OF FIRE COMMISSIONERS OF THE TOWN OF MAMARONECK
HELD WEDNESDAY, JUNE 1, 1994 AT 8:15 PM IN THE COURT
ROOM OF THE TOWN CENTER, 740 W BOSTON POST ROAD,

CONVENE REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Price at 7:00 p.m.,
at which time a motion duly made and seconded, the meeting was unanimously declared
adjourned into an Executive Session to discuss personnel. At 7:30 p.m. the Board recessed
in a Work Session in Conference Room A to discuss the Memorial Park.
RECONVENE REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Price at 8:20 PM.
CALL TO ATTENTION
Supervisor Price pointed out to those assembled the locations of exits as required by
law for public gatherings.
PUBLIC HEARING - No Parking Ordinance - Cooper Lane
On motion of Councilman Ryan, seconded by Councilman Weprin, the Public Hearing was
opened at 8:30 p.m.
Supervisor Price explained the regulation to be adopted was specifically to prohibit parking on
the northeast side of Cooper Lane between weaver Street and Mardon Road.
The Board members questioned the location and it was unclear which side of street was
northeast. Mrs. Carroll, 68 Cooper Lane, the only resident in attendance said that she there
was a dangerous situation on the street when cars backed out of the driveways from top of hill
(Cooper Lane and Mardon Road) that visibility is not good. Supervisor questioned whether a
new problem was being created by this law.
Councilman Ryan suggested sending the matter back to Traffic Committee with a request for
them to examine the entire stretch of Road.
Councilman Weprin moved to adjourn.
Mr. Silverberg suggested tabling the matter instead of adjournment.

Therefore, on motion of Councilman Ryan, seconded by Councilwoman O'Flinn, it was
unanimously
RESOLVED, that this Board does hereby table
the proposed local law regarding parking on
Cooper Lane and request that the Traffic
Committee review the entire area for further
recommendation.
PUBLIC HEARING -Solid Waste/Recycling Law
On motion of Councilwoman O'Flinn, seconded by Councilman Weprin, the Public Hearing was
opened at 8:45 p.m.
The Supervisor explained that the purpose of this law was to amend Solid Waste/Recycling law
to better clarify violations and to allow the Building Inspector to have authority to enforce the
law.
Michael Salem, 711 Larchmont Acres wanted to how if this amendment would include multiple
dwellings.
The Administrator replied that the Building Inspector was working with the Management of
those buildings to comply with law. He also said that he had been informed that the
Management Company had issued violations.
Councilwoman O'Keeffe said that she was please to see this amendment passed.
On motion of Councilwoman O'Keeffe, seconded by Councilman Ryan, the public hearing was
declared adjourned.
On motion of Councilwoman O'Keeffe, seconded by Councilman Ryan, the public it was
unanimously
RESOLVED, that the Town Board does hereby
adopt the following local law:
LOCAL LAW NO. 5 - 1994
This Local Law shall amend Local Law No. 9 - 1992
"Solid Waste/Recycling".
Section 1. Purpose:
The purpose of this Local Law is to amend and clarify
provisions of Local Law No. 9 of 1992 entitled "Solid
Waste/Recycling".
Section 2. Amendments:
Local Law No. 9-1992 shall be amended to read as follows:
Section 14. Enforcement
The Commission may promulgate such regulations as it
deems necessary to effect the provisions of this Local Law.
Any regulations_promulgated by the Commission which will
directly impact the residents of the Town of Mamaroneck shall
be subject to the approval of the Mamaroneck Town Council.
All provisions of this Local Law shall be enforceable by the
Building Inspector and the Building Inspector's designated
deputies and/or assistants.

Section 19. Penalties
c. Any violation of this Local Law shall be punishable by a fine of
up to Two Hundred Fifty ($250.00) Dollars for each such violation
or by imprisonment by the third and each subsequent offense
within a one-year period, not to exceed fifteen (15) days, or both.
Each day during which a violation exists shall be considered a
separate and distinct violation punishable as a separate violation.
Section 3. Severability:
Should any provision of this Local Law be declared illegal or
unconstitutional by a court of competent jurisdiction, to the
extent that the other provisions of this Local Law can be
implemented without such illegal or unconstitutional provision,
such other provisions shall remain in effect.
Section 4. Effective Date:
This local law shall become effective immediately upon filing with
the Secretary of State.

2. Report of Bids - Demolition Fire House
The Administrator reported that he had opened bids on May 31 for the demolition of the
firehouse and based on those bids was recommending that SRN Contracting be awarded the
contract as the lowest responsible bidder at$65,100.

Following discussion, on motion of Commissioner Ryan, seconded by Commissioner O'Flinn,
it was unanimously,
RESOLVED, that the Board of Fire Commissioners does hereby
award the contract for the demolition of the Weaver Street
Firehouse to SRN Contracting, the lowest responsible bidder,
in the amount of$65,100 and the deduct alternate bid of
$27,100.
3. Salary Authorization - Firefighter
Mr. Altieri said that authorization was being requested by the fire department for the payment
of salary to Terence Clarke to serve as a Fire Fighter in the Town of Mamaroneck. He said
that the Fire Council had interviewed candidates for the position of Fire Fighter and were
recommending Mr. Clarke for the position at an annual salary of$22,000.
On motion of Commissioner Weprin, seconded by Commissioner O'Flinn, it was unanimously
RESOLVED, that the Board of Fire Commissioners does hereby
approve the hiring of Terrence Clarke for the position of Fire
Fighter at an annual salary of$22,000.
There being no further business to come before the Commission, on motion of Councilwoman
O'Keeffe, seconded by Councilwoman O'Flinn, the Commission unanimously adjourned and
reconvened the Regular Meeting at 9:41 PM.
AFFAIRS OF THE TOWN
1. Appointments

There were no appointments at this meeting.
2. Authorization - Grass Cutting Contract - Cemeteries & Roadside
The Administrator explained that the Highway Department budget has a appropriation for
roadside and cemetery maintenance, which will include grass cutting on the shoulders of the
roads and in the cemeteries. He said that bids had been received for this contract and the
lowest proposal was submitted by Patzy Matera Landscaping of Scarsdale, for$2,390 per
month, and that the term of the contract would be from June through October, 1994, the total
value of the contract would therefore be $11,950. Authorization was requested to enter into an
agreement with Patzy Matera Landscaping for the above referenced work.
On motion of Councilman Ryan, seconded by Councilman Weprin, it was unanimously,
RESOLVED, that the Town Board does hereby approve the
contract for the cutting of grass at designated roadside areas
and the cemeteries for a term beginning in June through
October 1994, for the total amount of$11,950 payable at$2,390
per month.

3. Authorization -Contract- Billing Service Ambulance District
The Administrator stated that he had attached a copy of the proposal submitted by
Holdsworth Associates, Inc. to provide billing services to the Town of Mamaroneck, and he
briefly described the billing service. He outlined that they will assume responsibility for
preparing and mailing all Ambulance District bills to patients on their health insurance carrier;
that the billing service shall assume responsibility for obtaining the necessary provider
numbers for the billing of Medicaid and Medicare patients; that they will serve as liaison to
the various health insurance carriers; and that various types of monthly reports are to be
prepared by Holdsworth Associates, Inc., including various call reports that will help track the
performance of our ambulance service.
in responses to questions from Board members he noted that for the services to be provided,
Holdsworth Associates' fee will be I I% of the total billing revenue collected and deposited
into our accounts, and that it is estimated that the base fee for ambulance service will be $235
plus other surcharges such as mileage, advance life support service and oxygen, and we
have estimated the total revenue to be in the neighborhood of$385,000, said amount is net of
the fee to be paid to Holdsworth Associates, Inc.
Mr. Altieri said that the Ambulance District will bill all those that receive service from either
Larchmont Volunteer Ambulance Corps or from the Mamaroneck Emergency Medical
Service, noting that the Ambulance District Committee has been evaluating proposals from
billing service companies and are at this time recommending Holdsworth Associates, Inc. of
East Berlin, Connecticut.
After answering many questions he requested the authorization to enter into an agreement
with Holdsworth Associates, Inc. for a maximum period of two years and that such
authorization is subject to the final approval by counsel of the form contract between
Holdsworth Associates, Inc. and the Town of Mamaroneck.

On motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, it was unanimously,
RESOLVED, that the Town Board does award the Ambulance
District Billing Service contract to Holdsworth &Associates,
Inc., of East Berlin, Connecticut, The term of this contract shall
be for a period of two years and at a rate of 11% of revenues
collected.
4. Report of Bids - Fuel Oil Contract
The Administrator requested authorization to accept the low bidder on Fuel Oil #2 as follows:

Rad Oil: .8300 per gal
On motion of Councilwoman O'Keeffe, seconded by Councilman Ryan, it was unanimously,
RESOLVED, that the Town Board does award the contract for
fuel oil to Lawrence Heat & Power, Mamaroneck, NY at a cost
of.6650 per gallon for fuel oil #2.
5. Authorization -Settlement of Certiorari - Mamaroneck Gardens
Mr. Silverberg, the Town Attorney reminded the Board that previously they had approved a
settlement regarding Mamaroneck Gardens, Inc. tax certiorari, but that upon review of a
stipulation omitted by the petitioner's attorney, we noted that Block 408, lot 209 reduction for
tax year 1991 from $145,000 was listed as being reduced to $100,400; and that the
memorandum from George Derderian concerning this settlement had stated the reduction
was to $110,400. He added that he then discussed the discrepancy with' George and with
the attorney for the petitioner and they both agree that George had made an error in his
memorandum and that the correct number was $100,400. Mr. Silverberg said that under the
circumstances, he requested that the Board authorize a correction of the settlement for the
1991 tax year for reduction from $145,000 to $100,400, which will result in an additional tax
refund to the Town for$82.50.
The Supervisor noted that this may seem minor but that tax reductions were slowly
undermining our tax base here and around the County.
Thereafter, on motion of Councilman Ryan, seconded by Councilman Weprin, it was
unanimously,
RESOLVED, that the Town Board does approve the correction
to the tax certiorari settlement for Block 408, Lot 209, -
Mamaroneck Gardens, Inc. For an additional tax refund
totaling $82.50 for tax year 1991, said agreement reducing the
assessment from $145,000 to $100,400, originally stated as
$145,000 to $110,400.
6. Change of Polling Place - District 19 -Weaver Street Firehouse
The Town Clerk advised the Board that because of the construction at the firehouse, it would
I be necessary for to change the polling place that was located in there, and that my office had
contacted Sts. John & Paul and they have given us permission to relocate District 19 to the
Auditorium of the School. She said that this change necessitates your passing a resolution
authorizing the relocation and she would then request labels from the Board of Elections
enabling notification of those people affected by the relocation of the polling place.
RESOLVED, that the Town Board of the Town of Mamaroneck
does hereby approve a change in polling place, whereby
Town District#19 be changed from the Weaver Street Fire
House due to renovations, to the Auditorium at Sts. John
Paul School, 280 Weaver Street, Larchmont.

7. Adoption of Polling Places
The Town Clerk stated that in order to comply with election law it would be necessary for the
Town Board to adopt the location of the polling places and districts in the Town of
Mamaroneck, and she then requested the adoption of polling places by the Board.
On motion of Councilwoman O'Flinn, seconded by Councilman Ryan, it was unanimously,
RESOLVED, that the Town Board of the Town of Mamaroneck

unanimously,
RESOLVED, that as provided for in the 1994 Town Budget,
authority is hereby given for the payment of salary to the

Summer Conservation Corps
The Administrator explained that the summer conservation corps workers will work
for approximately six to eight weeks conducting a variety of projects in the
conservation area.
On motion of Councilman Ryan, seconded by Councilman O'Flinn, it was unanimously
RESOLVED, that the Town Board does hereby authorize the
payment of salary to Frank Marafino at an hourly rate of
$6.50 for his services in the summer conservation corps for
a period of six to eight weeks.
Administrative Intern
Authorization was requested to hire Mr. David Leeds as an administrative intern at an
hourly salary of$7.00, he will primarily be working in the Building and Engineering
Departments to assist putting on-line the new building permit computer software.
RESOLVED, that the Town Board does hereby
authorize the payment of salary to David Leeds at a
rate of$7.00 an hour for his services in the Building
and Engineering Departments assisting in
computerization.
Deputy Town Clerk
The Town Clerk reminded the Board members that this had been on the agenda of the
last meeting and it had been decided to hold it over pending research of an existing

County list. There is a dispute as to the need since State Law has determined that an
elected Town Clerk can appoint three Deputies that are exempt. She then requested
authorization for salary for Patricia Samela, her appointee to the position of Deputy
Town Clerk. Ms. DiCioccio explained that Mr. Altieri had also confirmed that there is no
existing County list for that position. She added that it was her understanding and she
had a copy of the law that even if a County list existed that an elected Town Clerk was
entitled to three exempt appointees to that position. She reiterated that was how she
wanted the appointment to be made.
After discussion, on motion of Councilman Ryan, seconded by Councilwoman O'Keeffe,
it was unanimously,
RESOLVED, that the Town Board does
hereby authorize the payment of salary to
Patricia Samela who will serve as an
Exempt Deputy Town Clerk at an annual
salary of$29,570 effective May 31, 1994,
commensurate with the Term of the Town
Clerk, which expires December 31, 1995;
and
BE IT FURTHER
RESOLVED, that the Town Clerk retains
all rights to appoint and to reappoint this
position at her pleasure.
PROCLAMATION - Rabbi Leonard Poller (This was deffered to next meeting)
The Supervisor stated that the next meetings of the Town Board would be held on June
15 and July 13, 1994 at 8:15 PM.
ADJOURNMENT
On motion of Councilman Ryan, seconded by Councilwoman O'Flinn, the meeting was
unanimously adjourned at 10:11 p.m.
