APPLICANT;-August Ackerman (builder)
SUBJECT:- Application ( re-decision of the Building Commission) under
Article 3 Section 11 of the Zoning Ordinance to permit in a
residence use and ''A" area district, the erection and main-
tenance of a one-family residence 29.52 feet from the pro-
perty and/or building line instead of the 30 foot set back
as required by the zone resolution.
PREMI S E S
AFFECTED: Southeast corner of Myrtle Boulevard and Windsor Street,
Town of ::.amaroneck (unincorporated section) known as
Lots block on a certain map
entitled "Yap of Larchmont Gardens".
APPEARANCES:-

ACTION OF
BOkRD: Application granted on condition.
THE VOTE
Affirmative-Rossbottom, Raynor, 'Worth, Smith, Cross.
Negative-No one.
Whereas August Ackerman (builder) filed November 16, 1931
an application under the building zone resolution to permit
in a residence use and "A" area district, the erection of
a one-family residence building 29.62 feet from the building
and/or property line instead of the 30 foot set back re-
quired by the building zone resolution; Premises , Southeast
corner of myrtle Boulevard and 7indsor Street, bourn of
Mamaroneck, (unincorporated section) , and
'"!hereas a public hearing was held on this application by
the Board of Appeals at its regular meeting November 27 ,
1931 after due notice by publication in the public press,
and
Whereas the use district maps accompanying the building
zone resolution show that the Southeast corner of Myrtle
Boulevard and Windsor Street is in a residence "A" area
district, and
Whereas the decision of the Building Commission rendered
November 16, 1931 reads ; there will exist a violation
of Article 3 Sectonll of the Zondng Ordinance ; Residence
will be in an ''A" area district nearer than 30 feet from
the building and/or property line of Windsor Street, and
Whereas owing to the fact that the property in question
is do a corner and that it would prove a hardship to the
owner in the free use of same, and
7hereas no one appeared in opposition to the erection of
said structure, situated as hereinbefore mentioned, and
"Ihereas the Board deems the variation is warranted under
Article 3 Sectionll it is therefor
RESOLVED that the Board. of Appeals does hereby make a
variation of the buildin zone resolution and that the
application be and it hereby is grantE d on condition that
the one-familyresidence be not less than 29.82 feet set-
back from the property and/or bmi_ ding line of ':7indsor
Street and that the requirements of the coning Law other-
wise shall be complied with in all respects.
