In the absence of the Supervisor the meeting was called to order by Justice Boyd at 2 .30 P.H. Present: Justices Boyd, Collins , Leeds and 1'essersmith town Clerk Harvin 2issessor Laddock The Board of Assessors having prepared tentative jury lists , �y�-_rcsented the same to the Board. for its consideration, and after examination and verification of said lists by both the Board of Assessors and the -2c,,,,n Eoar4 it ,,vas , upon motion, duly made and seconded P,I7S0I,V2-D,. that the completed lists of the grand and trial jurors be and the same hereby are approved and certified by the members of both Boards ; and it ryas further RE S OLV_HTD, that the I o wn Clerk be and he hereby is authorized and requested to forward certified lists to the Commissioner of Jurors in the form required by 7-aw., The Board then proceeded to execute the certificates for said Jury lists. Assessor 11addock thereupon withdrew fror.a the meeting and the members of the lovin Board reconvened as the Town Board. .4. co.,miunication dated September 3rd ,-zas received from the Lawyers Title and Guaranty Company requesting cancellation of certain taxes as erroneous and illegal. The letter was referred to Counselor Gamble . Justice Leeds reported as Chairman of the Fire House Committee that the Committee together v.rith Architect Charles -7 'ink had inspected the Weaver Street Fire House following the completion of the painting contract by Hichael J. Yanning and that they unanimously approved the work and that they recommend payment of 17anning's final claim in the amount of .�?1,650.00 including I31,250.00 for final payment a-Lac! ;,;400.00 extra for use of marine. Upon motion by Justice Lecd1s , seconded by Justice �Jessersmith, it :Iras u:oon roll call unanimously R, _?ire IFSOLVED that the report of the " re House Committee as presented by 'Chairman Leeds , be p a p. roved and that the claim of Ilichael J. Kanning in the amount of T1,050.GG for final payment of the ':=saver Street Fire House painting contract, be and the same hereby is approved and ordered paid. Justice 7�_Ilessersiyiith re-oorted on the Com. utation Rates Case against the I.ew York, Yew ffaven& Hartford Railroad Co. , and asked if the '2o7,= Board wished to have a. representative attend the Hearings on this case . U-Oor. motion by Justice 'Collins, seconded by the Clerk, it was unanimously VA R'SOMED, that justice Hessersmith be and he hereby is designated representative of this Board to attend the Hearings on the Yew York, Yew Haven L Hartford Railroad Company Commutation Rate Case. The Clerk requested approval by the Town ?Board for the usual publication of notice of registration, including the time , place and brief description of hounGary of each election district. Upon motion by Justice Mossersmithv seconded by the Clef it was upon roll call unanimously RESOL I)p that the Clerk be and he hereby is authorized to attend to the publication of the usual noticgtf registration including time , place and brief description of the boundaries of the cleciion districts , in both the daily Times and the Larchmont- Times in accordance with Section 75 of the Mection lay, and that the cost of same be made a proper town charge. The Clerk presented a communication which he had received by special messenger from Charles 11ac Donald,. County !_ngineer, requesting immediate signing of new tracings showing the in_prove- ment of the Boston Post Road. The Clerk explained that Ex. Yac Donald said that the tracings were identical with those previously approved by the Board and signed by the Clerk except with regard to the corrected existing property lines.. Yo changes were included in regard to the details of the improvement, which he said waa definitely assured of, and therefore he signed the tracings which were presented to him by special -messenger with the request for immediate signing® Thq Clerk repowited thatza certify°cute of indebtedness in the amo "i`t of 150 ,P 0, 00 forty he uieave,/ Street Sidewalk, improvemsot would become due d payable,,-'on Octop i 1st,-,�i930 and that NAM been advised that✓ a rescl flon was Qeded t-g authorize renew of this oertificate"Z, LTppt motion b ytne Cie rksI seconde�`by Jus i e lc-sser- jbith , it 3A upon rol call unaruimously The Town Clerk stated that a temporary certificatd of indebtedness in the amount: of 450,000@ authorizdd by resolution adopted by this Board at a meeting held on Hay 7 , 1930 in antic- ipation of the amount to be raised by sidewalk assessment and/or the sale of sidewalk district bonds to pay the cost of grading and constructing sidewalks along veave-r Street and to acquire the necessary property required for that purpose as provided by article 11-a of this Town Law, will become due and payable on October 19 1930 at the Trust Company of Larchmontg that the total cost of the improvement is now being determined and thet steps will be taken shortly for the purpose of holding a hearing and levying the assessment as provided by law; that in the meantime it will be necessary to take appropriate steps to the end that a new certificate may be authorized in the place of the one that is due on October 1st, as stated above., Whereupon, Justice- hessersmith offered for adoption the following. 1 RESOLVED, that the Supervisor be and hereby= is authorized and empowered to borrow upon the faith and craft of the Town of Yamaroneck the sum of j50,000.00 for which he shall issue in the name and under the seal of said Town a temporary certificate of indebtedness in antic- ipation of the amount to be realized from the sidewalk assessment to be made and levied and/or the sale of sidewalk district bonds in accordance with the provisions of Section 253 of the Town Laws and it is further RESOLVED, that said certificate shall be sold for not less than the par value thereof, shall bear interest at a rate not to exceed 6% per annum and shall mature at such time as the Supervisor may determine not exceeding, however, one year from the date thereof; and it is further RESOLVED, that the proceeds realized from the sale of said certificate shall be used and applied in payment of temporary certificate of indebtedness Yo. 3 in the amount of :_250,00000 which is due and payable at the Trust Company of Larchmont on October 1, 1930 ; and it is further RESUT;,VT+_r1D, that the Supervisor and Town Clerk be and hereby are authorized and empowered to sign, execute and deliver such papers as may be necessary and proper to effect the sale of said certificate. The question of the adoption of the foregoing resolutions was put to a vote which resulted as follows : Ayes ; 5 Xo es none The Chair declared the resolutions duly adopted.
