HomeMy WebLinkAbout1993_12_15 Town Board Regular Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON THE 15TH DAY OF DECEMBER 1993 IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order and on motion made and seconded was adjourned into a Work Session in Conference Room A of the Town Center at 5:30 PM and adjourned at 7:00 PM to join the celebration. RECEPTION - Honoring outgoing Supervisor Caroline Silverstone and Councilman John McGarr was Held from 7:00 PM to 8:15 PM. RECONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 8:30 PM in the Court Room of the Town Center. Present were the following members of the Board. Supervisor Caroline Silverstone Councilwoman Elaine Price Councilman John McGarr Councilwoman Kathleen Tracy O,Flinn Councilman Paul A. Ryan Also present were:, Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Steven M. Silverberg, Town Counsel CALL TO ATTENTION Supervisor Silverstone pointed out to those assembled the locations of exits as required by law for public gatherings. ADJOURNED PUBLIC HEARING - 1994 Preliminary Budget On motion of Councilman Ryan, seconded by Councilman McGarr, the public hearing was unanimously opened. The Administrator said that all changes made by the Town Board had been noted and changes, if they approved the budget, it will be sent to the printers for the distribution of copies for the coming year. The Supervisor asked if anyone wished to speak to this issue. Councilwoman Price thanked the Administrator, saying she know it was not easy finding where and now to cut, and often it was painful, but all in all she thinks its a good budget. She added her thanks to Carmine DeLuca, the Town Comptroller and the staff. The other Council members all added their thanks, in addition all said they too agreed that given the economy, that it had been difficult but they were happy with the outcome. On motion of Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED that the Town.Board does hereby adopt the 1994 Preliminary Budget of the Town of Mamaroneck as amended. Complete budget will be included when finalized will be on file in the Clerks safe for 1993. PUBLIC HEARING -Amendment to Senior Citizen Property Tax Exemption December 15,1993 .On motion of Councilman McGarr, seconded by Councilwoman O'Flinn, the Hearing was opened. The Administrator explained that this local law would amend the Tax Exemption law for p p Seniors increasing the income they would be allowed to get from $14,500 to$16,000 and still be eligible for an exemption. He added that this exemption was geared towards a sliding scale with those making the lease getting a larger exemption. The Supervisor asked if anyone wished to speak in favor of the law. Mr. O'Gorman, said that he was in favor of any law that would help our seniors remain here in the Town. The Town Board members also commented that they thought that the income level should be increased. On motion of Councilwoman Price, seconded by Councilman Ryan, the hearing was declared closed. On motion of Councilman Ryan, seconded by Councilman McGarr, it was unanimously, RESOLVED, that the Town Board does hereby adopt Local Law No. 12-1993, entitled "Senior Citizen Tax Exemptions" as follows: LOCAL LAW NO. 12-1993 The Local Law shall amend Local Law No. 3 of 1993, Senior Citizen Tax Exemptions. Section 1. Purpose: The purpose of this local law is to amend Section 74-7 of the Code of the Town of Mamaroneck to conform with recent amendments to the enabling provisions of Real Property Tax Law Section 467. Section 2. Amendments: Section 74'-7 -shall. be 'amended-to -read as follows: Real property_ owned by persons sixty-five (65) years of age or over shall be exempt from Town taxes, except district taxes, to the extent . of fifty per centum (50$) of the assessed valuation or such lesser per centum of assessed valuation as hereinafter specified, subject to the following conditions: A. The owner or all of the owners must file an application annually in the Assessor's office of the Town in which the real property is located. Applications must be filed in the Assessor's office on or before the taxable status date of the Town assessment roll, which is June 1 • of each calendar year for taxes payable in the following calendar year. B. In order to be eligible to apply for a partial exemption in the amount of fifty per centum (50%) of the assessed valuation, the income of the owner or the combined income of the owners must not exeeed sixteen thousand five hundred dollars ($16,500.00) (M) from all sources as set forth in such Section 467, as amended, for the twelve (12) consecutive months prior to the date that the application is filed. Where title is vested in either the husband or wife, the combined income may not exceed such sum. , C. The owner or all of the owners of real property located in the Town, who are sixty-five (65) years of age or - older and whose said income or combined income from all sources for said twelve-month period exceeded the maximum amount set forth in Subsection B by less than four thousand eight hundred dollars ($4,800.00) shall be eligible to apply for a partial exemption as set forth in the following table, in which M stands for the maximum income specified in Subsection b. f;> 2 F:_ December 15,1993 PERCENTAGE ASSESSED VALUATION ANNUAL INCOME EXEMPT FROM TAXATION More than M but less than M 45 per centum +$600. M+$600 or more but less than 40 per centum M+$1,200. M+$1,200 or more but less than 35 per cerituin M+$1,800. M+$1,800 or more but less. than 30 per centum M+$2,400. M+$2,400 or more but less than 25 per centum M+$3,000. M+$3,000 or more but less than 20 per centum M+$3,600. M+$3,600 or -.more but less than 15 per centum M+$4,200. M+$4,200 or more but less than 10 per centum M+$4,800 D'. The real property tax exemption provided herein on real property owned by husband and wife, one (1) of whom is sixty-five (65) years of age or older, once granted, shall not- be rescinded solely because of the death of 'the older spouse so long as the surviving spouse is at least sixty-two (62) years of age. E. Except as provided in Section 467-d, Subdivision 4 (b) title to the property must be vested in the owner or, if more than one (1) , in all the owners for at least twenty-four (24) consecutive months prior to the date that the application is filed. Section 3. ; Effective Date: This local law shall take effect immediately. 3 December 15,1993 BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner Silverstone at 9:11 PM in the Court Room. Present were the following members of the Commission: Commissioner: Caroline Silverstone Commissioner: Elaine Price Commissioner: John McGarr Commissioner: Kathleen Tracy O'Flinn Commissioner: Paul Ryan 1. Appointments Councilman Ryan stated that he would like to reappoint Joseph P. Fraioli as the Administrator of the Cable TV Board of Control. He added that Mr. Fraioli had been the administrator since the inception and that he had done an outstanding job. On his motion, seconded by Councilwoman O'Flinn, it was unanimously, RESOLVED, that the Town Board does hereby appoint Madeline Berg as Chair of the Coastal Zone Management Commission, to serve a term of office of one year, effective immediately, expiring August 2003; and BE IT FURTHER, 4 December 15,1993 RESOLVED, that the Town Board does hereby reappoint Joseph P. Fraioli as Administrator of the Cable TV Board of Control for a term of two years, ending November 1995.a 2. Adoption of Budget- 1994 Previously handled and voted. 3 Authorization -Snow Removal Contract-County Roads After much discussion, on motion of Councilman Ryan, seconded by Councilwoman Price, it was unanimously, RESOLVED, that the Town Board does approve the 1994 contract for the removal of snow for county roads; and BE IT FURTHER RESOLVED, that the Town Administrator is hereby authorized to enter into the contract on behalf of the Town of Mamaroneck. 5. Authorization -Transfer of Funds -Monroe School The Administrator,explained that the 1993 budget included an appropriation of$6,000 for the installation of an open pavilion at the Monroe School to increase available space for the summer camp, but'after study of the site it was found that the pavilion was on the site of the garage building which must be torn down. He added that upon demolition of the building it was found that a new concrete slab would be needed for the new pavilion, which would increase the budget from $9,900 to $15,000. He said that he was therefore requesting a transfer of funds in the amount of$5,100 and that he also needed authorization to pay BEC, Inc. of Larchmont$9,750 for the construction and $5,250 to J & S Interiors of Holtsville for the installation of the concrete slab. On motion of Councilman McGarr, seconded by Councilman Ryan, it was unanimously, RESOLVED, that the Town Board does hereby authorize the transfer of funds in the amount of$45,100 from unreserved funds to Account No. 7180.2102; and BE IT FURTHER RESOLVED, that the Town Administrator be authorized to make payments to BEC, Inc. of Larchmont-in the amount of $9,750 for the construction of a pavilion at the Monroe School, and the payment of$5,250 to J & S Interiors of Holtsville for the installation of the cement slab at the Monroe School 5. Authorization - Uncollected Water Bills The Supervisor explained that the Westchester Joint Water Works required that a resolution be approved which would allow those amounts owed for water bills to be added to the tax bills of property owners in the Town. She added that the total amount owed was quite small, $2,608.35. On motion of Councilman McGarr, seconded by Councilman Ryan, it was unanimously, 5 December 15,1993 RESOLVED, that the Town Board does authorize the Receiver of Taxes to add to the tax levy the amounts owing on unpaid tax bills as prepared by John Jock, Manager of WJWW as follows: Pursuant to Chapter 654 of the Laws of the State of New York 1927, as amended, and to the resolution of the Board of Trustees of the Westchester joint Water Works at a meeting held September 13, 1993, a certified copy of which is attached, we are submitting herewith a list of arrears for water charges to the various properties in the Town of Mamaroneck as of June 30, 1993 and remaining unpaid on the date of September 10, 1993, identified by block and parcel numbers of the assessment rolls of the Town of Mamaroneck, as prepared by the Manager and verified by the . Office Manager and certified to by the Chairman of the Board of Trustees of the Westchester Joint Water Works and the Clerk thereof, for the purpose of inclusion in the 1993 tax levy of the Town of Mamaroneck, in the aggregate amount of $2,608.35. 6. Report of Bids - Contract 93-5 - Premium Marsh The Administrator explained that the only bid submitted was from Aqua Dredge, for$796,287 which exceeded the budget by over$350,000. He said that the Town had scheduled to meet with the army corps of engineers to discuss alternative plans to dewatering the dredged materials. He said after that the project would be resubmitted for bid. 7. Report of Bids - Contract 93-6 - Dehumidification Equipment The Administrator said that this contract calls for the installation of a dehumidification system and the associated support structures for the equipment at the Hommocks Ice Rink. He said that the lowest responsible bid meeting the specifications was submitted by C. W. Davis Company of Syracuse, adding that the Town's consultant, WBA group had made the evaluation and recommendation on this bid. Bids are as follows: C.W. Davis Company $39,700 Syracuse, NY Hi Tech A/C Service, Inc., 62,800 Farmindgale, NY Frank & Lindy Plumbing 73,700 Peekskill, NY Hi-Tech H.V.A.C. Systems 79,500 Buchannan, NY Brothers Mechanical Service 94,900 Great Neck, NY After discussion, on motion of Councilwoman O'Flinn, seconded by Councilman McGarr, it was unanimously RESOLVED, that the Town Board award the contract for dehumidification equipment to C. W. Davis Company, Syracuse, New York in the amount of$39,700 as the lowest 6 December 15,1993 responsible bidder for the above installation and equipment at the Hommocks Ice Rink. 8. Authorization -Closing of Financial Records - Fiscal 1993 The Administrator said that the Town Comptroller was asking for authorization to make the entries and transfers necessary to close the financial records for 1993. On motion of Councilman Ryan, seconded by Councilwoman O'Flinn, it was unanimously RESOLVED, that the Town Board does hereby authorize the Town Comptroller to make all necessary journal entries and budget transfers to close our fiscal year 1993. 9. Salary Authorizations - Recreation - Court Clerk's Office Recreation On motion of Councilman McGarr, seconded by Councilman Ryan, it was unanimously, RESOLVED, that as provided for in the 1993 Town Budget, authorization is hereby granted for payment of salaries to the following: Kristin Donohue, Head Swim Instructor, Hommocks Pool, $17.50 1hour, effective 1/2194 Mike Gonzales, Swim Instructor, Hommocks Pool,$16.50/hour, effective 1/2/94 Kevin Hopkins,Teen Center,$28 per session,effective retroactive 1213193 Doug Carroll, E.M.T., Hommocks Ice Rink, $7 1hour,effective, retroactive to 1211/93 Court Clerk's Office The Administrator said that due to the retirement of Janet Farrand, it would be necessary to authorize the salary of Rose Gareri, who has applied for the position of Assistant Court Clerk. On motion of Councilwoman Price, seconded by Councilman Ryan, it was unanimously, RESOLVED, that the Town Board does hereby approve the salary authorization for Rose Gareri, as Assistant Court Clerk at a salary of$28,550 per year effective January 3,1994 ADDED ITEM 10. Authorization Retainer Agreement- Burly Kass &Chase I have no paperwork on this, therefore I can only submit the following: On motion of Councilman McGarr, seconded by Councilwoman O'Flinn, it was unanimously, RESOLVED, that the Town Board does hereby.approve the retainer agreement for legal services of Burly Kass & Case. 7 December 15,1993 APPROVAL OF MINUTES - November 4, 1992 Regular Meeting -June 23, 1993 Special Meeting On motion of Councilwoman Price, seconded by Councilman McGarr, the minutes of November 4, 1992 and June 23, 1993 were approved as submitted. PROCLAMATIONS -Supervisor Caroline Silverstone - Louis N. Santoro -John D. McGarr The Supervisor-Elect, Elaine Price read the Proclamations into the record. PROCLAMATION LOUIS N. SANTORO WHEREAS, for over 16 years Louis Santoro has unselfishly devoted his time and energy to the delivery of fire protection services to all the residents of the Town of Mamaroneck; and WHEREAS, he has developed his leadership capabilities guiding the Fire Department, first as Second Deputy Chief, subsequently as First Deputy Chief and most recently as Fire Chief; and WHEREAS, it was during the tenure of Chief Santoro that the Fire Department won voter approval to reconstruct the Fire House; and WHEREAS, Chief Santoro has performed outstandingly in coordinating paid and volunteer crews, and he has managed to deep exemplary control of his budget despite a myriad of emergencies; and WHEREAS, during the December 1992 storm, LOUIS coordinated in advance all rescue and emergency teams and himself stayed on duty for 24 hours in further service to the people of the Fire District. NOW THEREFORE, BE IT RESOLVED, that I Caroline Silverstone, Supervisor, and the members of the Town Council of the Town of Mamaroneck hereby present this Proclamation to CHIEF LOUIS SANTORO in deep appreciation for his dedicated service to the Town. IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of Mamaroneck to be affixed this 15th day of December 1993. PROCLAMATION JOHN D. McGARR WHEREAS, Councilman John D. McGarr has served Larchmont Village and the community of St. Agustine Church with considerable distinction before accepting an appointment to the Town Board on September 27, 1988; and WHEREAS, Town residents recognized his value and elected him to a full four-year term in 1989; and 8 December 15,1993 WHEREAS, JOHN brought to the Town his training in economics.and corporate finance and helped fine tune the Town Budget; and WHEREAS, JOHN took on the responsibility of working with the Recreation Commission and helped to develop policy for the myriad of recreation programs now available; and WHEREAS, JOHN balanced the pressures of a hectic schedule at IBM, with the joys and responsibilities of a young family and still never failed to be a major contributor on all Town matters; and WHEREAS, JOHN offered caring and thoughtful support to all of us. NOW THEREFORE, BE IT RESOLVED, that I Caroline Silverstone, Supervisor, and the members of the Town Council of the Town of Mamaroneck on behalf of all Town residents offer our gratitude and appreciation to JOHN D.
