HomeMy WebLinkAbout1993_12_01 Town Board Regular Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON THE 1ST DAY OF DECEMBER 1993 IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order and on motion made and seconded was adjourned into Executive Session in Conference Room A of the Town Center at 7:00 PM. RECONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 8:25 PM in the Court Room of the Town Center. Present were the following members of the Board. Supervisor Caroline Silverstone Councilwoman Elaine Price Councilman John McGarr Councilwoman Kathleen Tracy O,Flinn Councilman Paul A. Ryan Also present were: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Stevan M. Silverberg, Town Counsel CALL TO ATTENTION Supervisor Silverstone pointed out to those assembled the locations of exits as required by law for public gatherings. PUBLIC HEARING - 1994 Preliminary Budget On motion of Councilman Ryan, seconded by Councilman McGarr, the public hearing was unanimously opened. The Administrator gave an overview of the changes that had been made, to the tentative budget-that had been submitted in October. He said, that the 1994 preliminary budget without the inclusion of the new, Ambulance District would have of$15,467.135, an, increase of 3%. He explained that with the inclusion of the, Ambulance District the appropriations would rise by $427,000 and revenues by $264,860. Which, he added, would increase the tax rate by $ .98 per thousand of assessed valuation, levying an average of$19.60 per household for the Ambulance District. He also said that the budget maintains all current municipal services, but does not reflect the salary expenditure for 1994 due to the fact that the Town is currently negotiating with all three of the unions. He said that there would be an increase to personnel in the Recreation Department because of the extension in the ice rink season and the reinstatement of personnel to the Hommocks Pools which had been closed. The Administrator said that in addition the Town would be hiring a Junior Engineering Aide to work in the Building Department. The Administrator then outlined that overall revenues are expected to rise, and that the 1994 budget has $465,430 applied from unreserved funds. The Supervisor then asked if there were any comments from the residents, either for or against. There being none, she then asked the Board for comments. They all concurred that the budget process was getting to be more difficult, that many budget work sessions had been held, with department heads, as well as with agencies that December 1,1993 request funds. The requests are increasingly, but the funds are not and that is extremely . difficult in these times to decide which items to cut and which to not. They all expressed their gratitude to the Administrator and Comptroller for their efforts and work on the budget. They concluded that overall they felt it was a good budget, reflecting solid change to the escalations of cost. There being no further comments, on motion of Councilwoman Price, seconded by Councilman Ryan, the Hearing was adjourned to December 15, 1994. PUBLIC HEARING - Local Cable Rate Regulations On motion duly made and seconded, the Public Hearing was declared open., On motion duly made and seconded, the Public Hearing was declared open. Councilman Ryan explained that due to a change in regulations it would be necessary to amend Local Law No. 10-1993 to provide the possibility that certain areas of rate regulations may be taken over by the New York State Cable Commission. He said that essentially it allows us to regulate equipment and rate changes in the event that the New York State Commission does not choose to, adding that this effects basic service. He also said that as this was a Tri-Municipal agreement that the Villages of Mamaroneck and Larchmont would also be passing the law. There being no further comments, on motion of Councilman McGarr, seconded by Councilman Ryan, the meeting was closed. Therefore, on motion of Councilman McGarr, seconded by Councilman Ryan, it was unanimously: RESOLVED, that the Town Board does hereby adopt Local Law No. 11-1993, which amends Local Law No. 10-1993, which provides for a change in the way that cable TV rates are regulated, as follows: LOCAL LAW NO. 11-1993 This Local Law shall amend Local Law No. 10-1993 Procedures and Standards for the Regulation of Rates for Basic Cable Service and Equipment. Section 1. Purpose: The purpose of this local law is to amend local Law No. 10-1993 in order to provide for the possiblility of, preemption of certain areas of regulation of rates by the New York state Cable Commission. Section 2. Amendments: The Locale Law shall be amended by adding the following provision: 0.2 : To the extent the New York state cable Commission establishes final rules for rate regulation that must be followed by franchising authorities, those rules will govern as if fully set forth herein. However,. to the extent the rules of the New York state Cable Commission allow franchising authorities to follow different or additonal rules, the provisions set froth herein that may be enforced consistent with the rules of the New York state cable oammission shall continue to apply. section 3. severability: Should any provision of this Local Law be declared invalid by a court of co petent jurisdiction, such declaration of invalidity shall not effect any other section of this local law which may be otherwise capable of enforcement. Section 4. Effective Date: This Local law shall take effect innediately. 2 December 1,1993 APPROVAL of MINUTES -August 20, 1993 Special Meeting On motion of Councilwoman Price, seconded by Councilman McGarr, the minutes of August 20, 1993 were approved as submitted. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner Silverstone at 9:40 PM in the Court Room. Present were the following members of the Commission: Commissioner: Caroline Silverstone Commissioner: Elaine Price Commissioner: John McGarr Commissioner: Kathleen Tracy O'Flinn Commissioner: Paul Ryan 1. Fire Claims: Commissioner O'Flinn presented fire claims for authorization of payment, and on her motion, seconded by Commissioner Price, it was RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's Office: Cleaning Systems $ 420.05 Dri-Chem 560.46 Elekā€¢Tek, Inc. 911.87 Everson Ross Co. 14.78 Excelsior Garage 1778.21 Federal Express 31.00 Thomas Landau, MD 1,440.00 Lee Miles Transmission 850.00 Metpath 225.90 New England Uniform Co. 103.00 Stateline Fire&Safety 88.00 Sound Shore Fire Protection 348.50 Tri-City Auto Parts 32.77 TOTAL $6,804.54 There being no further business to come before this board, it was declared adjourned by motion of Commissioner Price, seconded by Commissioner O'Flinn AFFAIRS OF THE TOWN 1. Appointments There were no appointments. 2. Set Public Hearing -Amendment to Local Law No. 6-1988 -Signs The Administrator explained this request was to be deferred until the next meeting. 3. Set Public Hearing -Amendment to Senior Citizen Property Exemption The Administrator explained that the State has increased the income level to which Seniors could become eligible for exemptions on their property and that in order for us to adopt 3 December 1,1993 these new income guidelines, it would be necessary to hold a public hearing. After some discussion, on motion of Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that the Town Board does hereby set December 15, 1993 at 8:15 PM to be the date for the Public Hearing on establishing new income guidelines for Senior Citizen Exemptions for property taxes in the Town; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the Notice of Public Hearing for the proposed local law in one of the official Town newspaper 4. Snow Removal Contract -Westchester County The Administrator explained that this contract was essentially the same as lest year's with no increase to the amount paid to the Town for snow removal on County streets. Councilman McGarr questioned certain items in the contract and felt that this item should be deferred until the Administrator could have certain items clarified. Therefore, it was decided to hold this over to a lager meeting. S. Salary authorization - Recreation On motion of Councilman McGarr, seconded by Councilman Ryan, it was unanimously, RESOLVED, that as provided for in the 1993 Town Budget, authorization is hereby granted for payment of salaries to the following: Anne Marie Joyce,Alternate Lifeguard, Hommocks Pool,$6.50 1hour, effective retroactive to 11/24/9 Kristen Rainaldi,Alternate Lifeguard, Hommocks Pool, $6.50/hour, effective retroactive to 11124193 Joseph Isidori, Lifeguard, Hommocks Pool,$5.50 1hour,effective retroactive to 11/24/93 Amy Caro,Alternate Lifeguard, Hommocks Pool, $7/hour, effective retroactive to 11/24193 Nicolas Brindel,Alternate Pool Manager, Hommocks Pool, $g/hour, effective retroactive to 11124193 Elana Petruzzelli, Lifeguard, Hommocks Pool,$5.50/hour,effective retroactive to 11124193 (started 811/93 at$5 1hour as lifeguard)., TOWN CLERK REPORTS The Building and Plumbing Report for the month of October and the Clerk's Report for the month of October, were filed for the record. ADJOURNMENT The Supervisor asked if there were any reports and if anyone wished to address the Board, as there were none, she asked and received a motion for adjournment.into Executive Session at 10:35 PM.
