SUBJECT: Application (re-decision of the Building Commission) under
Article 3 Section 11 of the Zoning Ordinance to permit in
a residence use and "A" area district, the erection and
maintenance of an addition to a one-family residence
building feet and inches from the property
and/or building line instead of the 30 foot setback as
re :uired by the zone resolution.

Whereas Priscilla P. Liebenguth ( owner) filed
March 12, 1931 an application under the building zone
resolution to permit in a residence use and "A" area
district, the erection of an addition to a one-family
residence building within 30 feet from the building
and/or property line of Overlook Terrace instead of
the 30 foot set back required by the building zone
resolution; Premises , Northeasterly corner of 7:dgewood
Avenue and Overlook terrace , Town of Mamaroneck
(unincorporated section) , and
':7hereas a public hearing was held on this
a ;plication by the Board of Appeals at tts regular
meeting March 26, 1931 after due notice by publication
in the public press and
Whereas the use district maps accompanying the
building zone resolution show that the Northeasterly
corner of Edgewood Avenue and Overlook Terrace is in a
residence "A" area district, and
7hereas the decision of the Building Commission
rendered March 12, 1931 reads ; there will exist a
violation pf Article 3 Sectionll of the Zoning Ordinance;
alteration will be in an "A" area district nearer than
30 feet from the building and/or property line of
Overlook Terrace, and
Whereas owing the fact that the property in
question is on a corner and that the proposed
addition is to be a bay-window extending only to the
heighth of the second floor, and
Whereas no one appeared in opposition to the
erection and/or alteration to said structure, situated
as hereinbefore r:antioned, and
Whyyeas the Board deems the variation is warranted
under Article 3 Sectionll it is therefor
RESOLVED, that the Board of Appeals does hereby
make a variation of the building zone resolution and
that the application be and it hereby is granted on
condition that the addition to the one-family residence
be set back in accordance with the dimensions as con-
tained on the plot-plan as filed ai:d that the requiref-
ments of the zoning law otherwise shall be complied with
in all respects.
