HomeMy WebLinkAbout1993_10_06 Town Board Regular Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON OCTOBER 6, 1993 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 7:00 PM, at which time on motion duly made and seconded, the meeting was unanimously declared adjourned into Executive Session in Conference Room A to discuss real estate and contract negotiations. The Executive Session, on motion duly made and seconded, was unanimously declared adjourned into a Work Session at 7:45 PM, at which time the Board discussed overnight parking exemptions. RECONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 8:35 PM. Present were the following members of the Board. Supervisor Caroline Silverstone Councilwoman Elaine Price Councilman - John McGarr Councilwoman Kathleen Tracy O,Flinn Councilman Paul A. Ryan Also present were:, Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Steven M. Silverberg, Town Counsel CALL TO ATTENTION Supervisor Silverstone pointed out to those assembled the locations of exits as required by law for public gatherings. PUBLIC HEARING -Overnight Parking Exemption -Washing Square The Supervisor asked for a motion to open the Public Hearing and on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously, RESOLVED, that the Public Hearing be, and hereby is declared open. Following a brief explanation by the Town Administrator concerning the purpose of this Square, the Supervisor asked if on Washington S exemption from the overnight parking ban g q parking. on ban anyone wished to speak in favor of lifting the p g Joseph Mirabella, Jr., said that he is I favor of this law but only it it's for one side of the street, explaining that parking on both sides of the street might make it difficult for emergency vehicles to gain access. The administrator said that it was for the south side of Washington Square between North Chatsworth and Madison only. The Supervisor then asked if anyone wished to speak against the law, there being no response she requested a motion to close. October 6, 1993 The Public Hearing was unanimously declared closed and thereafter on motion by Councilwoman Price and seconded by Councilman McGarr the following resolution was unanimously adopted: WHEREAS, the Town has previously adopted an overnight parking regulation throughout the Town; and WHEREAS, after careful s tud y it has determined that it is not appropriate to continue the restrictions on overnight parking in the area of the south side of Washington Square due to the numerous apartment houses and limited parking in that area. NOW THEREFORE, BE IT RESOLVED, that the Town Board does hereby declare that the south side of Washington Square between North Chatsworth Avenue and Madison as exempt from the overnight parking restrictions previously adopted by this Board. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner Silverstone at 8:45 PM in the Court Room. Present were the following members of the Commission: Commissioner: Caroline Silverstone Commissioner: Elaine Price Commissioner: John McGarr Commissioner: Kathleen Tracy O'Flinn Commissioner: Paul Ryan 1. Fire Claims: i Commissioner O'Flinn presented fire claims for authorization of payment, and on her motion, seconded by Commissioner Price, it was RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's Office as amended: Brewer's Hardware $ 126.27 Cellular One 191.87 Compute& More 125.00 Dri-Chem Extinguisher Co. 277.50 Dri-Chem Extinguisher Co. 820.40 Frank's Carpet 400.00 Gall's 72.87 Gall's 133.23 MetPath 21.30 MetPath 42.60 MetPath 149.10 Tri-City Auto Parts 73.24 Dr. Landau 180.00 Dr. Landau 180.00 Technical Electronics 180.00 United Hospital 1,588.00 Town of Mamaroneck Professional 110.00 TOTAL 4 671.42 2 October 6, 1993 There being no further business to cane before this Commission, on motion by Commissioner Ryan, seconded by Commissioner O'Flinn, the meeting was unanimously declared adjourned at 8:50 PM. AFFAIRS OF THE TOWN 1. Appointments There were no appointments to come before the Board. 2. Authorization - Engineering Services - Hommocks Ice Rink - Dehumidification Mr. Altieri explained that he had given the Board members a copy of a proposal for engineering services to prepare specifications for the installation of the dehumidifiers at the Hommocks Ice Rink. He said that the total cost would be $4,800, which is part of the total project cost of the installation, and that The WBA Group was selected since they had prepared the original feasibility study for dehumidification, it was felt that they would have a better knowledge of what would be needed. There then was a discussion on what the hourly charges incurred would be should additional work be necessary and it was decided to include in the contract that if added work was needed, it would be paid at the rate of$75 per hour upon Board approval only. On motion of Councilwoman Price, seconded by Councilman Ryan, it was unanimously RESOLVED, that the Town Board does hereby approve the proposal from.WBA Group, Branford, Connecticut, for Engineering Services to prepare specifications for stem at the Hommocks a dehumidification s installation of Y Ice Rink; and BE IT FURTHER RESOLVED, that the expenditure for the above services shall not exceed $4,800, and should it be deemed necessary to have WBA do additional work, it will be upon Board approval only, and at a cost not to exceed $75 per hour. 3. Request-Temporary Sign Permit-Staples The Administrator explained that Staples was requesting that they be allowed to display banners beginning October 20, 1993 for approximately six weeks. i Councilwoman O'Flinn questioned the appearance as did Councilwoman Price. They also questioned the size and duration of the request. Mr. Altieri explained that the banners will have white letters on a red background and would be at the southeast and northeast corners of the building. After much discussion, on motion of Councilman McGarr, seconded by Councilman Ryan, it was unanimously RESOLVED, that the Town Board does hereby approve the request for a temporary sign permit for Staples, 2444 Boston Post Road with the following provisions: that there be a 15 day limit to the approval; that there be two signs only, at the southeast and northeast corners; and that the Building Department be notified prior to installation. 3 October 6, 1993 4. Set Public Hearing Date -Cable TV Legislation Councilman Ryan explained that he had requested that this item be placed on the agenda as it would be necessary for each of the committees, which oversee Cable TV through the Tri- Municipal Board of Control, to pass a law that establishes procedures and standards for the regulation of rates for basic service and equipment. He outlined the proposed law and requested that the Public Hearing be set for the next meeting. On motion of Councilman Ryan, seconded by Councilwoman Price, it was unanimously RESOLVED, that the Town Board does hereby set October 20, 1993 at 8:15 PM to be the date for the Public Hearing on establishing procedures and standards for regulating rates for basic cable service and equipment; and BE IT FURTHER RESOLVED, that the Town Clerk be authorized to publish the Notice of Public Hearing for the proposed local law in one of the official Town newspapers. 5. Letter from Conservation Advisory Commission RE: Greenway Trail The Supervisor said that she received a request to place signs along the Greenway Trail I honor of John Varsyannis,who had been instrumental I establishing the trail. She said that she had passed the proposal on to the CAC, who had replied that they supported the idea. The Board discussed the proposal and had no initial problem with it except that they would like to review the signage. It was agreed to hold this over. 6. Authorization -'Bank Signature Cards -Section 8 Housing The Administrator explained that Kathy Kopa, the new Director of Community Services, said that it was necessary for the Town Board to authorize the signature change for bank accounts for the: Town of Mamaroneck Public Housing Agency and the Larchmont/Town Community Services account. He said that the change was necessary since the authorized signature was still for Helen Mohan, who had retired. On motion of Councilwoman O'Flinn, seconded by Councilman Ryan, it was unanimously RESOLVED, that the Town Board does hereby authorize the change of signatures from Helen Mohan to that of Kathleen E. Kopa, Director of Section 8 for the Town of Mamaroneck Public Housing Agency account; and in her capacity as Director of Larchmont/Mamaroneck Community Services for the Community Service account. 7. Discussion - Postal Customer Advisory Council The Supervisor explained that she had received a letter from Thomas Riccio, Postmaster of Larchmont, which said that he was establishing a Postal Customer Advisory Council at the Larchmont Post Office. She said the letter outlined that the council would consist of volunteers from the community serviced by the post office and would provide a forum for customer concerns, and ideas; as well as giving the postal service an opportunity to answer questions and inform council members of new or changing programs and that he wished her, because of her position as Supervisor to serve as a member. Supervisor Silverstone said that she had many questions and wished to hold over this item. 4 October 6, 1993 B. Set Date Public Hearing -Sign Ordinance The Supervisor explained that the Board had been working on changes to the sign ordinance for quite a while and that it now appeared ready for adoption and she therefore requested a motion to set a public hearing on the ordinance. On motion of Councilwoman Price, seconded by Councilwoman O,Flinn, it was unanimously RESOLVED, that the Town Board does hereby set October 20, 1993 at 8:15 PM as the date for the proposed Sign Ordinance; and BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized to publish the Notice of Public Hearing in one of the Official Town newspapers. PROCLAMATIONS -Archives Week -Substance Abuse Awareness Month The Supervisor read the proclamations into the record: ARCHIVES WEEK WHEREAS, archives are central to research and education, both now and in the future; and WHEREAS, the archives of our governments protect the rights of citizens, support the effective operation of government and document the evolution of our democracy; and WHEREAS, greater public awareness of archival conditions and increased support for archival programs in the Town of Mamaroneck is urgently needed; and NOW THEREFORE, BE IT 6 October 6, 1993 RESOLVED, that I Caroline Silverstone and the members of the Town Council of the Town of Mamaroneck hereby proclaim that October 10 through October 16, 1993 be observed as ARCHIVES WEEK IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of Mamaroneck to be affixed this 6th day of October 1993. SUBSTANCE ABUSE AWARENESS WHEREAS, the Town of Mamaroneck proudly joins the County of Westchester in fighting the War on Drugs; and WHEREAS, the Town of Mamaroneck joins Westchester County in observing the 1993 National Red Ribbon Campaign, which has become the symbol to eliminate the demand for drugs in our -country and demonstrates a commitment to a healthy, drug- free life-style; and NOW THEREFORE, BE IT RESOLVED, that I Caroline Silverstone and the members of the Town Council of the Town of Mamaroneck hereby proclaim that October is Substance Abuse Awareness Month IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of Mamaroneck to be affixed this 6th day of October 1993.
