THE RESOLUTION Nhereas, ouken glen Incorporated , filed, ?+'arch 1+ , 1932, an application, under Article 3 Section 11 of the Zoning Ordinance to permit in a residence use and ' A" area district , the erection of a one-family residence structure , ( 25) feet and no inches from the front building and/or propertT' line , instead of the (30) foot set-back from the front building/and/or protert^ line as reruired under Article 3 Section 11 of the Zoning Ordinance; and Vhereas a public hearing was held on this application br the Board of Appeals , at its regular meeting, _.larch 24, 1332, after due notice by publication in the public press: and Nhereas , the use district maps accompanying the Zoning Ordinance show that the South side of Bonnie Briar Lane and/or Plot 407 is in a residence district; and Nhereas , the decision of the Building Commission, rendered :!arch 14, 1932 shows that a ( 25) foot set-back from the front property and/or building line is in violation of Article 3 Section 11 of the Zoning Ordinance; and 'There" , t tftxT. 1t ci5tMt 7lxi kitR*7c t_'ti the premises consist of a plat of ground the contour of which rises ver- rapidlY toward the rear of same , and 7hereas , the Board deems that applicant has substantiated his basis of appeal brought under Section 21 Article 3 of the aning Ordinance and that denial of the application would devolve unnecessar- hardship and practical difficulty upon the applicant. RESOLVED, that the Board of 'appeals does hereby- make a variation in the application of the use district regulations, and that the application be and it hereby is granted on condition that the one-family* residence structure shall be erected not less than ( 25) feet and no inches from the front building and /or property line to the nearest point of said structure or residence b zild ins, and that the requirements of the Zoning Ordinance shall be otherwise complied with in all respects.
