( owner) SUBJECT: Application (re-decision of the Building Commission) under 'article 3 Section 11 of the Zoning Ordinance to permit in a residence use and " A" area district, the erection of a one-fami1' residence within 30 feet of the front building and/or propertY line, also within 6 feet of the Westerly side building and/or pro pert line . For Opposition; -No one. 4CTION OF BOARD- Application granted on condition. THE VOTE Affirmative;-Chairman Rossbottom, Raynor, Worth, Smith, Cross. Negative;-None . THE RESOLUTION 4-32 B. Z. Whereas Selma L. Hanson filed , April 4, 1932, an application, under the building zone resolution, tp permit in a residence district the erection and maintenance of a one-family residence; and Whereas, a public hearing was held on this application by the Board of Appeals , at a special meeting, April 14, 1932, after due notice by publication in the public press; and Whereas, the use district maps aecompan^ing the building zone resolution show that Premium River Road, 125 feet west- erly from Edgewater Place is in a residential "A" district; and Whereas, the decision of the Building Commission, rendered April 4, 1332 (re- Applic. No. 1604) , reads, "Proposition contrary to the Zoning Ordinance , Article 3 "3eotion 11. The erection of a residence building within 30 feet of the front building and/or property line and within 6 feet of the westerl'- side building and/or property line; and whereas, the premises consist of a plot of ground, the proposed use of which is in conformity with the uses as have here-to-for been established; and whereas, the Board of Appeals deems that applicant has substantiated his basis of appeal brought under article 3 Section 11 of the Zoning Ordinance and that a denial of the application would devolve unneceesrary hardship and practical difficulty upon the applicant. RESOLVED, that the Board of Appeals does hereby make a variation in the application of the use district regulations, and that the application be abd it hereby is granted on condition that the one-family residence structure be erected not less than 23. 2 feet to the nearest point of the foundation from the front building and /or propertr line of !'remium -iver oad and not less than 3.5 feet to the nearest point of the foundation from the wes terlr side building and/or property line and that the require- :vents of the Zoning —aw othefwise shall be oomrlied with in alirespeots.
