HomeMy WebLinkAbout1993_08_08 Town Board Regular Minutes REGULAR MEETING OF THE TOWN BOARD AND THE BOARD OF FIRE COMMISSIONERS OF THE TOWN OF MAMARONECK HELD WEDNESDAY, SEPTEMBER 8, 1993 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W BOSTON POST ROAD, MAMARONECK, NY PRESENT: Supervisor: Caroline Silverstone Councilwoman: Elaine Price Councilman: John McGarr Councilwoman: Kathleen Tracy O'Flinn Councilman: Paul A. Ryan Also Present: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Absent: Steven M. Silverberg, Town Attorney The Supervisor said there was a scheduling conflict and the Town Attorney was absent because he had to attend the Planning Board meeting tonight. CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 6:30 PM in a Work Session to discuss, the Preliminary Draft of the FEIS-Conservation Recreation (CR)Zone, capital projects-computers, labor negotiations, ambulance service and the library. RECONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 8:27 PM. CALL TO ATTENTION Supervisor Silverstone pointed out to those assembled the locations of exits as required by law for public gatherings. PUBLIC HEARING - No Left Turn - Boston Post Road -GAP Store On motion of Councilwoman Price, seconded byjCouncilman Ryan, the public hearing was opened. It was explained that the purpose of the public hearing was to prohibit left turns for cars exiting onto the Boston Post Road from the parking lot of The Gap. The Supervisor asked if there was anyone wishing to speak either for or against the law. Sandy Tashoff asked if the following letter could be read into the record: September 8, 9993 Honorable Town Board Members September 8, 1993 I regret not being able to devote my sole attention to the Board's Public hearing regarding'no left turn onto Boston Post Road from the GAP store. As you know the Planning Board is meeting tonight and I have a commitment to attend this meeting as well. Since you both meet on the same evenings it is often necessary to divide one's loyalties. I am, however, very concerned with the issue of left turns for access or egress from The Gap store on Boston Post Road as well as on Weaver Street. These turns present a clear hazard to pedestrians and to vehicles in this area. It is especially critical in view of the fact that many students use Boston Post Road and Weaver Street on their way to and from Mamaroneck High School, Central School and the Hommocks School. I recognize that the location of the GAP, HOME FAIR CAMERA, and FINAST present unique traffic problems since one needs to gain access without crossing lane(s) of oncoming traffic and the only cross streets that make this possible are Weaver Street, to the south, and Richbell Road, to the north, which are approximately%of a mile from one another and require a very circuitous route. On Central Avenue,in Scarsdale, such turns are made possible by a center turn lane accessible to north and southbound traffic,and often accompanied by signal lights. I consider this to be the only alternative that should be considered in legalizing left turns at Boston Post Road and Weaver Street locations. I am confused by the necessity for this hearing tonight because I thought that the left turn problems were discussed and resolved when he GAP stores sought their permit from the Town and hat their application included the:Town's resolution of this. I would appreciate clarification of this. Sincerely yours, Sandra Tashoff. It was explained for the record that any traffic regulations must be approved by the Town Board. On motion of Councilwoman Price, seconded by Councilman McGarr, the public hearing was unanimously declared closed. Then on motion of Councilman Ryan, seconded by Councilwoman O'Flinn, the following law was unanimously adopted: LOCAL LAW NO. 9 - 1993 This Local Law shall be known as "No Left Turn" Section 1. Purpose: The purpose of this local law is to provide for restriction of traffic flow a 1340 Boston Post Road in Accordance with site plan approval granted by the Town of Mamaroneck Planning Board and the request of the owner as provided under Vehicle and Traffic Law Section 1660 (a). Section 2. Left Turn Prohibited: There shall be no left turn out of the parking lot located at 1340 Boston Post Road onto Boston Post Road. Section 3. Signs to be Erected: Appropriate signs shall be erected designating the area described in Section 2., as a "No Left Turn" area. Section 4. Effective Date: This local law shall take effect immediately. AFFAIRS OF THE TOWN 1. Appointments -Conservation Advisory Commission A communication was received from the Village of Mamaroneck recommending Ruth Merson to serve as their representative on the Town's Conservation Advisory Commission. 3 September 8, 1993 On motion of Councilwoman O'Flinn, seconded by Councilman Ryan, it was unanimously, RESOLVED, that the Town Board of the Town of Mamaroneck does hereby appoint Ruth Merson to the Conservation Advisory Commission of the Town, representing the Village of Mamaroneck, said appointment to take effect immediately. OUT OF ORDER 5. Discussion -Sister City Relationship -Wealing, China Supervisor Silverstone said she had spoken to James Heimowithz regarding establishing a `sister city' relationship with Wealing, China. She said it sounded like a fascinating and culturally enhancing experience, but suggest the Town Administrator gather more,information on Wealing before proceeding. 2. Resolution of Dedication - Locust Ridge Road A memorandum from the Town Attorney said he had researched this, and the actual filed maps do not contain Locust Ridge Road going through the property owned by the Town and the mapped road actually ends at the point of the Town's property. Under the circumstances there should be no problem with the Town designating their property as park land. Pursuant to Subsection 220 of New York State Town Law, the designation can be by resolution subject to permissive referendum. The resolution should state it is subject to permissive referendum and the appropriate advertisement should be made by the Town Clerk of the adoption of the resolution. In addition, a survey has been requested and a metes and bounds description should be included in the resolution authorizing the designation of this property as park land. Once the property is designated as park land, the designation cannot be removed except through an act of the State Legislature, and the property cannot be utilized for any other purpose. On motion of Councilman McGarr, seconded by Councilwoman O'Flinn, the following resolution was unanimously adopted: WHEREAS, The Town owns a certain parcel of land known and designated on the tax assessment map as block 105, lots 124 and 579; and WHEREAS, the property is adjacent to other parcels owned by the Town which have been designated for conservation purposes; and. WHEREAS, the Town CAC and CZMC have reviewed the potential uses of the property and have determined that the best use of the property would be as park land so as to preserve it character in perpetuity; IT IS NOW THEREFORE, RESOLVED, that block 105, lots 124 and 579 are hereby dedicated in perpetuity as park land; and BE IT FURTHER, RESOLVED, that the Town Administrator shall cause a metes and bounds description to be drawn for this property by a licensed surveyor and provide copy of such description to the Town Clerk to be annexed to this resolution. 4 September 8, 1993 The Supervisor added this property was over an acres and requested the resolution be sent to all residents. 3. Reports of Bids -a) Road Resurfacing b) Replacement of Sidewalks c) Leaf Loader Road Resurfacing The Administrator gave a breakdown of the bids received, and recommended the contract -TA -93-3 be awarded to Peckham Road Corporation. The bids received were: POSITION CONTRACTOR TOTAL BID Low bidder Peckham Road Corp $128,486 2 ELQ Industries, Inc. 131,240 3 Bilotta Construction 133,675 4 Montesano Bros. Inc 137.710 Supervisor Silverstone requested letters be sent to residents letting them know when their streets will be under construction and that pruning must be done either by them or the Town will do it. On motion of Councilwoman Price, seconded by Councilwoman O'Flinn, it was unanimously, RESOLVED, that the Town Board does hereby award contract TA 3493 for Road Resurfacing to Peckham Road Corporation of White Plains, who submitted the lowest responsible bid in -the amount of$128,486; and BE IT FURTHER RESOLVED, that the Town Administrator be and is hereby authorized to execute said contract on behalf of the Town. Replacement of Sidewalks This is for Contract TA 93-4, replace of sidewalks and related work. The bids received were from: POSITION CONTRACTOR TOTAL BID Low bidder Persico Contracting $ 86,400 2 ESBE Contracting 89,850 3 Peter J. Landi, Inc 90,000 4 N. Picco &Sons 111,020 5 DiSisto Construction Corp 112,020 The Administrator recommended the low bidder, Persico Contracting be awarded the bid, and said the sidewalk replacement work would begin with ten days. On motion of Councilwoman O'Flinn, seconded by Councilwoman Price, it was unanimously RESOLVED, that the Town Board does hereby award contract TA 4-93 for Replacement of Concrete Sidewalks and Curbs, to Persico Contracting, of Mount Vernon, who submitted the lowest responsible bid in the amount of$86,400 and 5 September 8, 1993 BE IT FURTHER RESOLVED, that the Town Administrator be and is hereby authorized to execute said contract on behalf of the Town. Leaf Loader This bid award was held over. 4. Authorization - Capital Project Accounts This matter was not discussed. 6. Salary Authorization - Environmental Coordinator - Recreation A communication was received from the Assistant to the Administrator requesting salary authorization for Eve Nudelman, hired as Environmental Coordinator at a salary of $28,500. On motion of Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that the Town Board of the Town of Mamaroneck does hereby authorize the salary of Eve Nudelman, who will serve as Environmental Coordinator at a salary of$28,500, effective September 13,1993. e Recreation RESOLVED, that the as provided for fin the 1997 Town Budget, the Town Board authorizes the payment of salary to the following: Josephine Amatuzzi Key Attendant $5 1hr. Eff. 912/93 6 September 8, 1993 PROCLAMATION -"Day of the Working Parent" DAY OF THE WORKING PARENT WHEREAS, there are an increasing number of Americans who balance work responsibilities with the demands of caring for children and elderly relatives; and WHEREAS, there is a critical need for both workers and businesses to learn more about child and eldercare options; and WHEREAS, new solutions.must be sought to help achieve a balance between work and family; and WHEREAS, the National Council of Jewish Women is forging partnerships in communities around the country to broaden employer and general public awareness of dependent care issues and to implement strategies for meeting those needs. NOW THEREFORE, be it RESOLVED; that I Caroline Silverstone, Supervisor, and the Members of the Town Board of the Town of Mamaroneck hereby proclaim Thursday, September 9, 1993 THE NATIONAL COUNCIL OF JEWISH WOMEN'S DAY OF THE WORKING PARENT IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of Mamaroneck to be affixed this 8th day of September 1993. ORAL COMMUNICATIONS Valerie O'Keeffe, a Town Resident asked about problems at the firehouse. Councilwoman Price explained the monies expended were added from he contingency budget in the amount of approximately $40,000 to $60,000. TOWN CLERK REPORTS The Town Clerk Filed the Building Department August Monthly report in the amount of $320,600.00 ADJOURNMENT On motion of Councilwoman Price, seconded by Councilman Ryan, the meeting was unanimously adjourned into an Executive Session to discuss the ambulance district at 9:10 PM. DiCioccio, Town Clerk 7 September 8, 1993 There was a Work Session held to discuss an upgrade to the AS400 System and to accept the Draft Environmental System submitted by Ferrandino and Associates. There was discussion on capital projects which could amount to approximately $65,000 or more for the upgrade to the Finance Office's AS400 computer system. The Board discussed changes to different pages of the document, and they expected further comments from Councilwoman Price to be delivered the next day. They said the public hearing should be set for October if Ferrandino gets the document delivered by September 22, 1993.
