as much time as they feel is necessary to
address concerns that have been verbalized here and in many other places, and added that it was
his belief that these antennas would work well out on Long Island Sound.

Dear Elaine:
I regret that I cannot attend the Town Board meeting this evening.
However, for the record, I favor extending the moratorium on the installation of cellular
antennas in the Town of Mamaroneck. Realistically, the density of the Town's population
together with the location of our schools makes such installation a serious health and
safety threat to all residents and their families.
I implore the Board to be prudent, to seriously consider the scientific and medical
expertise and advice of both your consultants and concerned residents, and to keep the
health and safety of the residents a primary factor in such decisions. Once such cellular
antennae are installed, the hazardous physical results cannot be reversed. The reality
of our very lives being threatened for the sake of "state of the art" communications
systems is not a well balanced equation! This is not a risk I'm willing to take!

Sandy Tashoff
The Town Attorney said that Cleary Consultants were working on drafting a zoning ordinance that
will take the state issues into consideration, with the proviso that federal regulations be also
respected. He suggested that 60 to 90 days be granted to allow the process the recommendations
and for the Planning Board to review the proposal, and for the Town Board to set a hearing date.
Mr. Snyder thanked the Board for their diligence and said that he was pleased to''see the process
progressing, and it would be helpful if a draft was circulated since NYNEX and its engineers would
then have the opportunity to have input as well.
Ms. Silverberg explained that this draft was a working document that has not even passed staff
approval, but at the appropriate time, a copy would certainly be given to him.
Mr. Snyder asked if the Town would commit to a time. The Supervisor replied that there were too
many variants to make such a commitment, because it depends on how much work needs to be
done, noting that to give a date would only be misleading.
Mr. Snyder asked if two weeks seemed fair, to which the Supervisor agreed. He then asked if he
and NYNEX would be allowed access and input into the report, to which she also agreed.
Ernie said that it seemed strange that the Board's consultant did not ask for the opinion of the
NYNEX engineers. Councilman Weprin answered that NYNEX engineers would not have the
independence necessary to be totally impartial.

More discussion followed regarding procedure, and timing. On motion of Councilwoman O'Keeffe,
seconded by Councilwoman O'Flinn, the Public Hearing was closed.
On motion of Councilman Weprin, seconded by Councilman Ryan, it was unanimously
RESOLVED, that the Town Board does hereby make a Determination of
Non-Significance as follows:
NEGATIVE DECLARATION
NOTICE OF DETERMINATION OF NON-SIGNIFICANCE
November 16, 1994
This notice is issued pursuant to Part 617 of the implementing
regulations pertaining to article 8 of the Environmental
Conservation Law and Local Law #4 of 1989 .
The Town Board of the Town of Mamaroneck having previously
declared itself lead agency hereby determines that the proposed
action described below will not have a significant effect on the
environment and that a Draft Environmental Impact Statement will
not be prepared.
Name of Action: Proposed local law entitled "Amendment to
Local Law #7 of 1994, Moratorium on Placement of Cellular
Telephone Antennas" .
SEQR Status: Unlisted
Description of Action: Extension of an existing ninety day
moratorium on any approvals which would result in the erection of
cellular telephone antennas in the Town of Mamaroneck, to
February 15, 1995, in order to allow the Town Board to review
possible implementation of local land use regulations relating to
such installations.
Location: Throughout the entire unincorporated area of the
Town.

Reasons Supporting Determination: The proposed action is a
limited extension of an existing moratorium to allow the Town
Board an opportunity to complete the study commenced by its
consultants relating to the location of cellular telephone
-antennas and determine whether it is appropriate for the town to
implement regulations with respect to the placement of these
antennas as part of its authority under local zoning and other
land use regulations. After reviewing the criteria contained in 6
NYCRR 617 and local law # 4 of 1989, this Board has determined
that there will be no significant impacts from the proposed
moratorium extension. Any regulations which may be adopted as a
result of the ongoing study shall be subject to separate
evaluation under applicable environmental regulations.

On motion of Councilman Ryan, seconded by Councilman Weprin, the following law was
unanimously adopted:
LOCAL LAW No. , 1994
This Local Law shall be known as "Amendment to Local Law No. 7,
1994, Moratorium on Placement of Cellular Telephone Antennas" .
BE IT ENACTED by the Town Board of the Town of Mamaroneck as
follows :
1 . This Local Law shall be known as Amendment to Local Law No.
7, 1994, "Moratorium on Placement of Cellular Telephone
Antennas" .
2 . Purpose and Intent :
The Town Board, on August 17, 1994, adopted Local Law No.
1994, known as Moratorium on Placement of Cellular Telephone
Antennas, which provided for a moratorium, for a period of
ninety (90) days from adoption, on any action which would
permit the erection of a cellular telephone antenna within
the Town of Mamaroneck.
Since the adoption of the Moratorium the Town Board has
retained the services of Cleary Consulting, planning and
environmental consultants, for the purposes of undertaking a
study of the Town' s land use regulations with respect to
placement of cellular telephone antennas within the Town of
Mamaroneck.
As a result of the study Cleary Consulting has advised that
they will recommend certain amendments to the Town Zoning
Ordinance with respect to the citing of cellular telephone
antennas within the Town so as to address aesthetic, as well
as public health and safety concerns arising from the
proliferation of these antennas .
Town regulations and State statute require that prior to the
adoption of a zoning amendment that such amendment be
referred to the Town of Mamaroneck Planning Board and to the
County Department of Planning and, further, that the Town
undertake compliance with the State Environmental Quality
Review Act . It will be impossible to review the proposal of
our consultant and to implement any changes before the
expiration of the initial ninety (90) day moratorium period.
it is, therefore, the purpose of this Local Law to amend
Local Law No. 7, 1994 for the purposes of extending tpe
moratorium so as to allow the Town to complete its study and
adoption of regulations based upondthat study and to
• maintain the status quo pending the adoption of those
regulations so as not to render the Town' s efforts to review
e these uses moot .

3 . Section 6 of Local Law No. 7, 1994 is hereby amended to read
as follows : "This Local Law shall be in effect until
February 15, 1995 . "
4 . Severability
Should any provision of this Local Law be declared
unconstitutional or invalid by any court of competent
jurisdiction, such declaration of unconstitutionality or
invalidity shall not affect any other provisions of this
Local Law .which may be implemented without the invalid or
unconstitutional provision.
5 . Effective Date
This Local Law shall take effect immediately.

ORAL COMMUNICATIONS
Irving Scharf said that he was here to request that the Town Board take action on what is an
increasing hardship on owners of coops and condos. Because of the way the law is written many
renters actually pay less in rent than it costs the owners to run it, especially when you figure in the
maintenance charged to the owners. He requested that a letter be sent to the Rent Guidelines
Board regarding this problem.
The Supervisor affirmed that she had knowledge of this problem and if Mr. Scharf would call her,
she would prepare the correspondence.
Councilwoman O'Keeffe requested Mr. Scharf to explain the procedure for rent stabilization. He
outlined that one-third of the apartments are under rent control, and 80 percent of those are paying
less in rent then what is charged to the owner for the maintenance. He then thanked the board for
their attention.
REPORTS OF THE COUNCIL
Councilwoman O'Flinn reported that 22 trees had been planted along Murray Avenue, which had
been funded through a grant received from the DEC. She said that the trees were purchased from a
business located in the Town.
Councilman Ryan reported that the new stand at the Ice Rink opened on October 26, that they had
an excellent menu, and the response so far seems excellent. He said that the stand is open Monday
-Thursday, from noon to 6; and Friday, Saturday and Sunday from noon to 10 PM.
The Supervisor reported that there would be a meeting on November 28, in the Mamaroneck Senior
Center, spearheaded by Martha Kaufman, who is revitalizing the Committee on Family and Youth,
and the program will be on the use of alcohol by teens and discussion on intervention.
APPROVAL OF MINUTES:
On motion of Councilman Weprin, seconded by Councilman Ryan, it was unanimously resolved to
approve the minutes from the Months of April and May 1994 - as amended.

2. Update - Firehouse Renovation Project
Richard Tortorella reported that the footings and walls of the new additions should be completed
next week; the elevation will be drilled for next week and overall the project is on schedule and
going well.
Councilwoman O'Keeffe asked how long would the construction continue before it gets to cold to
work.
Mr. Tortorella answered that the steel work will continue into February and the rest would depend
on how cold and wet it gets.
There being no further business to come before the Commission, on motion of Councilman Weprin,
seconded by Councilwoman O'Flinn, the Commission unanimously adjourned at 10:00 PM.

AFFAIRS OF THE TOWN
1. Appointments - Cable TV Board of Control
Ambulance District Board
Councilwoman Ryan said that Bill Littauer has been a real asset to us on this Board and he would
like to make the motion to reappoint him, Councilwoman O'Keeffe seconded, it was unanimously:

RESOLVED, that the Town Board does hereby reappoint William Littauer, 6
Knollwood Drive, as a member of the Cable TV Board of Control for a term
of two years, said term to expire November 1996.
Ambulance District Board
Councilman Ryan explained that the Ambulance Board is comprised of one elected official from
each community and a representative from the UM Volunteer Ambulance Corp and Mamaroneck
Village's Emergency Medical Service. He said that two representative had chanbd and it therefore
necessary for the Board to ratify the changes, noting that Frank Cioffi will serve as the rep from VAC
and from EMS, Bonnie Foulke. Councilman Ryan stated that Frank Cioffi is one of the original
founds of VAC, serving as president in the past; and that Bonnie Foulke has been a long time
member of the Village's EMS.
On motion of Councilman Ryan, seconded by Councilman Weprin, it was unanimously:
Ambulance District Board
RESOLVED, that the Town Board does hereby ratify the appointment of
Frank Cioffi, 14 Senate Place, to the Ambulance District Board as the
representative from UM VAC; and
BE IT FURTHER,
RESOLVED, that the Board hereby ratifies the appointment of Bonnie
Faulke, 82 Hommocks Road, to the Ambulance District Board as the

Councilman Ryan asked whether the 100 foot buffer, referred to either fresh water, salt water or
both. Phyllis said that she would have to check to make sure.
Supervisor Price said that the process with the State is to spell out problems and to take steps to
alleviate them and to have an understanding of them as well as to identify solutions.
Councilwoman O'Keeffe said that she was impressed with the literacy of the document, and that as
a layman, she found it comprehensive.
4. Authorization - Intermunicipal Agreement - County of Westchester
DWI Patrol Project
Authorization was requested by the Administrator to enter into and execute an agreement with the
County of Westchester that will provide funding to the Town to help alleviate the cost for
enforcement of DWI Laws. He said that under the terms of the agreement, the Town will receive an
not to exceed $15,000.
The Board discussed the funding and whether it actually covered the expense, especially because
of the high cost of overtime and wear&tear on the police cars. Mr. Altieri said that this agreement
is specifcally to cover those costs.
On motion of Councilwoman O'Flinn, seconded by Councilwoman O'Keeffe, it was unanimously,
RESOLVED, that the Town Board does hereby authorize entering into the
agreement with the County of Westchester which provides funding of up to
$15,000 in 1995 for extra costs incurred for enforcement of the DWI Laws,
and authorization is given to the Administrator to execute the agreement on
behalf of the Town.

5. Authorization - Intermunicipal Agreement - County of Westchester
Enforcement of Seat Belt Law
The Administrator explained that authorization was being requested to enter into and execute an
agreement with the County of Westchester for reimbursement of expenses incurred for enforcement
of NYS Seat Belt Law. He said that the agreement outlines that the County will reimburse the Town
an amount not to exceed $5,238 for overtime expenditure, commenting that the Town had
previously entered the agreement and had been able to utilize the funds for additional enforcement
during the year.
On motion of Councilwoman O'Keeffe, seconded by Councilman Ryan, it was unanimously:
RESOLVED, that the Town Board approve the agreement with the County
of Westchester which provides for funding of up to $5,238 for enforcement
of the Seat Belt law and authorization is given to the Administrator to
execute the agreement on behalf of the Town.

The Supervisor said that George Derderian, who serves as our consultant in Certiorari filings, had
made recommendations that the cases before us be settled. She said that these assessment
reductions are having an adverse impact on all local governments.

6. Authorization - Software Purchase Agreement - Section 8 Housing
The Administrator said that this was a request from the Section 8 Housing office for authorization to
purchase software specifically designed to meet their reporting and records requirement, and for
the hardware necessary to run the networking system with our existing computers, also for the
purchase of a Hewlett Packard Printer. He advised the Board that the authorization was pro forma
only, as the cost of the system is being funded directly by Section 8.
On motion of Councilwoman O'Keeffe, seconded by Councilman Ryan, it was unanimously,
RESOLVED, that the Town Board does hereby authorize the purchase of
software for the Section 8 Housing Office for the total amount of$4,730;
and hardware and printer purchases for an amount totaling $2,090; said
purchases are to be totally charged to the Section 8 Housing Program that
is funded by the Federal Housing and Urban Development Agency.

7. Authorization: Installation of Fire Hydrant -Winged Foot Golf Club
Mr. Altieri explained that since Westchester Joint Water Works will soon install the new water
storage tank at the Winged Foot Golf Club, that it seemed logical to consider the installation of a fire
hydrant that has long been under consideration by our fire department that had originated the
request at behest of the Fire Council. He said that the cost has not been determined but in no case
will it exceed $10,600, and that after meeting with Mr. Hoch he will have a more precise figure.
On motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, it was unanimously,
RESOLVED, that the Town Board does hereby authorize Westchester Joint
Water Works to install a fire hydrant at Winged Foot Golf Club at a cost not
to exceed $10,600.
8. Salary Authorizations - Comptroller's Office -- Part Time Clerk
Recreation Department
The Town Administrator said that this request was for the replacement of a part-timer who had gone
back to school, and the person to be hired would be paid at an hourly rate of$8.00.
Councilwoman O'Keeffe asked if she could have a more thorough explanation of this person, would
they be an additional part-timer, was the position really necessary, what would be the
responsibilities involved.
Mr. Altieri assured her that it was a replacement not an additional hiring; that the position entailed
many duties, posting taxes, receiving tax payments, answering phones, computer work, etc.
Thereafter, on Councilwoman O'Keeffe's motion, seconded by Councilwoman O'Flinn, it was
unanimously,
RESOLVED, that the Town Board does authorize the salary of$8.00 per
hour to Evelyn Bevilacqua to work as a part-time clerk in the Comptrollers
Office.
